hello Im feeling awful writting this message, well heres the thing we got RFE 2weeks ago cause we forgot(our lowyer forgot) to include G325a I just sent today and I think its really awful ,
when I printed the dates were not clear at all so I did them handwritten , do you thing its a problem if dates are handwritten and the rest typed ???

I made a mistake on the address that I didn't see until now when I was typing 3 pages I wrote on them ''Rosemont'' and the other one I don't know how it was ''rose mont'' with space its now that I noticed on my computer :s do you think its a problem too
and finally our RFE expiration day is 7th april what if I do another G325a and we send it Monday is it too late ???

It has been about 2 months since I returned to Canada. He lives in Washington state and I am in BC so it actually took me further away from him. My boyfriend (US) and I (Canada) spoke with an immigration lawyer in the States about this. We wanted to get married and find out the best route for visa's, etc..

The lawyer suggested I enter into the States, we get married, and therefore skip the K-1 fiancee visa. I asked about this in the forum back in January and was told this is considered fraud. The lawyer seemed quite confident about her advice, and her fee was $2500. She said she would take care of everything from beginning to end and would train us on the entire interview process. I'm not sure if having a lawyer in these cases will sway the decisions of USCIS or whoever it is/whatever department that decides...

See, that would be considered an adverse factor, which could be used against your AOS case if the USCIS disovered that fact.

I can't believe a lawyer would basically tell you how to circumvent immigration law like that.

"Train us on the interview process" probably means "lie" - not good to do that.

Wait - I can see how, she will still get her money regardless if you get through or not, also will make more trying to defend your case.

I wouldn't recommend anyone to attempt anything like this.

It's one thing to come here as a visitor then decide to get married, then to plan with a laywer prior to coming, be trained for the interview, and get married after arrival. blink.gif


I've had such poor experiences with lawyers... no offense to any lawyers out there.. but there is a reason ya'll have a bad reputation!

Years ago, I had moved to the UK on a working holiday maker visa (2 year visa) and it allowed me to live/work while there. I applied for this visa to spend time with my then boyfriend. Things were great! 2 years whizzed by so quickly and a few months before the visa was set to expire, we set out to speak with an immigration lawyer. I'd researched solicitors, and found this guy who had helped to write the UK laws on immigration... figured he could really help me sort things out and offer super advice. Well... he told me to leave the country before my visa expired (didn't mean I had to go back to Canada..) so my b/f and I planned a trip to Prague. While in Prague, my visa expired, then re-entered the UK on a tourist stamp (valid 6 months) and the lawyer noted that this would give us time to get married, or figure out our next steps. This worked no problem! Month later, I went to Spain for a weekend. Upon re-entry into the UK, I was detained, questioned, treated like a prisoner, a criminal... then sent packing. Even tho, I explained that I acted on the advice of the solicitor, I was told by immigration that I was given the wrong facts. I should have done more research rather than take the word of a lawyer. All of this bad advice cost me about $4000, and sad to say but the relationship between my b/f and I became too strained due to all of this stress and we split (tho we are still friends) smile.gif When I emailed/called the lawyer about the poor advice, he had the nerve to say to me "are you implying that I told you what actions to take?"... a really nasty conversation and email absolving himself of any responsibility. And he had the nerve to CHARGE ME for this correspondence!

Anyway... take the proper routes, and be wary of lawyers and their advice... and their fees!!!!

I just received the k-1 visa in March. What others have said is so true. WAIT for the k-1 visa until you have it in your hands. Anything can happen! I did plan a wedding before receiving my visa and it was very stressful not knowing what was going to happen! It would have been a much happier wedding planning experience if I waited till I had the visa in my hand.

I did hand out the invitations when I had the visa in my hand. We estimated the time, and we were correct about that. But you have to have your priorities straight: visa first, wedding planning after.

I really feel for you. I think that you should get this process started as soon as you can. Waiting around will just get longer. My fiance and I got engaged in August of last year and we filed immediately and I received my visa in February - so there goes the wait. Time will go quicker than you think.

In the meantime I kept my teaching job and just kept teaching and making money which will be very much needed. You need something to do in the meantime- course work, job whatever just to keep your mind on something else. We both got webcams and we skype - that has helped tremendously. Also, planning a wedding made the time go faster. That way you are working toward a goal.

Last August I was so scared too, I thought how is this going to work out? Our wedding is this May, so soon and my fears have turned into excitement and joy.

I filed in Vancouver last September. It took us 5.5 months to get the visa.
The thing is if you get the visa too early, let's say in November, then you have exactly 6 months to use it. So that would be till May.

Now, as many others have said, take nothing in this for granted. I think you will save yourself a lot of stress if you at least wait for your noa2 to come in and then estimate the time. If everything goes smoothly you should get the visa within 2 months of your noa2 date.

We did what your mother in law suggested and it did work out but you just never know.

Also aiming for 45 days is not realistic. We got ours in 3 months and I thought that was fast. Have all your paper work ready, especially proof of income.

I'm in the middle of applying for a K-1. I've read the FAQs on this site and everywher else, but I had a quick concern.

For Documented Evidence of meeting within the last 2 years, I have my receipts for my airline tickets and confirmed booked flights, but I do not have all my boarding passes. I have the one for the last time. Will those count as evidence, or do they only look at boarding passes? I may have them laying around (which I will begin looking for) but the only one I know for sure I have (unless it got left at my fiance's lol), is the one for my most current visit.

My fiance and I are just getting ready to send out the I-129F and we have a few questions:

1. What absolutely needs to be an original copy?? (Other than the obvious - documents with signatures and photo's)

2. We have various boarding passes and a car rental receipt with my name on it from my visit down there for Primary evidence, along with a ton of secondary evidence (phone bills showing I call him 20 times a day blush.gif, and a ton of roaming charges from my visit. IM messages, all our first correspondences on eharmony, dated photo's of the two of us together, credit card statements showing purchases in each others countries as well as corresponding receipts and more). Will this be sufficient?? (I assume yes, but I want to be certain!!!)

3. What is the best way to go about writing out personal statements. I have a tendency to be slightly long winded, so I want to be sure of what I am trying to say and how I should say it before writing it out.

4. If all goes well, completely smooth, can I hope for a visa in less than 6 months?? As you all can fully understand, I need to get down there!!!

So, my fiance and I really REALLY want to have a summer wedding. There is little chance that I will obtain my K1 by then, so we were considering having a ceremony and reception without making it legal this summer. I would then return to Canada for my interview and we would get married legally after I get my visa and enter the states. Is this possible or would immigration have a problem with this plan. The sooner you recognize your options and how the system works, the easier this process is going to be for you. DO NOT attempt to do the 'oh this awesome job 'suddenly' came up while my wife was visiting on a tourist visa and now we are adjusting status'. I HIGHLY doubt that will fly with the customs officers.

MSU and pushbrk are right, your wife has NO RIGHT to visit the U.S. nor does she have a RIGHT to immigrate.

You are going to soon be a married man, this come with responsibilities and planning. You are going to have to face that you may have to give up your 'fly by the seat of my pants' attitude and life style and actually sit down and plan your life.

A LOT of people on here are going through immigration the way you explained, the waiting, the worrying, the stress. It is a difficult procedure but you are not unique. If you KNOW you are going to go back to the U.S. and are making plans, you can begin the immigration process in Syria through the US consulate which is substantially shorter wait time then you returning to the US and then filing the papers.

If her intention is to immigrate to the US then it becomes increasingly difficult for her to be granted admittance, regardless if she has a tourist visa or not as the customs officer will, as you have clearly pointed out it is your intention to do so, see it as if she intends to file immigration paperowrk upon arrival in the US which is illegal.

As of now, nothing to worry about. Enjoy your life with your wife and if plans change you can begin the immigration procedures. Just make sure it is done properly.

I am not sure how is works is Australia, but in Canada when we renew our passports with our new name on it, we submit a copy of the marriage licence and there's some form to fill out asking how the name is to be applied (ie first name husband's last name, first name maiden name husbands last name)

I am not sure this is a consulate issue, certainly not a US consulate issue as I have not notified them. Good luck

Nope, no problem about the ring. I'd assume that it will be a non issue. My husband and I do not have an engagement ring and it's a non issue

I think that as long as you can prove a bonafide relationship, whether it's 2 months or 2 years, you can file the finance visa. I am sure they may put you under more scrutiny the shorter the relationship.

Getting denied a tourist visa I do not think will affect your K-1 visa application (again VJ-ers correct me if I'm wrong) however, I am not sure if you'll be questioned about the tourist visa. They may ask you why you didn't have a girlfriend when you applied for a tourist visa but suddenly you have a fiance.

I understand the K3 takes even longer and most people recommend going the K1 route. Personally, I would rather get married in Brazil and come back to the States as a couple. If we did marry in Brazil, could she enter on her B2 and then adjust her status later? Please tell me yes... Filing the petition directly with the consulate in Brazil would not be an option for our circumstances. I'm not real sure why the forum doesn't show as much love for the K3.

Either option will no doubt present some logistical problems seeing as I'm currently out of the country. I'll have to rely on the Brazilian post to mail everything back and forth. Not exactly the most speedy or reliable. Any other issues I'll have to worry about being out of the country?

Are there any other options out there?

What advice can you offer me?

no, you cannot marry her, have her enter on her tourist visa with immigrant intent. She was given her tourist visa to be...a tourist, not to circumvent the immigration laws. She can enter with you and interview at home, as long as she does not overstay.

I agree, quickest way seems to be Direct Consular FIling (DCF) but I am not sure what the requirements are for Brazil. Good luck and welcome to the journey
