Happened to me Jan 22, 2013. Still no completion. They probably just changed yours or your beneficiary's address. Although, if you didn't request this change, it's possible that they are working on your case.

A little ambiguous. But it doesn't necessarily mean they are working on your case.

our date has been passed , and we did call , and they said you should wait 38 days to consider it late , is it right ? or should we do something ???

I trust him because he is Cambodian and he did my uncles paper too. We only did the wedding ceremony we are not legally married our papers say we are engaged. I think he just didn't send the papers in yet...USCIS did not receive my packet yet... :'(

Nationality really shouldn't come into the trust radar for normal people (fraud is no respecter of nationality). If someone was Canadian, that would not make me trust them more.

Though the fact he did your uncle's papers and your uncle was approved is a good sign.

Wait, your uncle was approved, correct? I mean, he isn't waiting for the same things you are is he?

Some countrys have cultures that require a wedding ceremony be held before a marriage happens.
Some embassys ask to see this and if its not been done people are denied K-1 visas because they did not follow the norm cultural practice.

As long as the OP is clear that it is a cultural wedding ceremony and they did not marry they should be fine. If it is not the norm or they wore white wedding type attire and everything looks very wedding like then it can pose a red flag and make things difficult for the OP.

Good to know. I guess we should ask for clarification. Is the beneficiary and the spouse legally married?

Though, it still seems that the guy took their money without submitting any paperwork. And he did imply a guarantee of fast processing times (which you're never supposed to do if you're legit), even if he only told the OP that it was his case. He should have warned the OP that not all cases are that simple or quick. Still sounds fishy to me.

You shouldn't have filed for a K1 and instead filed the I-130 for a CR1, no?

Maybe this scammer saved you some time getting denied for the K1.

Good point. The I-129F would have been declined anyways, assuming they didn't submit the I-130 with it.

Some of you probably already know this but make sure you keep a copy of your NOA2. After K-1 you will have to file an I-485 after you marry and they will want that copy of NOA2 again. I made copies but can't find them. I thought, no big deal just get a copy from USCIS. Well, they want an arm and a leg for a copy of notification paperwork for over $400.00. That's just crazy!

I scan everything I send to and receive from USCIS. Then I email it to my hotmail account and put it in a special folder. I should really consider emailing it all to my wife, too, in case something happens to me or in case hotmail is hacked.

You can file the petition while she still in the U.S. rather than waiting until after she leaves. Since she'll need to provide you with a passport-sized photo, a signed letter of intent and G-325A, it would be easier to have her there with you. Better yet, she can get married while she is in the US as a visitor. I did. I didn't need a visa for it. If she's already in the US and would stay if she were married. Once married you can file the I-130 and apply for adjustment of status.

But if she's going back anyways, it won't make a difference.

Hi All - I want to say thank you to everyone who posts on this site. The information provided is priceless and has helped me work through this process over the last year.

I have my interview scheduled at the Montreal Consulate on December 3rd and am just trying to put the finishing touches on everything.

I have two questions:

When I sent in Packet 3 I included the signed and sealed copy of my Criminal Record Check. I kept a photocopy for myself but see it on the list of documents to bring to the interview as well. Do you think that I need to get another copy from the police that is also sealed? Will they have my packet 3 there with the original?

Second question - for the Packet 3 it indicated that I needed police certificate for any country that I lived for more then 1 year. On the interview appointment confirmation list it doesn't list the 1 year part, it just says for any country I have lived since age 16. In 2002, I lived in England for 9 months.....do you know how I would find out if I need this forsure. It takes a bit of time to get the police certificate from England and I worry that I can't have it in time for my interview.

Thoughts??


You can email the consulate to find out for sure. They take only a few days to respond. Not that long. though I thought it was supposed to be any country you've lived in for longer than 6 months.

Now that I've re-read it, yes it should only be for 12 months. I would double check with the consulate though.

So I sent in my papers around the 20th of December and still haven't received my I-797C receipt notice of action.. :( should I start worrying now?? Maybe give them a call? Any advice on what i should do?? Thanks alot for any responses

Call and see. It took my wife and I a couple of weeks to receive ours. But it shouldn't take a month. When you call, ask for your receipt number so you can keep track of your case online.

I will be upfront and honest with you as I believe that is what you are looking for on here. These are the not the possible red flags, but RED flags will be raised right away:

a) You have been married twice.

b) You have already filed for someone via a DCF, that is the # 1 red flag.

c) He is a citizen of Afghanistan, so I believe you will need to file through Afghanistan. I don't think he can file in Malaysia. I know he is living there legally, on a student visa, but unfortunately when it comes to countries like Afghanistan, Pakistan, they want people to file from their original place of residence. I hope someone else on here can confirm this.

These are just a few things! You probably need a good immigration attorney!

Technically You can. However the consulate won't issue you the U.S visa unless they receive the police check because when you mail that, it assumes that you have had all the document in hand (besides the medical check).

Make sure you have at least a month and a half for the HK police to process and mail the police check to the consulate.

It wasn't a pleasant experience for me when waiting for the HK police check as they mail it back to me to request for more things... A month was wasted because of that! :(

The RFE states how long you have to return it on the sheet you get. It is not the same for everyone, some RFE have a longer time then others to return it.

When you call USCIS the operator cant even see your case, they cannot see anything more than you can on the case status website. They don't have the ability to tell you anything other than what you yourself can see.

If you call and request an officer or a T2 operator you are more likely to get information on your case.

Iv never seen anyone tell people to use fasteners or anything, and I never tell people too either.

USCIS takes apart the whole thing and re-does it their own way with their own items. Regardless if you make it pretty with colours and tabs and dividers... all of that gets tossed in the trash.

A return ticket is essential on the VWP. I don't know if Canada is included in the VWP though as it's only recently that you guys even needed a passport to come in. You probably have a different arrangement and if you are driving in obviously you won't have any kind of ticket. Proof of a job and a permanent address back home should be enough. When I was visiting my wife before I got my visa I brought a stack of evidence of ties back home. I had details of my bank account, my job, my mortgage, letters from family, I also brought a copy of my vacation request form from my work stating which dates I would be off and when I was going back. I was grilled a few times but was never asked for any of the proof. I would think that they might be more suspicious of someone who is entering the country to marry a USC without a visa though so the more evidence you have the better. Possibly you being from Canada will make it easier than for someone from a "high risk" country.

Above all NEVER EVER lie. If they catch you in one lie (and they are very good at it) they won't believe anything you say.


Canada isn't VWP - it has its own deal with the USA. But the OP will be living in Korea at the time of his plans. Not Canada.

Bring the proof of your work in Korea the contract etc and the return ticket id bring a lease / rental paper too if you get one to show you are returning not only to a job but a home that you are keeping there.
