Once the petition is sent to the embassy, we are supposed to get our police clearances, thats what I am aware of. For Canadian police clearance, how do I go about ? Can I get it from a local police station or is it necessary to get it done from RCMP (Royal Canadian Mounted Police)?

Hey Mike, your message was kind of vague. But I will try and answer your question to the best of my abilities.
From the way you have written your message, it sounds like you want to know whether the email conversations you guys have had in the past have to be translated in English or not for the I-129F application?
The answer to that is Yes !!! UCSIS does not understand your mother tongue, the only language they know is English and for them to consider these emails as an evidenciary support to your application is by understanding what they read.

Okay, here's what happens ! All the correspondences from USCIS will directly be forwarded to the petitioner (that is you in this case not your foreign fiance). Once, you receive NOA-2 and the package clears the NVC, it will be forwarded to the US consulate in your foreign fiances country. Thats when, his address comes into play as the embassy will forward him packet-3/4. I hope this helps !

Here's the scoop: During the "Initial Review" phase, it says that background checks are initiated on the applicant/petitioner. However, I think they conduct background checks on both, the petitioner as well as the beneficiary as these are just preliminary background checks.
On the other hands, after the I-129F is approved, it is sent to NVC (National Visa Center). At this time, the background checks are conducted on both, the applicant and the beneficiary.

Hey guys, the US consulate comes under the DOS (Department of State) and so does the NVC (National Visa Center). When your case if forwarded from USCIS to NVC, all the relevant details are transferred too (this is why they ask for your and your fiances DOB and Name along with your email address when you call them to inquire about your case status).
So if the embassy were to email your fiance the packet-3, they would have their address from NVC. That being said, I am not sure if the embassy actually emails P-3. They send it by mail, its a list of documents that you need to download from the links, along with a checklist and you send these things back to the consulate.

Hi I found this web site last night and was so happy to find somewhere to get advise and support, I'm Australian and my fiance and I haven't started the K-1 process yet. I currently live in Canada, but plan to leave in Dec, drive with him to his home town, stay for Christmas then go home to Australia and start the process. We have a few concerns and would like some advise.

1. My fiance earns above the required amount for his household, however he has been at his job for 3 months and before this was studying, his parents who he lives, with are happy to co-sponsor me but individually don't quite make the amount. Will me need to find another co-sponsor or will they take the combined income?
-> As far as I know, the embassy/consulate will NOT consider a combined income. If you have a co-sponsor, he/she alone should meet the income requirements.

2. I read a co-sponsor has the same responsibility as a sponsor, does this mean my co-sponsor needs to fill out all the same forms his does, or only the affidavit of support?
-> The co-sponsor only fills out the I-134 i.e. Affidavit of Support. However, the co-sponsor will have to submit documents proving his/hers domicile status in the US along with copies of Birth certificate/passport indicating his/hers US citizenship.

3. How current does a police record check need to be for a country previously lived in? If I get my record for Canada before I leave, will it be acceptable for the interview.
-> The police clearances for most countries for embassy(immigration purposes) are valid for 1year. However, I would still try to be on a safe side and get them issued within 6 months of the interview date.

Last question.
4. Planning the wedding? we would like the big white wedding with everyone there, should we wait for all forms to be processed and approved or start planning for a date well past the project time line?
-> Well, this is a tricky question. You have to understand that your application goes through USCIS (Department of Homeland Security) and then once approved ( keeping fingers crossed for no RFE'S issued) then it is forwarded to the NVC (Department of State) and then to the beneficiary's listed consulate. So, it is kind of a long process. However, that being said, the current processing speeds are actually faster than what they used to be, especially the Vermont Service Center. I would advise to atleast wait till you get done with the USCIS stage for planning the wedding. I know most of the people on here might advice you to wait till you have your visa in hand and they are right too. That is just my opinion !

Hi Andy, it does not matter when you send the I-129F according to me. The border guards that is the CBP officers view each visitor as an intending immigrant. All you have to do is prove to them that you have "ties" to your home country. A letter of employment, house lease, a return ticket, if you are in school a copy of your schedule, everything that prove your ties to your home country.
If you submit your I-129F before that and you get a copy of your NOA-1, carry a copy along and show them only if they ask for it. However, be completely honest with them. They know much more than you think they do. If they ask you the purpose of your visit, tell that you are visiting your fiance and his family for Christmas.
As long as you convince the CBP officer that you will be returning home, I do not see any problem why they would not let you in. Let me know if you have any other questions and take care.

You're not obligated to tell them that you are going to visit your fiance unless they expressly ask you, however complete honesty is always the best way to go. Having strong ties to home is a good place to start, you don't want to get yourself into immigration trouble by looking like a liar.

1) Your chances of getting a B2 will have diminished considerably since you got your last one. Based on
a ) you having a fiance
b ) you having been denied a previous extension, They may not specifically ask you that question but when they ask questions like "have you ever been denied entry or asked to leave", I think not mentioning at that point and having it come up later would be ground for a ban. But I am no expert.

what might help you getting a B2 in the interim would be if you had a NOA1, showing that you are and do intend to follow immigration law generally gets individuals a long way.

2) Absolutly not, that should have no bearing on your I-129f application, I would even use it as proof of a relationship with your significant other.

Plan your wedding, here or in Canada, get married and then file the I-130 for a CR-1 visa. During this time you may visit the US if you have adequate proof you will return to Canada. You cannot "live" in the US until the visa is issued, but you can visit for as long as they allow you to. You cannot work on a visitors entry.

Really? I had no idea, and how long does it take "typically" these days until you get such visa? So a couple can get married today and the spouse continue to work and live in Canada until the CR-1 visa is approved. There is no guarantee that they will let you into the USA once you tell them the situation though I'm assuming?? I can still show them all of my ties to Canada, but I could be denied entry though right? Sorry, i'm just really curious about this process.

I am from Canada (beneficiary) he is from the USA..:-) So you can't cross the border until after your interview in Montreal to marry? That's when they issue the K-1 and where thereafter you have 90 days to marry once you cross into the USA?

Is that correct?

So then, how long would it take if I went over to the USA, got married..on a whim of course..:-) I guess I would have to stay in the USA? File the CR-1?? Then how long until I could work?

Or can a Canadian get married in the USA, travel back to Canada..continue with my job here..etc. Until I get my working visa and approval to live in the USA. How long would that process work? Just approx...thanks again!

If you say I am just visiting but you do get married, then those two conflicting stories MAY come back to haunt you, usually during the interview. I am not saying they will, but not telling the truth is/can be very bad.

I fully understand this and will never lie to a border patrol. To avoid all of this wouldn't it just be easier for us to apply for a marriage license in Canada, get married IN CANADA, he goes back to u.s. and we apply for everything while I remain here in Canada and still working etc..??

BTW, did I mention how great I think this site is?? good.gif

p.s I'm across the border from Detroit, so either way i'd be going to Montreal.

I have been here everyday pretty much since I joined in August. I have been studying the k-1 and the CR-1 options and reading everyone's advice and interpretations.

We have not filed for anything yet as I don't know which option works best.

I have a number of questions if any of you are bored and can answer them?

I am Canadian, he is U.S.

1) If we file for the K-1 visa, I can't enter the U.S. until it's approved right? So it takes approx how many months until I can?

Then when it is approved, I can enter the U.S and then you have 90 days to marry. During this time I can't leave the U.S.

2)After you are married, I can apply for AOS then I can get a ssn and start my job search right? How long does that take approx?

Option CR-1

I enter the u.s. and get married. Can I go back to Canada and work until the CR-1 is approved? If so, how long does that take? Can I enter into the U.S. back and forth during my visa wait, Or do I stay in the u.s. do an a.o.s and wait for a ssn so I can work? How long would that take?

Sorry for all of the questions, but I have no idea what option to choose. Number one priority is to be together in the U.S. and for me to find a job as soon as I can. I have older children in Canada and would want to go back and forth to visit them of course.

Hello everyone. I have a question and I would like to know the proper procedure for this. My boyfriend/fiancee has 3 kids in total. One lives with him and he gets child support for her and he claims her on his income tax returns. His 2 boys live with there mother and he pays child support for both of them and he does not claim them on his income tax returns. My question is, when we fill out the affidavit of support does he need to put that he also supports his two boys even though he does not claim them on his income tax returns? At that point will he be responsible for just a household of 3 or 5 people???Anyone, Please if you can help me with this, I would really appreciate it. Thank You

I believe everything needs to be original signatures they dont accept copys of signatures, its possible you could get RFE for it but you might not too if they dont notice.

Send everything you have for evidence the more the better.

For form G325A i THINK you can send 1 of them for him and 1 for you.. if it is the new form. If it is the old form you HAVE to send 4 copys from him and 4 copys from you. With 2 passport pictures of him with his forms and 2 passport pictures of you with your forms.

Someone may have more info tho on the new forms, I just sent 4 of the G325A for AOS anyways just incase.

I have family living here as well all are amercian citizens american born. As per my understanding if they co-sponser you, as i was told, it could create problems cus its a direct family member. I could be wrong but USCIS said when I called them that having direct family co-sponcer is a whole other can of worms when you are entering on a K-1.

if he is petitioning for you to move to america i beleive he has to find the co-sponser and it has to be american, it cant be your own family member.

if you are sponsering him then you need to find a co-sponser.

if im wrong im sure someone will correct it lol,
as an example if my husband had to get a co-sponser to bring me here, to america, he would have had to get a family member or friend to co-sponsor me. I could not ask my family member to do it.


and when i say it has to be american the person co-sponsering needs to be living in america, or the respective country you are moving to be with your fiance. Cant be sponsering from another country.

For all our documents from USCIS it was an I-797C. We never got a I-797 for our NOAs, transfer notice, or Welcome to America. You got the right form.

1) You should have original signatures for all 4 copies of the G-325A - preferrably in blue ink

2) Question #10 is regarding how you acquired yoru citizenship, if you were born in the US then you check the appropriate box and move on to question 11. If you were not, check the appropriate box and complete the information regarding your naturalization certificate.

Well, I doubt they will ask for your NOA1 for your change of status nor do I think they will bother with contacting your host family.

What's done is done, you didn't lie on the forms but I'd be prepared to answer some difficult questions as to why you thought you were entitled to work (immigrant benefit) when clearly you knew you were ineligible to do so. If you answer honestly and confidently I think you will be Ok.

2. This is only illegal if you marry and stay. You may marry and leave the country, back to Canada, and wait for the visa.

The only difference between 2 and 3 is the locaiton of your marriage. Regardless of where you get married, the paperwork is the same for a Cr-1. Don't go for the K-3. It is basically an obsolete visa and, when I filed, were being processed 6-8 weeks after Cr-1.

The main difference between K-1 and K-3 is that K-1 is for a fiance, K-3 is obsolete and for a spouse, read the guildes

Safer? Well, neither option is going to get your killed jest.gif but safer traveling? Either one you will have to being ties to Canada to show you do not intend to violate any immigration laws by entering as a tourist and trying to adjust status.

For both visas, plan on 6 - 8 months. Montreal is s-l-o-w when it comes to scheduling interviews.

No, furniture will need to arrive only after the visa has been issued, typically a copy of the visa is necessary when moving large items. This is because you are technically importing your furniture.

My husband took a bag back with him before I moved, it was searched and he had to pay a duty on it. It's WAY too much of a headache, save yourself the trouble.

If someone has had better luck with importing large items, I hope they will correct me
