Are you already married and filing for a K3 visa or are you looking to bring your fiance over? If you're not married yet then there is no need to worry, the person that you talked to has no idea what they're talking about.

If you ARE married already though, you did need to file the I-130. I hope this helps.

Yeah, if we're not on Messenger, we're on the phone or webcam, or sometimes both at the same time! We actually fall asleep on the phone! I know it sounds ridiculous but that way it's like we're spending time together and if I wake up in the middle of the night from a nightmare I can wake him up and he's there for me. (That's happened more than once!)

I couldn't imagine not talking every single day! He's the person I want to tell everything to, and share everything with. Heck, sometimes we don't even talk. Just listening to him breathe and knowing that he's there is enough for me.

I agree with Laura though. If you haven't met her in person yet, that's the first thing to do. Don't even worry about emails if this requirement hasn't been met! We didn't submit emails actually or any written correspondence. We showed boarding passes, passport stamps, pictures of us together, and phone bills.

I went to visit my fiancee 4 times between NOA and interview at the consulate. My last trip was 2 weeks before the Consulate interview and never had a problem. Though, I always had a employment letter from work and a return ticket information.

They never gave me a hassle. I WAS ALWAYS TRUTHFUL. Don't lie.

The visa just gets you in. The marriage is what makes you legal to be here (plus the requirement that within, what is it, 2 years? you begin AOS process - but better to do that ASAP).

Hello,

This has likely been asked before, but I really would like to hear from anyone that has immigrated from Canada to the US with the K-1 Visa.

My fiancee and I will begin the filing process in a few days (package is together, just waiting for some documents she mailed to me). We really want to do everything right, but if we can, we would rather not be apart. We had plans to meet together halfway in Knoxville for Labor Day weekend (driving, not flying), but we are now curious if she can remain here for longer than just that weekend.

Ideally, she'd stay with me until Christmas, at which point we will both fly to Canada to spend the holidays with her family. She will then remain in Canada until the Visa is issued.

This means, however, that she will be quitting her job before September (she cannot get a 4 month leave of absence, of course). She is also currently living with her parents to save money.

If she were to visit as a guest from September to December, would we be hurting our chances in any way? She doesn't have much evidence to prove her ties to Canada. Even though we truly do intend to do this the proper way, I'm wondering if they might not see it that way.

Also, at the border, should she simply announce that she is visiting for pleasure for 4 months? Or should she tell them our full intentions (visiting for 4 months, return until application approved, etc)? If she omits the latter, could this upset the USCIS?

If she discloses it, could the border guards turn her away?

It hurts so much to be away from her. I want to do all of this properly, but if we can see each other in the meantime, we really want to try.

Oh, also, since she will no longer have a job, what do people normally do about health insurance? Just be really careful? :unsure:

Speaking from experience as of late she will lonly be able to stay in the states for a period of 90 days at a time but in total a period of 180 days but they will question her for sure they did me every time but more so at the Sarnia border even though I showed all docs to prove I was coming back, I was able to continue my trip but it was ifie for over 2 hrs,al I can say is go for it the worst that could happen is that they deny her but it's a chance I guess we've all taken at some point in our relationships.
But may I add to that if you already have a visa pending and your in the system the chances are slim at least thats what I've been told!

It is on the DS-156K, Nonimmigrant Fiance(e) Visa Aplication. The form on the website expired 7/31/2007. In Colombia, the DS-156K is submitted with the DS-156. I assume it is the same everywhere, but maybe not.

The DS-156K has a list of documents that must be attached in order to apply for a Fiance(e) Visa. One of those documents is Evidence of Engagement to Your Fiance(e).

As far as I know, most people fulfill this requirement by submitting a new letter of intent.


Thank you. I missed the "K". No, not all Consulates use this form. A letter of intent will do nicely. Some countries may have official documents for engagement. I wouldn't know.


This line on the form appears to be relatively new. There is no requirement or law to have a ring. Most people wouldn't dare make any plans for a wedding because this process is so unpredictable and again, there is no requirement for proof of wedding plans, etc. The letter of intent should be more than sufficient as well as anything else you might have i.e. engagement cards, etc. Not something to stress about.

Hello. I was reading Ds-156K form every other thing I got it but... Evidence of Engagement to Your Fiancé ?
what do I need to have to prove this ? is Letter of Intent good enough ?


I have a question for anyone who could maybe give me an answer , we got engaged back last Feb 14th but we haven't got the ring yet because we oted to put our money to better use (ie) filings fees etc.. question is would a letter of intent be good enough as one post said? Or do we have to show ring reciept and pics? But we don't have it yet. what do we do? Any suggestions on this matter would be greatly appreciated!

Does anyone really believe that this is NOT a troll? Yes there are a lot of dumbos out there -- but this is a case where the I-129F makes it CRYSTAL CLEAR that you have to prove you've met in the prior two years and describe that meeting. The form even clearly says "Explain also in detail any reasons you may have for requesting that the requirement that you and your fiancé(e) must have met should not apply to you".

I don't believe a real applicant filling out the form would just decide to skip that part.

I'll give you a brief history, I've had 3 kidney operations one gullbladder removal,5 kids all healthy and alive and well last 2 were twins all this while I had been sick with my kidney over the years and had my tubes tied. Ok question is I had my right kidney removed back in 1997 do to cronic infection from the 2nd surgery 11 years earlier,Will this be an issue for my medical?
I am in perfect health now and have been since the 1997 surgery,I'm very active still ride my horses,and still participate in shows, barrel racing & dressage, I walk everyday rain or shine.
Should I get a letter from my family doctor stating that I'm fine even though I will have ALL my medical records with me ( they go every where I go) when I go for my medical?

We did f. Fraud only occurs if the spouse stays and then tries to adjust status. But just an FYI I didn't know when I went to visit the US that we were getting married - my husband had everything organized and surprised me so that we could elope. If she has a job/school to go back to there shouldn't be a problem at the border.


f Get married when she visits the US for the weekend under the VWP (visitor) in a few weeks time. She flies back the Monday after which i start the K3 filing process. Same as e but i guess more risky [potential visa fraud issue / intention]. On the bright side, now we do not have to deal with the Canadian system to get a marriage certificate which might add some delays to the whole process

The K1 should not have been sent to Chicago. It should've gone to Vermont, California, Nebraska or Texas, based on where the USC lives. This is also pretty clear on the instructions as well as the USCIS website.
