if you want to send copies of pages from your passport, do you need to include the detailed page as well? (ie. the page with the passport holder's photo and info?) .

Hey there! You sound like me 6 months ago when I first started researching this long process! Just read the guides and come over the Canada forum for some more regional advice if you would like! In one of your posts it says that you are employed, this doesn't matter as they look at the USC income for sponsoring purposes. What I will advise you on though is that there is associated costs that will have to be paid in Canada when it comes time to have your interview. Paying for the immigration medical (200-300), paying the visa fee (131) and travel and lodging expenses if you have to travel far to the consulate (either Vancouver or Montreal). Then of course wedding costs and all that jazz depending on if you have a civil ceremony. Once you are married you apply for AOS (greencard) and that will cost you $1010.

You may have to stay in Canada until the form is approved...you CAN VISIT.... but it gets tricker at the POE as you have to have enough proof of ties to Canada to prove somehow that you plan on coming back to Canada to await the processing of the visa. There have been some people denied, but I would say just because we are from Canada and do not need a tourist visa, (nor do we get our passport stamped most of the time) to visit it makes things a little bit easier. Its all about Proof of ties and the immigration offical.

The prospect of being able to visit my SO in the States while waiting for things to be approved definitely makes me feel better! I currently have a NEXUS card which makes border crossing a bit less stressful... I wonder if I would still be able to use it while we await for approval, or if I would have to surrender the card...

The don't look at the intending immigrants income at all. They look at the US citizen's income. If you go the K visa route, look at the requirements on form I-134. If you go the CR-1 route, look at form I-864.

As far as differing courses, it's your call. You will be with your SO quicker with K-1, but be prepared to not be able to work or leave the country for awhile. I think it also might bring up some driver's license issues. Also, you will have to spend $1010 to adjust status. The CR-1 is about $500 cheaper overall.

You should also not trust the lawyer who gave you the advice to do this.

I'm so glad for this forum... I have been really unclear about the information this immigration lawyer has given us. The last thing I want to do is muck things up. I've been given bad advice by a lawyer in past that cost me thousands of dollars and loads of grief.

Ok, so seems the way to do it is have my fiance file for the K-1. Then once approved I can enter the US and we can get married within 90 days.
Next step after that???

The I-129F is a form you fill out. Once it is approved, you can apply for the K-1 visa at the foreign consulate. Check out the guides at the top of this page.

Thanks for the response! I did read some of the guides at the top of the page. My understanding is that my fiance (American) would file the K-1 (fiance/e) visa that would allow me into the USA. Within 3 months we would have to marry. Then we file the I-129F. Is this correct?

Hi ya'll! Ok, I'm sure this has been discussed more than once.. but can some of you out there please help to clarify for me, the difference between K-1 and I-129F???

I am a Canadian citizen, born and raised. I have been dating an American citizen, born and raised for the past 2 years now. We are keen to get married and have consulted with an immigration lawyer in his state. I would be relocating to the US.
I'm not sure if we are better off going with the immigration lawyer and paying thousands of $$$, or doing it on our own...

He had explained to us that if we get married in the States, and file all the forms at the time we get married, I could have status within 4 months.

If we do it on our own, do we file the K-1 first? or the I-129F? Is it necessary to file both?
If I am able to obtain a fiancee visa and be in the States for extended time, that would be so helpful! What's the best step here? I'm so tired of traveling back and forth between Canada and the States.. not to mention I'm always scared that I will be denied entry one day at the border. I know that I'm "allowed" to be in the States for 6 months per year, but that doesn't mean that immigration can't deny you if they feel like it.

depends on what the health "concerns" are.... if it something like HIV/AIDS then yes it will....

I'm not an expert but it is definitely easier going to the UK and marrying and living in the UK for awhile...
I was married to a Brit and found out the hard way, what the immigration rules were. If you can get a visa of some sort and go over there and live with your fiance for 2 years, you are automatically eligible to apply for citizenship as a common-law spouse. Of course, you would need to find some legal way to enter the country first. I had entered on a working holiday maker visa..

yes. Also bring supporting evidence, I just had the form i 134 and they asked for income tax, letter from employer and paystubs. Have it all there the first time and you won't have a stressful experience.

after staying in Vancouver for about a month, she has recently tried to come back to United States for Christmas and new year. and once again she was pulled to custom and was held of over 5 hours this time. And they would not let her go. They accused her saying " you will not come back. you don't own a house, or you don't work" so you are not going to come back to Canada. They told her that only way for her to visit United States is that she will need to either have to own a house in Vacouver, have a job, or get a Visa. but she is not banned since she did not violate any law.

is this possible for US custom to do that to her??

is there anyway for her to come visit me in the US??


and second question that I have is this...

1. is it faster to get married in Canada and file for permanent resident? attorney told me that process doesnt take that long if we file for permanent resident outside of US. he said it is cheaper and faster. is this true?

2. or is it faster to file for K-1 visa?


Our goal is to reside in US.

The same thing happened to me visiting my Fiance in the USA with Vancouver's customs.. they held me until I'd miss my flight then told me to come back with evidence of my job. Then they'd let me through, which they did.

The only way she'd be able to come visit you like I mentioned with my story Evidence of a job etc.

I did the K1 processes. Handed in 129F in march and visa in hand in December, And had gone through Vancouver's Consulate.

I have been to see my SO 3 times sice we filled for the K1. Each time I went thru the Buffalo NY POE it has gone something like this
Where are You From?
Where are You going?
How long will you be there?
Where did you meet?
What do you do?
When do you expect to return?
What are you bringing in the country?
When was the last time you were here?

Because I am from Canada I dont need a vistor visa to enter the USA but I am sure if you can provide sufficient evidence that you are planning to return to your home country there is nothing to worry about. I usually bring a copy of my flight itinerary and a copy of my school schedule and they have only ever asked to see my itinerary, nothing else, Well the last time the boarder guard guy did make fun of me when I said I met my SO in World of warcraft, I loled at him because he didnt know what WoW was and said " girls play video games too" .


So currently you are in the K-1 process and when you are at the border/immigration, do you tell the cbp officers that you are going to visit your fiance? Do you have to provide some sort of document or is it associated with your passport? I am currently considering applying for K-1 and the only thing that is upsetting me is that I won't be able to visit my fiance during the process. Do you know if they will let us visit until the process is complete?

What part of Canada are you from? I'm from Ontario and I was able to call the public health office who keeps your records for all your vacinations done in school and they faxed me their copy for free. You can also have a blood test done to see which ones you are vaccinated against.

Bankruptcy is not an issue as long as US citizen's income exceeds 125% poverty line at time of visa interview for the affidavit of support.

Me. The foreign resident. Im hoping this doesnt affect my USA fiance applying for the K1..Im not even sure how my credit will be affected in America.



IF you the foreign resident applies for Bankruptcy then no, in no way will it affect your case.

Every Case is different. The US consulate in Canada put my A# on my visa that was stamped in my passport. Most however receive it on their NOA or ASC appointment notice.

It's not a big deal at all... You can file AOS with your married name as others have already mentioned.

My I129F expired in March and I had my interview at the U.S. Consulate Montreal in August. The consulate told me that the I-129F would automatically be extended when I inquired back in Feb of last year.
