K-1 Fiance(e) Visa Process & ProceduresCan I send copied file

I need to send my fiance in Canada the i134 and intent to marry letter. It has to be dated within 30 days of the interview. We don't have the date yet, but can I just sign the forms here in US at home and scan them and send them to her. Then she can just print them out? Or do they need to be the original forms? Thank you!!

Original signatures on all forms/letters, you cannot scan them and send them.

K-1 Fiance(e) Visa Process & ProceduresQuestion 18 on I-129F

I was wondering about the same thing!
Also, I thought the letter of intent was just stating that you are willing and able to marry that person within the 90 days after they enter into the US? I wasn't aware you provided details of your meeting in that letter?
Also, for question 18 in the area underneath would you just say something like 'see attachment', or what is the proper thing to put when you attach a sheet?

Yes you would put "see attachment" if you cant fit your couple sentences on the line. On the attachment you would write the question number and the question down followed by the answer.

You don't want your intent letter to sound to mechanical! we are humans after all. Fell in love short para then intent to marry on entry etc.

K-1 Fiance(e) Visa Process & ProceduresQuestion 18 on I-129F

Most people would use a Continuation/Supplimental Sheet for this question. The Sample I-129F here on VJ also suggests that most do it this way. That being said, my Continuation Sheet explaining how we met was about 3 paragraphs. I explained about how we met and also how we saw each other within the 2 year requirement. My reasoning was more information was better than not enough. Hope this helps your decision.

They really only want a couple of sentences on that question. The rest of it would go in the 2 letters of intent from each person.

K-1 Fiance(e) Visa Process & ProceduresQuestion 18 on I-129F

A quick question, did a quick search too but couldn't find anything about this.

How much detail do you need for question 18 on the I-129F, "Describe the circumstances under which you met." Is a couple of sentences okay, I'm thinking of something like the following...

"We met while she was working at XXXX on MMM/YYYY, we chatted, exchanged phone numbers, texted for a few days then met up for coffee. We then started dating and chatting via email and text."

As you can see I'm not a very wordy person, but if they need more I guess I could add more fluff.

Just a couple sentences is what they are looking for. You have the right idea!

K-1 Fiance(e) Visa Process & ProceduresNeed to file Change of Address after POE?
Change of address is not required to be filed on entry to the USA unless your address has changed since the paper work was done like your situation.

GC holder and USC should file the change of address but the GC holder is required by law to change the address within 10 days of moving to the new address the USC is not required by law to do this. http://www.uscis.gov...00045f3d6a1RCRD

K-1 Fiance(e) Visa Process & ProceduresHelp Me Understand the K1 Processing Times

So, basically that indicates if I submitted in January, the earliest we would hear our NOA2 is late July? Am I understand correctly? Sometimes I wonder if I should just move to her country, where not as strict to enter, etc. Does consulting with a lawyer help with the process going quicker, or make exactly no difference. Thanks again for anyone's help!

Lawyers have no power what so ever to make anything faster, they often actually slow it down by making errors on your papers. They also charge so much money for something you yourself can do using the guides and example forms found on this website.

ok cool That's what common sense was telling me, and what i was hoping to hear, but I didn't want be deceitful.

However, what happens if her interview is say, May 11th, and I had moved in to the new place on May 10th...should we still just wait til she gets here to change the address officially or...what?

Put the new address on the AOS forums when you file.

If you do not live there, there is no point in putting that address on the forms. Use the address you currently live at. Do not complicate the matter because you " might live somewhere but have not signed anything ".

Also just to add because I forgot in my other post - if you don't get any text / email and get the NOA 1 in your mail box. Take this to your computer and go on the USCIS website, make an account and put your case number in your portfolio - from here you can manually select to have text and emails sent to you. After that you should then get them. ( had to do this from start to finish because they never used my contact forms I sent )

K-1 Fiance(e) Visa Process & ProceduresSeparated, divorce pending, petitioning another woman after divorce

In 2010 I married a Filipina in the USA after I petitioned her on a K-1 visa to come to the Philippines. We since split and have a pending divorce. But I am entertaining the idea of going to a different country to meet a girl that I really like. If all goes well we take things to the next level after my divorce, would it be possible then to petition a new fiance on a K-1? What are the rules regarding divorce and petitioning again? I definitely think you shouldn't be punished and not allowed to it again. You want to fall in love again, and be able to petition if need be. Some things that happen are beyond your own control :/

There are no rules on divorce and petitioning again. There are rules on qualifying to petition for someone and how many K-1 petitions you can file within a certain amount of years. These are stated in the instructions for the I-129F. http://www.uscis.gov...i-129finstr.pdf

K-1 Fiance(e) Visa Process & ProceduresHelp! I-134 for fiance visa?

I read yesterday that income for the I-134 is actually 100% FPL not 125. 125 is for the I-864.

Embassys and consuls look at the 125% because you have to prove 125% when you get to the USA.
100% is actually used for military people only generally.

The K-1 will take 6-10 months from start to finish. The 3 months you get might be for USCIS processing.

No, the Canadian cannot move to the US without a visa, they may VISIT, but not move. The medical and interview must be done in Canada.

Separation may be part of this journey, as it is for most people. Canadians may visit for up to 180 days, but be sure he does not overstay

Actually, is your intent to STAY in the US once married? If she intends to immigrate and live in the US (we should not assume, perhaps they are going back to Hong Kong or to a 3rd country) then she needs an immigrant or dual intent visa (such as a K-1)

Do not have her come to the US on a tourist visa or Visa Waiver Program if you intent to have her immigrate, it is visa fraud

K-1 Fiance(e) Visa Process & ProceduresCanadian moving to the USA

Hey everyone, I am hoping that I can get some responses hearing from people who have moved to the USA and can give me some ideas about moving my stuff.

I have a decent amount of stuff (a 2 bedroom house worth of stuff) to move.

We are unsure if we should hire a moving company or use a uhaul, etc. Its a 15 hour drive to where I am moving to. Should I uhaul it myself? has that been a problem for people?

Are moving companies very expensive? Is it less hassle?

Any experiences would be greatly appreciated.
Thanks!

My wife and I UHauled it from Northern Alberta to Florida. No problems at all. Was a lot cheaper than any moving companies, too. If you are planning on moving your posue before you get your immigration visa, you need to make sure you bring proof of ties (NOA1, Employment Verification Letter (with recent pay stubs and a statement from your employer that you're expected to return after your visit to the US), Rental Agreement or Title to Home, bring only enough clothes for the trip, return airline ticket, etc.) If you're moving after receipt of your immigrant visa, then no worries. Just show up at the border with your stuff.

Had I done it all over, I would have had movers help me load the UHaul. But other than this part, no regrets. If you're strong enough to load all of your stuff with no help, then you should be good with just a UHaul.

K-1 Fiance(e) Visa Process & Proceduresprocessing dates

It might be a silly question but Im bit confused...I havent seen any new significant approvals from CSC as they seem to be going a bit slow as stated here on VJ before but
when we go to Immigration Timelines and there's that processing date list, it says CSC is now processing September 21 petitions. And this week it changed from July to August
to now September quite fast. So I was just wondering where does this data come from? Cause I know not everyone that applied is here and lots of people dont update their timelines
so Igor's List is just to give us an idea and even though I like to see the dates changing on this list I'd like to know based on what they update it. Thank you!

VJ gets this info from members. So new approvals make the average waiting time decrease depending how quickly they were approved.

If a new approval was approved quicker than the average waiting time, the date moves forward. If a new approval takes longer than the average wait time, the date moves backward.

It all depends upon the average for VJ members in that particular category of petition or application.

K-1 Fiance(e) Visa Process & ProceduresEffect of Reports Made to ICE/Dept Homeland

Thank you all for your responses. I think I just need not to worry as what evidence would he have for ICE to investigate. Like "Life's Journey" suggest ICE wouldn't investigate a frivolous claim. And really what could prove other than what his mouth says.

I just felt a worried because its approaching five months since I've filed and I wouln't want any uncessary delays. Especially since Jamaica is already classified as a high fraud country. Either way as bs058 recommended, I will keep the copy of his text and when we are due back in court I will have the opportunity to make this order permanent and never have to deal with him. This immigration process is complicated enough without having to deal with idiots.

Thank you all again for your support. Good luck with your journey.

It's a good idea to keep as much documentation of your communications with him as possible.

K-1 Fiance(e) Visa Process & ProceduresEffect of Reports Made to ICE/Dept Homeland

Hi Everyone,

This pretty much is out of the norm, but figured I'd post the question here. I tried searching for an answer through google but this seems to be a unique situation. Has anyone ever experienced or know what effect a claim/tip placed with ICE or Department of Homeland security has on the processing of a filed petition for K1 visa?

Here's the story. My ex (whom I have a filed order of protection against) claims to have contacted these departments reporting my fiance's name. He did not elobrate as to what he reported, but my fear is he has made an accusation that my fiance is fraudulently trying to enter the country. My ex works in the legal system so I know he has the capacity to cause such a problem. It really is embarrassing to me because i can't believe I ever spent any time of my life with this person. Anyhow, my fiance is aware of this situation. I'm just worried that this may cause delays with the processing of my I-129F or K1 on his end. The relationship I have with my fiance is bonafide. We love each other very much. I have visit him every 3 months and we speak to each other every day sometimes 3-4 times a day. We have met the test of meeting in person within the last 2 years.

Has anyone ever had an experience similar to mines, or atleast experience claims of fraud to ICE/Dept of Homeland Security? Or does anyone know what effect a claim like this would have for our petition. I know there may be an RFE, but what kind of informaiton would they ask. Should I file a copy of the order of proctection against my ex now or wait?

Thank you.

A report from an ex doesn't carry much weight. And because the relationship between you two, if he tries to dabble too much he could be putting his law license at risk as members of the bar are held to a high standard of ethics, and there is clearly a conflict of interest if he tries anything stupid. I would say there is nothing to worry about. Just keep all of your correspondence with him (emails, letter, texts, etc.) and there shouldn't be a problem.

You don't need to file anything in regards to your ex. This petition has nothing to do with him. If it comes up, then show them.
