Documentary Proof of Having Met in Person in the Past Two Years and an Ongoing Relationship:
Use as many of these items are possible. There is no minimum,
but the more you can provide the less likely you are that you will receive an RFE. 1. Copies of all airline boarding passes, train passes, itineraries, hotel receipts, passport stamps (make sure you can read the dates on the stamps), and other documentary evidence that you have met within the last two years. You may want to highlight or place post-it notes indicating the dates and locations on the copies (to make the adjudication easier) for the person reviewing your file.

2. Color Photo's of you and your fiance(e) together. Make sure you write your names, date, and location on the back of every photo. Provide two to five photo's. If you only have a single copy of the photo, then make a color copy and send that. If it is a digital photo, have it printed at a company such as kodakgallery.com. You can also make duplicates of photo's at your local photo store (Walgreeens, CVS, etc). Place photo's in a plastic bag or photo sheet and label the sheet. Note that you may not receive originals of photo's back.

3. The following items will not typically show proof of having met in the last two years however will show proof of an ongoing relationship: Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also), stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

You will also need to show that YOU make 125% above the poverty line of a household of 2 is $18,212. If you cannot do this alone, you will need to find a co-sponsor

Meeting within 2 years of filing is not 'more or less' mandatory. It IS mandatory. You will not have a petition approved without it.

USCIS and the U.S. government does not tell you who to love. They simply decide who is eligible to move to the U.S. as a perminant resident as a spouse/fiance of a U.S. citizen. If you cannot prove that you have a bona fide relationship then you will not have much of a chance.

1. K-1 is probably your best option at this point. You can file now and then when she is finished her bachelors she can join you in the US and marry there

2. Personally, I'd avoid ANY type of marriage while applying for K-1 since it is for fiance and regardless of the type of marriage, the CO may see it differently than you and cause you problems.

3. If you insist on getting married first then filing, I suggest you go for the CR-1 and forego the K-3.

Read the guides, it will help you figure out what visa is best for you.

I wouldn't worry about it right now. If it is a concern you will receive an RFE. If you send the info now, there is little guatentee that the new GA-325 will make it to your file. Just sit tight now. Good luck.

I think the USCIS error as a reason to expedite has to due with the filed petition. As in there is an error with your I-130. An error with a previous application I do not think applies.

It cannot be prepared if the child has been brought back into the United States (although a different document may be requested - see the next two paragraphs), or, if the child is 18 years of age or older at the time the application is made.

If the baby is born to a US citizen abroad, then a CRBA needs to be filed so the birth is registered. If the baby has a USC parent who meets the residency requirements, the child is automatically a UCS.

Some embassys require a DNA test to prove the baby is the child of a UCS.

Now the next question is I am a Farmer, I do not make alot of money that shows on my tax forms cause of the way I work and my investment back into the farm. Do they go by gross or the end line on how what you make and will I run into problems. if it is not much? They take your income after taxes, you will have to have 125% over the poverty line or get a co-sponsor

I make enough to support myself and her with out problem I have my own home only thing would be insurance, but I am hoping that when she comes here she will be able to get a job that will get insurance for both of us.

I am paying her way through to take her test to get her license now also. to show support for her.

I appreciate any help you can give me and hope you can understand my post ok. Thanks Steve

While Canadians do not need a visa to VISIT the United States, they do need one to move there. There is no special procedure for Canadians. Yes, YOU will need to fill out the I-129F if you are going for a fiancee visa. Where you live will determine where her interview will be held. Western Canada is Vancouver and Eastern Canada is Montreal.

Entering EWI and entering EWI after a deportation are 2 very different things. The OP needs to know exactly what the consequences are for entering EWI after a deportation.

I'm pretty sure that he cannot adjust status because of the EWI. But also he must get past the reasons for deportation. If it was due to criminal activity, that is not likely to be overlooked.

Entering for 80 days with a 2 week break before you try and enter again for another 80 may raise flags and the CO may question your ties to your home country. There is nothing illegal about it but there is no guarentee either that you will be admitted. Remember, your 2 passports are linked (yes it's true) so if you stay for 80 days on your Swiss one and use your Belgian one for the second trip, they will know about the previous stay.

Remember, for a K-1 you must interview in your home country so you will have to return to Belgium (I assume) to interview.

Student visas are issued when the beneficiary has non-immigrant intent - not the case in your situation since that will be very difficult to prove with a pending I-129F.

Further, attempting to enter on a student visa (a non immigrant visa) with intent to adjust status further down the road is illegal anyway. Best to wait for the K-1

You will be denied at the interview since you are married and no longer qualify for K-1. As for the ramifications...someone else will be able to help you with that. The only thing I see you losing is time. You will have to spend longer periods of time apart as they deny your visa and you will then have to reapply. I'd withdraw now and file sooner

No, you cannot lie to the CO and tell them you are not married. If you are discovered you or your spouse is subject to deportation due to lying to a CO in order to get a visa. VERY bad news since it can also result in a ban.

DO NOT lie to a CO. You need to withdraw your K-1 and file the I-130.

If you did not meet the 2 year requirement when you filed then you will most certainly be denied. First they will send you an RFE for proof that you met in the last 2 years, which you cannot provide, then your case will be denied.

That takes time and since you are visiting in May, I would ask USCIS to cancel your petition and then file after you've visited your fiance. Then you can file as soon as your petition has been cancelled by USCIS.

Your fiancee has not been issued a visa. The petition has simply been approved. Her visa will not be issued until after the interview. As long as she has proper documentation that will show strong ties to Canada then she should be able to cross the border to pick you up.

You cannot get married and continue with the K-1 process. As Luv2 said, it is visa fraud and can have devestating concequences.

You will need to start again and refile the I-130. There is no way to switch.

I assume since your fiance has not been to the US in 15 years then she has a legal residence in Singapore? If she does, check the guides for Direct Consular Filing. It is quicker for petition processing. She will need to show that she intends to return to the U.S. this can be done by getting a job in the U.S. or getting a residence.

On some of my boarding passes, there isn't a year shown, or even a date (since they took the date stub on me a few times).

Is it okay if I write on the photocopies (or next to the photocopied tickets) the dates since it doesn't show it?

I'm unsure if this is a no-no for them or not.

Oh, and during one trip with my fiance we went to Vegas, would you consider hotel reservations for that DURING my trip to see him good proof?

I'll probably be on 2 part time jobs when I send it to my fiance, but there's only one present spot.
I understand that I can put "Present" down in the time thing, but my Adobe MAKES me put a year in.

Is there anything better I can maybe put down instead of present, or just skip computer and do it by hand?

The form says that I need to put in where I've lived in the past 5 years.
I have my permanent fixed address of my parents' house, and I also lived in two different places for college.
Even though the years overlap, is this okay?

Also, I'm currently living in a subleased apartment.
Do I have to put this address down too?
I'm kind of iffy about it, because I'm not getting bills sent here, or paychecks under this address, due to the fact that my name IS NOT on the lease.
Is it still safe to put this address down anyway?
