Normally...they suppose to transfer your file (including everything) to NSC and then to the embassy of your country...So technically they should still have everything in it ( as the packet 3 is to informe you of what missing in your file ).

well I hope so loll blink.gif

K-1 Fiance(e) Visa Process & ProceduresInterview with fiance/e or without??
Well I've been looking all around the forum and didnt find any thread regarding my question so here it is:

Of what I read, most couples go together for the interview....But me and my fiance arent sure yet if he would be able to make it as he is the owner of a company and he got severals obligations so

Is it really a big of a deal to go alone at the interview??

Is there anyone who went alone and it went well?? is it better to go with your partner?

thanks anyway for your answers, comments, or suggestions

K-1 Fiance(e) Visa Process & ProceduresPapers for the interview
OK heres my situation...when we filed last september I didnt know about VJ blink.gif which would have helped but anyway, I included everything in my petition file.

By everything I mean everything :

- police check and translate ( I"m a french canadian cool.gif )

- I-134 "affidavit of support" notarized

- birth certifificate original and translate

- letters to intent from both of us

- bank statements ( which arent necessary as my man's incme is way above the poverty guideline )

- taxes transcripts

well everything.....

Now that file is going to be soon on its way to Montreal embassy and I know that 'technically dry.gif they suppose to check it and tell you what yo need to bring.

My fiance said "well if they smart they wont ask again for those documents as they got them already " to which I replied " dont forget honey..they are americans laughing.gif (we like to tease each other )

Besides the I-134 that my fiance gonna get a more recent one due to the fact that a date is include in it but I wont be his wife yet. ( USCIS all timeline loll )

All other documents are from last september so DO I NEED TO GET ALL OF THEM AGAIN ??? huh.gif huh.gif

and my fiance is the owner of a company so he has the right to file for an extention to file his tax return as it is quite complicated so I wont have the 2007 with me for the interview.

Is it a problem ??? or is 2004-2005-2006 is sufficient ???

well thank for all your answers and comments or suggestion I really appreciate it smile.gif rose.gif

Anybody who can reply...your answers are more than welcome. However the matter of my question regards specialy canadians.

- 1- can we get the shots at same time of medical exam and is it included in the 220$ cost?

- 2- can we chose the doctor we wanna consult from those who are approved by US government ?

- 3- is it better to wait on packet 3 to take medical appointment or is it ok to do it before?

- 4- Does my vaccination booklet must be translate and notorized ( as I'm french canadian. I'll try to get a copy in both language but not sure if they will do one in english )

Is it worth noting here that the NOA2 has a four month time limit?

Yes..it sure does...but the point is that she doesnt know when they will be approved (NOA2) yet and she till want to go visit him as they planned

Of course if they get the notice of approval soon...if I'd be her I wouldnt visit for 6 months but for a shorter period of time.

However...they can get it in only a month or so...and I wouldnt want to be stuck in my country either loll

On other notes...theres couples who got their interview after the 4 months limit of NOA2 in Canada and they didnt have any problems...on what they say loll laughing.gif whistling.gif

Nope, she's the one who needs to fill in the papers from the embassy. He will need to give her the financial paperwork proving he can support her, but she is the one who is applying for the visa, so she is the one responsible for the paperwork.

Bonjour Faustine !!

Translation for other VJ members lol

Yes she needs only the nation police certificate for every country she lived in since age 16. She can order it now so she would have it once shes back in France from her trip in US. The rest of papers its gonna be her fiance whos gonna fill tem and he can do it while shes visiting him and give them to her for her return in France.

Good luck and do not hesitate if you have any questions

QUOTE (FaustineJason @ Feb 25 2008, 08:11 AM) <{POST_SNAPBACK}>
Hi everyone,
I am an October filer and I have seen that the first October filer had been approved by CSV. Pretty good news!!!
However, I have a question about that:
I am going to visit my boyfriend in Alaska, from March 12th to beginning of May. I am very very excited about that, but I realize now that (hopefully) our case should be approved by the time I come back to France and I wonder if it could be an issue or not. I mean, once the case has been approved, will I have to come back to my country right after?? Am I allowed to be in the US once the case is approved?
You see, the timeline says that it should get approved arounf mid-April... And I will still be in the US at this time.
Do you think it could be a problem??

A couple more questions...
I don't really know what will happen once we are approved. I understand that the USICS will send our case to NVC and then to the Embassy in France. Am I right? How long does it usually take? A coulpe weeks or months???
I will then receive papers from the US Embassy in Paris, explaining all what I need to provide the day of the interview. Still right? Is it I who will have to call the Embassy to get a interview or are they going to call me to tell me when to come?
Last question: Once they grant me the visa, does the 3 month validity start the day of the approval or the day I come in the US under the K1 visa??

Thanks for your help!!!
Have a very good day.

Faustine

Ok....Theres is NO problem at all if you are in US while you receive your NOA2 (notice of approval )...I was in US visiting my fiance when we did receive ours last feb 7th. and NO you dont have to go back right away after its been approved.

From the time you recieve your NOA2 ...it can takes severals weeks before they transfert it to NVC or few days it really depends on how fast they are.

Personnaly ours havent been recieved by NVC yet and its 2 weeks now. Either you or your fiance can call the NVC center a week after you get the NOA2 to check if they recieved your case or not and base check with them ( that will give you then an idea of when youll have to go back in France )

Once the embassy get your case...youll get the packet 3(couple days or weeks later) which you gonna have to resend back to them (papers they ask you like police certificate, birth certificate, 134 "affivadit of support"....)

If i may suggest..I'd get everything ready for packet 3 before your departure ( that will give you some peace of mind during your trip )

Once your gonna send the packet 3 back...few days later or weeks depends on the embassy youll get the packet 4 to schedule your interview and medical.

The NOA2 isnt your visa so theres no limit time to be in US at that time...Its only once you get your visa k-1 in hands which gonna be issue by your embassy and not USCIS then you got 6 months to go back in US and once you are in US you got 3months ( 90 days) to get marry.

So I wish you an approval soon and a very nice trip. rose.gif

you CANT have your interview in Canada as your work permit doesnt mean you become a citizen or a legal immigrant of Canada.

I just looked at the MTL embassy check list for packet 3 and I was wondering if we can file all forms online and print them out? Is so...where can we find the DS-230 good for 2008 (the one i found expired in 2007 )?

Regarding the I-134.....we included it in our case already back in september.....do we need to send them a new one?

They also have a intend letter from both (me and my fiance) so are we gonna need to bring them a new one for the interview ?

Welcome to VJ Huskerkiev, and thank you for sharing all this info with us. You may or may not have the answer for my question but please tell me what you think is happening here. I had an IR-1 interview at the Montreal Consulate and the interview went well and I was told I would get the visa the following week. This did not happen and when we contacted the consulate we were told to wait 2 weeks. Now what I think is that I am stuck in Security Clearances but isnt it strange that I was not given any information after the interview that it would take longer then a week. What do you think is happening here? Thanks again for all your feedback.

HuskerKiev may have thoughts on this but remember he was a USCIS adjudicator (which is a part of the Department of Homeland Security) for a while and your question is regarding what happened at the Consulate which is controlled by the Department of State.

Hi,

My fiancee and I are going to be submitting our application in the first week of Feb for K1 Visa, Im in Canada and hes in Indiana. I have two children and all the paperwork needed, My Question is, We are looking for him to book time off from work as a firefighter the last week of July first week of August as to help me move down to him, If we apply the first week in Feb is that about a good time to think about the move, or will it most likely take longer then that to be approved?

If any other Canadians have been through this process can you give me an idea on how long it took for the process to be able to move into the US please. I understand all cases are different just need on idea on if this is a possible time period or we need to reschedule that time off .

Ok im getting worried I just got back from visiting my new fiancee( proposed March 25 =) ) and we filed our I-129f well I was there, we sent it to California and now im reading more and more and thinking we sent to the wrong place.. Does anyone know where it was suppose to go as he is in Indiana?

My other question is I have two children, One I have full custody of and on my final order of divorce its said in the papers that I have permission to move to Indiana with my son, My daughters father is unknown but I have her full birth showing no father and a letter from my lawyer saying the same, Is there anything else I would need for them in regards to the visa or entry to the states when I get approved ?

Any help is great Im getting very nervous at this point now.

does the customs officer need to know that you are visiting your fiance?

The customs officer does not care. Everyone is subject to refusal. The more information that causes the immigration or border post officer to believe you are at risk of not returning to Canada, increases your chance of denial.

So can I just tell him I am going for a short vacation to visit friends? I am coming back. I have a return ticket, employment letter, etc. etc.

If you're worried about getting stopped at the border/by customs, you can always bring proof/evidence of your ties to Canada that will show that you will be comming back to Canada blush.gif But, I see that you have mentioned these things. Good Luck!

ok, so my question is....do i tell them i am visiting my fiance when they ask the purpose of my trip? or does it really matter what i tell them? should i be honest?
