Me and my fiancee are thinking of having a wedding ceremony before we get our K-1 visa. We have already sent out the invitations and some of the guests have already bought tickets to come in and attend from out of the country. We miscalculated the waiting time. We would not sign any papers whatsoever at the time of the ceremony. It will be symbolic only. We will have another "real" wedding with papers signed and delivered to the powers that be once the K-1 visa is in hand. Would there be any legal repercussions for this or do you think it will be ok just as long as we dont file any paperwork for the symbolic wedding ceremony?

Any help or information will be greatly appreciated.

You would have to have a legal wedding in the US since your K1 visa permits you to enter the country as a fiancee/fiance. I am not sure if you can have a legal marriage in your country after you are issued the K1 and then use it to enter the US. Im sure others will correct me if I am wrong.


Im pretty sure he/she means having a legal marriage in the US after the K-1 visa is granted. Although the wording may suggest otherwise.

what was the deception that led to the breakup in the first place? If you gut led you to cancel the first time around, you need to trust your gut and not second guess it. Sometimes these things need time to unravel, and going back to your fiance right away may not be the best thing to do. Start your process over and see how your fiance reacts, or tell her you need to start over.

What you are suggesting is visa fraud. Your friends case is in no way similar to the OP. They have a visa petition already pending approval for a K1 visa so she has immigrant intent. To get married now would mean that she is using her status as a visitor to get married and bypass the K1 visa which could get her into a lot of trouble and even possibly a ban.



why not get married and get the vist visa adjusted my fiance has friend who was here on a tourist visa and meet a man and go married here and then just applied for a adjustment of her tourist visa

From what I have seen and read all K1/K3 visas are processed by Immigrant Visa units at US consulates abroad. Even though it is technically a non immigrant visa it is considered an immigrant visa because of immigrant intent.

Now that I have your attention... :yes: ... let's get back to reality. Spending more time in waiting is exactly what you are going to do, no matter what else you do. Right now, there is nothing at all you can do until they finish whatever additional review and processing they deem necessary based on the complaint they have. There is not a single thing you can do for at least three months that has a chance of speeding their decision. After that, the petitioner has an outside chance of accomplishing something through a Senator or Congressional Representative. The chances of a politician actually making a difference would depend on the circumstances. They are probably slim at best, but since you haven't disclosed the circumstances, it's anybody's guess.

If you have a child you are not supporting, then before you obtain a visa with immigrant intent to the US, you are going to have to satisfy the Consulate, you've made appropriate arrangements to meet your support obligation. The character of the mother is not going the change that. So, if you fathered the child, I advise you to make the arrangements needed for the child's support. You can do that now.

First clarification is that this woman that we are reffering practiced PAY PER USE system,she already has previous child from also unknown recipient and some other aborted case...I know I have a fault on using this kind of services .but what can I do ,,I met this woman prior to meeting my fiance...and we have already argued,explained in detail to her everything.including my no no knowledge of the child..I already learn on this when her family traced back my past .I know that this something personnal,but I together with her both totally lost,including our plan...I am not running away from any obligation ,especially fathering a child (why would I? at this age) but my only concern is ..am I the real father???? You could take a paternity test to verify if the child is yours. If the child is not yours you have documented proof for the consulate when they complete their review. If you are then you should arrange to show that you will provide support for the child until the child is an adult.

I'm the USC. I've been living and working abroad(file taxes as an expat) for many years. We're abroad now, but I'm currently not working(by choice, new well paying job in the US shouldnt be a problem). If I want to start a K-1 visa process at which points in the process do I have to physically be in the US? Ideally I would stay abroad with my fiancee in her country or better yet travelling around. Only head back to the US at the very end. Does anyone have experience with this? I see from one line on the 129f process that you can mail your forms from abroad, but no further detials on where we are allowed/should be in the meantime..


You do not have to be physically present in the US to file. However you would need a place where correspondence could be mailed to you in the US (family/friends home address) You will also need US income to show that you meet the poverty guidlines (Co-sponsor if you do not have US income)

He is in Jordan..agency working with us is in Jordan.. I'm in USA. This will take time (probably setting up appt with lawyer..husband missing work.. then sending it to me.. I was really really wanting to get this out..I've been waiting for almost 2 months now since I-130 was sent.. and with ongoing probs with USCIS/CSC sending out receipts (one reason for non-receipt of NOA1)... this making my brain cramp again :wacko:


I know this process is rough... keeps loved ones apart for great lengths of time. In the end its really up to you, you can go with the current forms you have and hope that it goes through fine or go through the hassle and get the latest version of the forms and send them in.

If it goes through... well and good
If not then there will be additional time in them notifying you, you and husband going through the hassle anyways of getting the latest version filled up and sending them back to USCIS.

You can always call USCIS and see if they will accept the older version of the forms.

OMG!!! I was just going to mail out my I-129F which was prepared while I was in Jordan(signed April 2007. We are working with an agency there. I just looked at it..Form reads: Top- OMB No. 1615-0001 Expires 12/31/06 Bottom- Form I-129F (Rev. 05/23/06) N


What am I going to do now? I've been waiting so long for NOA1 (I-130) and was going to submit it with other evidence of filing I-130.. Will they really kick this back to me and cause more delays.. Why did the lawyer give us (and other clients) this form?? She got it from online.


Why speculate and take a chance if it does get sent back? If you have not received the NOA1 for the I-130 and have yet to send in your I-129F petition, you can get the latest version of the I-129F completed and signed and get it signed by your spouse and have it ready.

Agreed, he must be a legal resident in NZ to be able to process his visa there.

My finance is Hungarian and he is living in New Zealand - currently with a visitor's visa but hopefully will soon have a work visa. We are in the researching stages of getting the K1. Does anyone know if he will be able to apply for his K1 and have his interview in New Zealand or will he have to return to his country of origin to apply?

I would appreciate any insight anyone has on this topic. Thank you.


Not if he's legal....if he has 'legal residency' status, then he can have his interview in New Zealand. For the most part, the US consulates allow those beneficiaries who have legal residency in the country in question, to interview there for the K1. I've got an attorney handling all my paperworkd. He did not send me a cover letter to include with my package to send to the service center.

Is the cover letter really necessary?

My lawyer did include a document signed by him that states "Copies are exact photocopies....I understand the Consular can ask for original copies at any time." (or something like that)

So, do I need to type up a separate cover letter to include?

Yes you can but it is up to the CBP officer to parole or deny you at the POE. Make sure that you carry as much proof of ties to Canada. like Lease agreements/Mortgage papers, Letter from employer, Pay stubs, K1/K3 papers (NOA1 NOA2 etc), Return ticket etc.

Hi Everyone

I'm just starting the K1 visa process and have a few questions that I'm hoping someone on this sit can help me with:

1) should i be getting an immigration lawyer?

2) after i am approved for the K1 visa can I still enter the USA to visit my fiancee (prior to our wedding) or will he have to come visit me always? we still have 9 months to our wedding!

3) i want to have the wedding ceremony in Canada - i was planning to have the ceremony in Canada and the legal marriage in the US. We are planning a spring wedding next year in Canada followed by a honeymoon somewhere outside of the USA and then we were going to enter the USA and have a legal marriage there. Is this risky? Has anyone faced the same issue?

#1 - read the guides on here - then decide if your case merits a lawyer or not.

#2 - once the K1 is issued, you have 6 months to use it and 90 days after entering the US to get married.

#3 - Look at the timelines for K1 & if you file thro Vermont or California. CSC is a longer waiting period. Look at timeline for Canada & if you are Vancouver or Montreal. Vancouver is a much longer wait. PLease don't make any firm wedding plans until your visa is in hand - timelines vary greatly.

Actually Montreal is the longer wait. Vancouver schedules interviews about a month from sending packet 3 checklist. Montreal about 5-7 months.

I was just wondering about those of you who chose to just get married at the courthouse - were you able to do anything more than signing papers in a boring room? We just realized that we don't know what exactly happens when people get married at a courthouse.

Also, how much do they typically cost, and how do you go about reserving them? (We're not necessarily planning on doing this, but we we were originally...)

Also, how do you manage to get someone to come if you want to have a wedding outside somewhere? I guess it's a different cost depending on who it is but how much would it cost for say a justice of the peace or county clerk?

And, how do you go about obtaining your marriage license? Do you do this in-between when the foreign fiancé enters the country with his/her visa and the wedding day, or is it possible for the USC to obtain it beforehand?

If your check was cashed then u can get the number from the back, this will be your new case number. Then go to USCIS and register that account to watch the process. I dont now if the 1 is a must to have but the 2 will be as you have to give a copy to the SO. So register your new address in all the appropriate places.

Regarding the police record, i am sure its different for each country, but my fiance's paperwork took about one month before it was granted by the authorities. The paperwork was good for like a year, i think... Anyways, we were a bit lucky we did it early or else we would have had problems. But check out the timelines for other folks that are in the same country as you are, you will get a pretty good idea of the timeline, hence, be better prepared.

That's something I was wondering about too - I want to get the police check but since I don't know when we'll get our NOA2 (obviously ;)) I was thinking maybe I should wait til then. Especially if they are done pretty quick.

Misunderstood if you were the USC or beneficiary - only the USC gets the NOA1&2 - once your file reaches the home country, the consulate will send the beneficiary mail to the address on the form. Make sense? lol

Look at the Step By Step for the K1 - you'll see information on the packets.

As far as the people receiving/forwarding your mail - sounds cool to me. As long as you get it.

The USPS will not forward your mail, so it is best you list an address you can receive mail at.


Thanks! I understood your comments except for this one. When and where do you mean I should list an address I can receive mail at? And if the USC (petitioner) gets everything, what do I receive in the mail anyway?

Plus I can't list anything new in the I-129F package as it's already been sent. If they do happen to send anything to this address the people I'm living with would be glad to forward it to me though, so maybe it's not a big deal.

I have some more questions now that we sent our petition...

How are the NOA1 and NOA2 received? Do they send everything to the USC or do they send something to the non-USC too? Main reason I'm wondering is because the latest address on my G-325A form I won't be living at in a week and a half.

It seems like they email the USC (since the USC is able to put an email address on their I-129F petition) and then send the real thing in the mail. What exactly will be contained in this thing? (And what about the NOA2 also?)

Also, what's all this talk about "Packet 3" and "Packet 4" ??? How many packets are there and how do they know where to send them? What are the packets anyway??

No one knows the true motives of the poster here, but I don't see at all from her post that she is "clearly trying to commit fraud," although I can understand why it might look suspicious to some. She did not write that she 'JUST wants to get into the U.S.' although she did say she does WANT to come to the U.S. (implied from her statement, 'as much as I want to come to the U.S.' - the two statements don't mean the same thing at all!) My impression was that she does not any longer care for her original fiancé which is the reason she doesn't want to do all the visa stuff with him - it is HIM she was referring to when she said she doesn't want to be with him and doesn't love him. Yes she has another fiancé in the U.S. and I can totally see this looking suspicious but I don't think it's fair to automatically assume she is committing fraud. I think some of her statements are being mixed up here!

I would like to suggest that you add the beneficiary's birth certificate since in some cases they received RFE for it but if you don't have it and you're so ready to mail the package, maybe it's ok without it. I'm not sure about the money order though since we used personal check but maybe you can write NSC's address in that missing field? I'm sure others can give you more details about this one...

So now that we have received our NOA2 and I have graduated from obsessive compulsive checking the USCIS online case status numerous times a day (and am now checking DHL courier site in the same way), should I just delete the petition on the USCIS site? Is there any reason to keep it up there?

I thought they automatically put the case status online, but if you can delete it, then do you have to add it? Maybe a silly question! I'll probably end up doing the same (checking the status multiple times a day, once our NOA1 comes or whenever I find out our case number, lol)

Yes - she also stated clearly at one point that she ended up thinking another type of visa was the best option (besides the K1) - she didn't say that she was planning to get married when she was 16, she just suggested it as a possible option.

Please do not come to the US without at least a high school education. We don't need any more uneducated citizens. Unless you want to break your back working under the hot sun in a field picking produce and live a very honorable but otherwise miserable life you would only become another leech on the system and an uninformed voter. Why do you think we are currently in the mess we are in over here?

And as for getting married at the age of 16, I would guess you are doing this to run away from family or other problems. You will find that those problems will follow you to the US. We don't need those problems here either. Get your education, make good with your family or cut ties with them if the relationship is permanently unhealthy (still far too soon to know yet, all 16 year olds hate their parents), figure out who you really are (at 16 I guarantee you don't know yet), then consider marriage and a new life in the US.


Now I don't know if that's quite true! And sometimes, people who don't have a high school education have attitudes that are a lot better than people who have university degrees...

I think these statements are too general! She didn't say she was planning on getting married at the age of 16; she was just asking about her options.

Some people might have thought you wanted a "go get K1" response, since you posted in a K1 forum AND to most people who replied, it probably sounded like you wanted to get the K1 as soon as you turned 16 - sometimes the Internet isn't the best form of communication - that's nobody's fault.

Personally, I didn't think that you were asking for a ''just go get a K-1" as some suggested, but given that it was posted in the K1 forum, I can sort of understand why others might have. I do remember you posted that CR1 seemed like the best option but I have no clue what it is.

I don't think people who suggested that you were maybe trying to escape something (and you admitted yourself that you want out of there and hinted that things were bad for you, so it was not an unfair assessment) were necessarily judging you. You can't really blame people for analyzing your motives, or your boyfriend's motives.

I don't think people who are analyzing your motives are judging you; there's a difference between warning against something for your own good based on what you've shared, and judging you. Like I said before, NO ONE knows your situation, you might have good reasons, you might not.

I think the main message people were trying to give you is simply that it probably isn't a good idea to get married so young (since you asked about getting a K1 and what it would take - it sounded like it's what you wanted) and move all the way across the world, and no one really know how to say it properly.

I think for this thread, there just have been misunderstandings that often occur due to the lack of tone on Internet. I have sympathy for you and the others who posted on this thread - I used to run into this problem with people online misunderstanding me a lot!

at what point did i openly say that i wanted anyone to give me a "go get a K1!" response?
as far as i knew, at the point i posted the topic, this was the place that had the best chance of giving me some idea of which road i should head down, be it K1 or a different type of visa. i never said i was only open to one, and if you read the entire topic, you would have noticed that i posted a short while back saying that the CR1 option looked like the best idea, but i still wasn't sure how to go about it.
i'm not using my boyfriend as an escape, i love him and his family, and have done for almost a year and a half. i admit freely i want out of here, but who exactly are you to judge me when you don't know my exact circumstances at home?
in a couple of weeks he'll be here for two weeks, and then when my passport is renewed, i'll be visiting him for as long as i can stay on a tourist visa.
so right now, this isn't immediate.

thank you to everyone who has provided me with information i can use, as opposed to namecallers and people intent on analyzing my motives.

Personally, if I were you, I don't think I'd go the K1 route.

As for me, I will not advise a young person of 15, almost 16 to go out and just get a K1. Too many factors are involved with that journey to give out a flippant response such as that. If that's the response she wanted, she came to the wrong message board for that.


I agree; I wouldn't either. My fiancé and I don't even live as far apart as most people in a long distance relationship (flying is only one to two hours, driving might be about 7 or 8!) but going the K1 route was a very big decision even for us. I can't even imagine what it is like for people who are on opposite sides of the world, let alone very young.
