Hello all,
I've read through a bunch of threads and still don't know what I should do. There are several similar situations on the forum but I'd still like to explain my specific situation:

I'm a US citizen and have a Brazilian girlfriend I've been in love with for two years. I'm currently working on a project in Brazil for four months and plan to pop the question sometime soon. After learning how long K1/K3 visa processing times are I realized the sooner the better and I know it's time... I didn't realize the whole visa thing would be such a big hassle but I'm quickly learning otherwise. I'll be coming back to the US after the four months and would like for her to come with me too.

She got her B2 tourist visa in October 2008 and visited my family in December 2008 for the holidays.

The sense I get from the forum is that I should apply for a K1 because it's generally faster these days. She could also visit on her tourist visa during processing time and then return to Brazil for the interview, right? Is it the best option?

I understand the K3 takes even longer and most people recommend going the K1 route. Personally, I would rather get married in Brazil and come back to the States as a couple. If we did marry in Brazil, could she enter on her B2 and then adjust her status later? Please tell me yes... Filing the petition directly with the consulate in Brazil would not be an option for our circumstances. I'm not real sure why the forum doesn't show as much love for the K3.

Either option will no doubt present some logistical problems seeing as I'm currently out of the country. I'll have to rely on the Brazilian post to mail everything back and forth. Not exactly the most speedy or reliable. Any other issues I'll have to worry about being out of the country?

Are there any other options out there?

What advice can you offer me?

no, you cannot marry her, have her enter on her tourist visa with immigrant intent. She was given her tourist visa to be...a tourist, not to circumvent the immigration laws. She can enter with you and interview at home, as long as she does not overstay.

I agree, quickest way seems to be Direct Consular FIling (DCF) but I am not sure what the requirements are for Brazil. Good luck and welcome to the journey

Through birth abroad to one United States citizen
For persons born on or after November 14, 1986, a person is a U.S. citizen if all of the following are true:[4]

Was your fiancee born after 1986? Do the 3 items apply to her parents? Does she have the documentation that her birth was 'registered' with the U.S. embassy?

Your finance's mother needs to have met the residency requirements in order for your fiance to recieve U.S citizenship. Call the embassy to see if the birth was 'registered' to be sure.

This is not a correct statement for K-1 filers.

He should use the address he knows that he will receive mail at for the duration of the process. He'll get NOA1 (I-797) and NOA2 (I-797) and perhaps letters from NVC once they send the petition off. If he plans on being in Virginia the entire time and is assured he will receive mail there then he can use that address and file with VSC. If there is someone in CA (a parent perhaps?) whose address is more consistant then he should file with CSC.

Yes it does make a difference. You no longer qualify for the K-1 as you are now married. DO NOT attempt to lie during this process and give him a "oh it was just a 'blessing'" #######. If you are legally married, then you are legally married.

I am not sure what you need to do next, someone will let you know (but I think it involves cancelling your K-1 and refiling an I-130)

Yes, technically your wife can travel to the U.S. but since she will be married to a U.S. citizen and with an immigrant visa pending, there is no guarentee that she'll be admitted into the U.S. since it is clear that she has immigrant intent.

1. Yes, I would put student, or volunteer so there are no gaps in the employment section

2. Use the first name that is on her passport/other documentation. If Katherine is used, put that. Yes, you can put "Kate" if you like under 'other names used'

3. Yes you can file while you are in the U.S. No it should not cause problems as long as you do not overstay.

4. You can put the parent's house, but you may also want to put the current address (it's ok if you move after you arrive) just to save time when mail arrives.

5. I wouldn't write a novel, but be detailed yet concise

6. We also met online, we put the name of the site. No worries.

7. Yes, if she was 'employed' she should put it on the employment section.

Once married, your wife will need to follow the steps for YOUR country (I assume Saudi Arabia) to become a legal resident. After 6 months of her being a resident, she can petition for you at the US embassy in Saudi Arabia.

I am in the same boat as you are. I just found out that it takes 8 weeks to get the marriage certificate in Toronto but only 2 weeks in NY where my fiance lives. I also have a visitor visa to US and thought it will be a better option to get married in US. But I am worried about the interview. What if the interviewer asks me if I disclosed my real intention for entering US and was it planned that I will enter on Tourist visa, get married and then come back to Canada. Will it cause any issues?

Hi Guys,

I'm down here in the USA spending the holidays with my fiancee, and I'm hving a great time! I was a little worried (very worried, actually) about whether or not I could visit the US with a big fat K-1 visa on my passport (without activating the visa). So here is my experience. I hope it eases your mind.

I am self-employed, have no debt, and there is nothing much really holding me to stay in Canada (except for deciding who I will sell my business to). So when I searched this forum (as I have done throughout my whole K-1 process) I didn't really find any postings with anyone's experience in this particular scenario. All I gathered was that I was going to have to show proof of ties to Canada. So I spent some time putting whatever proof I could muster (all I ended up with was a list of client meetings for the month of Jan...) and lost sleep the night before my flight.

I arrived at the airport 4 hours early with an anxious stomach. As I lined up for US customs my palms began to sweat, and I raced through multiple scenarios in my head. I was pretty sure that I would be sent to secondary for interrogation and would certainly come close to missing my flight. I looked up suddenly and came back to reality, I was waved in by a Customs officer. "Ok it's show time!" I thought.

Here is a transcript of how it went (I will do my best to provide it as exact as possible without boring you to tears):

Officer: [in an inaudible voice]
Me: "Pardon me? I can't hear you."
Officer: "Where are you going?
Me: (handed him my passport) "I'm going to Florida."
Officer: (leafing through my passport and stopping at the K-1 visa looks at me)
Me: (trying to beat him to it and blurt out as much info in as little time as I could) "That's a K-1 visa. But I am not activating that today. I will be activating it in March. On this trip I will just be going to visit for 2 weeks."
Officer: "Well.. I don't know."
Me: I'm thinking 'what does he mean - I don't know?'
Officer: "I'm not sure if this is allowed." (and he started leafing through booklets that he pulled out of a briefcase) This indicated to me that he has no prior experience with the K-1 visa. So I thought I had better inform the guy and try to sound like I know what I'm talking about (which I actually do, thanks to VisaJourney and having gone through the process this far).
Me: (Very confidently speaking) "The gentleman at the embassy told me to tell you that I would not be activating the K-1 visa and that I will only be visiting. I didn't even bring the envelope so I would have no way of even activating this today if we tried. You should be letting me in as a B2 Visitor." He did not like this!
Officer: (in a very antagonistic tone) "How do you know what I should be doing? Why are you telling me how to do this?"
Me: "Well I travel back and forth every month. You can see that on your screen."
Then paused and looked at me with annoyance, and then began to shoot quick, angry questions at me without letting me finish the previous answer before starting on the next question (I notice that they are trained to do this - not sure why though, it's only effective in making the traveler feel upset) So I thought I was pretty much screwed at this time, so I would just return very quick antagonistic answers back. In Science class I learned that a wave of equal vibration will cancel out another wave traveling in the opposite direction. So I thought I would match his antagonism with my own! lol
Officer: "What do you do for a living? Who are your customers? What kind of people are they?"
Me: "What kind of people are they?"
Officer: "Yes. What kind of people are they?"
Me: "Officer, I'm not sure how to answer that - they're people.."
Then he asked me about my education and tried to convince me that my school program was called something else.. and then he handed back my passport and papers and let me through.. This was certainly the weirdest experience at customs yet! But I was really happy because this took all of 5 minutes and they let me through! And then I had to kill 3.5 hours at the airport, but It was worth it.

I am now here enjoying some quality time with my fiancee. The funny thing is, on this visit I'm getting really jittery and anxious because I know in 12 weeks I will be living here.... A whole new life in a whole new country.

Anyways, I hope someone out there finds this helpfull, or atleast amusing.

They would send you another RFE for further information, if it is required. Dont worry you aren't over reacting, this process is stressful.

Comply with the RFE sent to you and submit the information that they have requested immediately. Do read the guides, they are helpful and will help with the next part of the process. But more importantly read ANY guidance given to you on the forms. And as puskbrk would say "interpret literally" blink.gif

They wont outright deny you for not sending in information, but if you dot submit the information required you will continue to get RFE's and this will slow up the process.

I do like this site and it provides SO MUCH information, but I found this site well after the fact and now I find there are so many things we missed!.

- We have already had one RFE, and I didnt include the letter stating we were engaged and plan to marry, and I'm pretty sure my fiance didnt either. Have they ever sent TWO RFE's? or will they just deny it outright ?

I cant believe this whole process is so stressful and the fact that the government sites say include form A. thats it. when in actuallity what they want is form A-Z PLUS forms 1-5. Then they hold it against you for not supplying them the information they want.

- Ok, now that I have ranted on, back to the topic at hand. If we dont get denied right away, it will be ok to bring the letters of intent to marry to the interview right?

Yeah its definitely not reliable, but I did receive a couple of emails from them for various status, such as Received and pending, sent out RFE, received RFE, but thats pretty much where is stops. theoretically, however the online system is not without its flaws.... I received hardcopy NOA2 about two weeks before the e-mail. No chance of an e-mail for NOA1 either....

Well in the end its up to you on what you choose and what is best for you, but the reasons we choose the K1 over other visas, are its supposed to be a bit faster, plus with the fiance visa, the first year of our marriage will not be spent apart.

It took us 5 mnths and a few days to get our NOA2 since the NOA1. Before that we got hit with an RFE, so the fact that you havent heard anything yet, could be good news or just normal.

Well anyway the amusing thing about this situation( as if there was one...NOT) is that these two geniuses ( my SO and his attacker) were across the street from the police station, so suffice to say police came out arrested both of them, saw only one was bleeding, got the story from the drunk that my SO stabbed him, they sent him( drunk guy) to the hospital and my SO to a warm and cozy jail cell for the night, fortunately said SO's brothers were able to bail him out. He now has a court date on March 5 to deal with the case. My question is, if he is charged he was told he could face 3months in jail, how would this affect us getting approved for a visa, if it shows up on his police certificate????? Just another set back in the journey of visa, which has become my life. All input is appreciated!!!



Well, Honestly I have no idea , but if your SO is the petitioner, then I dont think it will matter at all. If he is the benificiary, then I think there could be a problem.. but dont take my word on it.. lol wait for someone who knows what they are talking about to reply to your post blush.gif

I was confused to, but I got my packet 3 today, so I can kinda answer your question.

First off if you have already been approved, just wait for the packet 3 to come to you, but you can still be gathering all the required information so that you are ready when you get the packet (see the guides for what you should be gathering) You can not call and schedule and interview at this point or a medical, you will need to wait for the packet 3, then they will give you a list of approved doctors and what to bring, then when you have your completed packet 3 you can mail it back to the consolate, Then and only then will they schedule a meeting for you.

Ok I just got my packet 3 today , and I am confused... It says I need to fill out the online form DS-160 - which is fine, but the online form also asks me to submit a passport photo. I got four passport photos, so far, two I sent to my fiance to include in the K1 application, and I have two, NOT digital. Plus the form says I need FIVE passport photos blink.gif
So.. does that mean, I need one electronic AND five "Identical photographs" ? which means, the other two I have, I cant do anything with ?

- should I scan one of the two I have and use them for the online application ? or wait till I get the other FIVE and scan one of those ?

You don't need to send passport photos per say, just passport-STYLE. Uscis doesn't care if your born in South Africa and now live in the South Pole. However, NVC will care about all this which is what I am trying to get sorted now. I will explain my situation first, in october my fiance filled the I-129, after a long wait we got RFE, appears we forgot to include passport pictures blush.gif and the G 325, that I filled today the problem is I live in canada as a foreign student (not permanent resident) my question is do I have to submit a copy of my canadian visa and study permit with it ? What if they get the wrong idea that Im illegale in canada or send another RFE?

Just one more thing about the G-325a, make sure you get the 4 different copies signed as each one has a different code on the bottom left. If you fill it out using Adobe Acrobat it should make identical copies of the information you enter on page 1.

can i get my US fiance to gather these documents now? i just want to get everything together. we probably wont get a NOA2 until early jan. does the I-134 need to be notarized?

Phew. ok. I thought the US fiance had to show all assets (including bank accts, etc. etc). His income exceeds the poverty line so I guess he doesnt have to show his property as evidence! thanks for the clarification.... smile.gif

My US fiance owns property in the US and I wanted to use the copy of the property deed as evidence for the affidavit of support. However, he owns the property with his ex-gf from a long time ago. Both names are on the deed. Good idea to attach to affidavit or will immigration question that?

they will undoubtedly never be able to put the two together in order to swap it out with the one currently included with your petition....
