As for me, I will not advise a young person of 15, almost 16 to go out and just get a K1. Too many factors are involved with that journey to give out a flippant response such as that. If that's the response she wanted, she came to the wrong message board for that.


I agree; I wouldn't either. My fiancé and I don't even live as far apart as most people in a long distance relationship (flying is only one to two hours, driving might be about 7 or 8!) but going the K1 route was a very big decision even for us. I can't even imagine what it is like for people who are on opposite sides of the world, let alone very young.

I read your post when you posted it but had no clue what to say and I'm sorry I had no advice for you given the visa regulations! I'm also sorry about the poster who called you names - that was highly inappropriate and uncalled for. And you do not sound stupid at all; it does sound like you've thought a lot about this.

15 does seem pretty young but sometimes 15 year olds can be a lot more mature than 50 year olds.

Personally, I do think it wise to consider more seriously whether you really want to get married right now though. Everyone is different and you just might be ready to get married now, but at the same time, a lot of people think they are ready to get married (at ANY age,) and do it too quickly, and then their happiness is dashed and before you know it they either want a divorce, or are not happy together (who thinks that will happen to them when they believe they are in love?) No one knows why you and your fiancé want to get married, and in my opinion, it's not necessarily your age, but rather how compatible you truly are and whether you TRULY share the same values, that matters. The only thing here about age is that you can change a LOT in five or ten years and have a lot more firmer values and beliefs than you do now at 15, but a marriage in and of itself I don't think would necessarily be wrong - it depends on the motives. If you want to get married because you think you and your boyfriend are in love and because you want to escape either your country or people in your country because you think life will be better with your boyfriend and just so you don't have to be in Australia for two more years, I'd say that you shouldn't - marriage, AND going all the way on the other side of the country are huge responsibilities. I don't know your story or your reasons but getting married to escape a situation is not good (and I'm not saying you are, or that you have to explain - it's just a gentle warning. ;))

If you don't have on-line banking go into you bank. They can provide a photocopy of the check for you and you can get the number off the back. It is the one that starts with 3 letters.

I have a toll free bank number that I can call 24 hours a day to get my balance, hear what checks have been cashed etc... They system updates every morning around 5am . When I phoned this morning- sure enough the check number and amount was cashed on the 8th.

Unfortuantely, I can't see the back of the check because I don't have online banking. I'll just wait until snail mail comes.

I am certain you can go into your local bank, and they can look up recent checks in a few seconds on their computer.

My check was posted as "cashed" March 8. All the worry for nothing. I can't believe I'm so happy to turn over 170 to the government, but I am.

My worst fear was that the package would get sent back as incomplete or something ... I can't imagine they cash your check anyway.

So now the longer wait begins...

How do you know your cheque was cashed??? Is it based on a number on the back of the cheque??? I wish we knew that... I guess we have to wait for the NOA1, or another way my fiancé can see that his cheque has been cashed, but that might be awhile, lol. (If it shows up on a record that comes in the mail too that is)

From what I can see it looks like people who go through Vermont get their NOA2 faster BUT it can take a long time from then until the actual interview and getting the visa. :\

If you sent the originals, don't panic! There's no point in panicking now. You would have needed them at the interview anyway, and the government will already have them there.

Usually, the recommendation is to hold on to the originals for safe-keeping, since photocopies are completely fine at this stage. But if you sent them in, you sent them in. Don't lose sleep over it now.


Oh, I guess it's suggested to keep the originals just in case the package gets lost. But if all goes well then our original package will be sent to the Embassy? Hopefully our package won't get lost then!

Scanned copies are fine for your petition. You will need to supply originals for the interview if they are asked for. The way to handle that is make a complete duplicate copy of your packet. If they want to see originals you have them to show them. If they want to keep anything, they can keep the copies.

She wasn't denied the visa due to a mental problem. HE denied her due to the mental problem - he didn't want to marry her once he found out.


Yes, I understood that clearly but that doesn't negate what I was saying. I know they don't deny petitions based on just discovering that. BUT it's still important to them to figure out whether the foreigner has these problems, which is why I'm saying it seems so one sided - they don't care if the USC has them. We know we sent in all originals and followed all the guides and they were all signed, etc. etc, etc. We found the guide here on VJ very helpful and followed it to a t. We just have no idea what else they could "need" to make a determination. It's just very disheartening when we thought we were so close to being approved..


When you find out please let us know.

Maybe blank spots were left accidentally somewhere? I made that mistake with my G-325A form and almost didn't catch it despite looking the thing over several times.

1) From what I've learned, all the attachments should be dated and signed by the petitioner. I think I've heard about someone who got an RFE for not signing the attachments. But again, since there is no written rule about this, other service centres could have different policies about this. Have you sent your paperworks?

Please keep us in the loop on the specifics behind the RFE ... my friends got one for not providing a Circumstances of Meeting letter and not having dates on the proof of meeting photos. They say it stalled their process by about 3 months (CA Service Center).


3 months!? Scary! I didn't attach a circumstances of meeting letter... I just wrote a few sentences in the box where it said to. Should I have elaborated more? I said "I first met Ombeni while I was studying abroad in Tanzania in April 2006. He was a server at a restaurant where I was eating. I then returned to Tanzania from 12/06 to 03/07 to visit him."


We didn't attach a circumstances of meeting letter either. :/

I think its time for a protest. I'm making up my "HURRY UP" sign to picket outside the USCIS. Congrats on ALL the Vermont people and if I hear any one of you complain that your 3 weeks of processing takes SO long Im going to flip out on you.


Seems long to me right now since I haven't even heard of a NOA1 yet (it's been a week already, but then - we didn't mail it overnight and my fiancé probably hasn't even checked his email) :( and I'm worried we might have RFE's (hopefully not!) ....but, no, 3 weeks is incredibly short.

Thanks for all your opinions and thoughtfulness. I would like to add that i do have a copy of her divorce papers which i submitted one with the I-129F. But the copy i have is illegible & USCIS says i have to translate it into English so i asked her for a more legible copy which she has not sent. She is going to school full time & i wonder why if she plans to come to USA, she just enrolled for two months. She has not beat me out of any money to date and when i visited her in 11/06, she was very frugal with my money. But when i met her in 02/07, she seemed like a spender wanting a $1,200 dress. She settled for a $300 blouse, which is still a lot of money, but she was not happy. I also know she doesn't love me yet, but she has a 14 y.o. son and said she wanted a Dad for him, so i am hoping she will learn to love me. Thought i would add some more infor, it is hard to tell the whole story in one post. thanks again everyone, i am needing some encouragement to continue. But i am coming to realize that it may be a lost cause.


WHOA. I have to agree with all the other posters on this one. A $300 blouse? That's ridiculous! She definitely sounds like she is trying to commit visa fraud, and usually I'm not so quick to think so when someone posts about a questionable situation here. No woman who truly cares about you would expect you to buy her things like that. And if you remain with her it is not going to stop but get worse. If I were you I'd forget about her. She's using you and does not love you.

I dreamed last night that I got an email from USCIS requested proof of the level of proficiency of my fiance's French. Well... he doesn't speak French! Anyway... in my dream he did speak French but I couldn't get back on-line to send them the information. I remember being excited that they had been working on our case but was so frustrated because I was unable to get internet access. :D

I got all excited when I woke up to see if our case had been touched but....no luck. :wacko:

What does the term filing mean?

It seems like a lot of people take filing to mean the date that they receive their NOA1 (ie, "I mailed my petition in February, but it looks like I'll actually be a March filer), but I was under the impression that filing is the date you mail the petition. Like taxes, right? You have to file by April 17th, which just means that it has to be postmarked by then.

Are you looking at the ''official'' dates of their NOA1's, or the dates that their NOA1's arrived in the mail? Because no one knows the official date until they get the notice in the mail... we sent our petition on March 6 and didn't get the notice until March 15.

So far I'm 5 months into the process, and I probably have another 5-6 left to go. So over all, about 10 mos to a year for the K1 for me... (My fiance is a Canadian from Ontario and I'm a USC from Chicagoland)

It sounds like you'll just have to travel back and forth and you probably won't have the visa by September according to the current trends unless you are sending your stuff to Vermont and Vancouver, then you just may have a chance...


I'm from Ontario, Canada and my fiance lives in New Jersey, US. I will be driving to and from the USA when I go down in July... does that make it easier rather than flying?

I always thought flying would probably be easier since you can prove you paid for a return ticket, but that might not be true. I've always had a return ticket when I entered the U.S.!

I applied for a visa for my fiancee in December 2006 with I29F. We have received an interview date for June 18 at the the U.S. embassy in Manila.

However, we were married in the Philippines on April 28, 2007. I would like to change this application from a FIANCEE visa to a SPOUSE visa.

I'm asking this on behalf of a friend - I'm hoping what she and her fiance plan to do is legal, but I have my doubts and am not sure where to look for information.

He is in the U.S. and she is in Singapore. From what I understand they have already set a wedding month. She plans to come to the U.S. through the Visa Waiver Program in time for their wedding, process her green card during that time, and then leave the country, and return.

First of all, I am concerned that if she is honest about the intent of her visit - marriage - she may be denied entry.

Second of all, wouldn't she need to re-enter the U.S. with a K3 visa, because once she leaves she'd then be an intended immigrant?

Or is she legally able to come to the U.S. through the VWP to get married as long as she leaves, and will she be able to return?

Also doesn't it take a couple of months to a couple of years to process the green card?

So I was looking at the G-325A form in preparation to filling it out and I realized I might have a problem. I have had SO many jobs in the last five years that it's not funny. The problem I'm having is that I can't remember the exact dates that I worked in certain places, or even the order of the places that I worked at. I mean, I guess I'm relatively sure I know the order that I worked for them, but I'm not exactly sure of the dates. Is this going to be a huge problem I wonder? I really don't want to get any of this screwed up or get an RFE.

Any advice? Or has anyone had a similar problem? Any help is greatly appreciated!

Well, if all went right today and he made it to the post office, my fiance just sent our application for the I-129F in! YAY! I'm so excited, but nervous too! I get nervous at the funniest things. I'm just nervous about waiting so long I guess. From what I read, it sounds like the waiting times may be going far past the 6 months I was expecting. ~sighs~ Oh well, I've waited my whole life to find him, I don't suppose waiting a few more months will really hurt right?

Are you already married and filing for a K3 visa or are you looking to bring your fiance over? If you're not married yet then there is no need to worry, the person that you talked to has no idea what they're talking about.

If you ARE married already though, you did need to file the I-130. I hope this helps.
