If you get married during the K-1 process, then you forfeit the K-1 and you will have to refile. The I-129F does not carry over. This also means paying the filing fee again

The I-129F does not need to be filed with the I-130. You have the option of doing that if you want to go the K-3 route but if you have been doing your homework, K-3 is virtually obsolete and not worth your effort (unless you'd like to post what country you are from then maybe the answer would be different)

Don't be sad. USCIS is not unreasonable. I am sure as long as you have your asylum papers, maybe even a letter from family explaining what happened (sworn affidavits) it will be OK. I mean not everyone comes from perfect, record keeping backgrounds.

Just take it one day at a time, keep trying to get your birth certificate (perhaps get a family member to try in Vietnam). You'll be ok

tri_gear - estimate on 6-10 months. Montreal is horribly backed up so if you are interviewing there then it will be a while from NOA-2 to interview. Vancouver is quicker however. Where is the beneficiary from?

Nope your contested/non contested divorce, it does not matter. But you will have to be able to legally marry (obviously) no matter what visa you apply for. So you'll have to wait until you're divorced before you can file

I'd go for the Cr-1. It is cheaper and it allows for immediate work and travle (unlike the K-1 and the K-3 is useless in your situtation). But yes, sadly Montreal, where she will interview, is dreadfully backed up so speed in this situation is moot since the consulate is at a snail speed.

In the I-129F I would make note of the dual citizenship, either in question 3b of the form or on the cover sheet. However, I'd also note that the interview will hopefully take place in Taiwan. It shouldn't cause a problem as I am positive your fiance is not the only dual citizen to apply. They can question her about anything they want to, as long as she is honest about why she uses the Canadian passport (obviously the absence of a formal visa, better reciprocal agreements between Canada and the US)

As for visiting you, my stock answer is - no guarentees. Duration of stay and admittance is up to the CBP upon entry.

Yes proof of your relationship is important. So is proving you've met. So gather LOTS of evidence on this first trip. Focus on primary evidence like passport stamps, boarding passes, hotel receipts, etc. Get your cell phone logs and e-mails as well.

Interivews will be in your home country and can have the petitioner there if you want to.

If this is your first meeting EVER and you've only known him since May, I strongly suggest you do not marry on this trip - it may raise some red flags.

No - a K-3 visa is for people who are outside the US. You don't need a visa once you are in the US. Visas are for people who want to enter the US. You can go to the US, get married, cancel your K-1, forfeit your filing fee, apply for the K-3 and then return to Itally. That's no problem.

less painful route? well that depends on your definition of painful! The fiance visa is certainly quicker, however I've noticed a lot of complaints from people entering on a K-1 as they sit at home for 3 months not being able to work or travel. Plus it is an expensive visa, requiring $1010 after entrance into the US for adjustment of status; this is on top of all the filing fees

The CR-1, spousal visa, is a little bit longer - which is painful - but it is an automatic green card once you enter. This allows for work and travel.

Both visas have great benefits but also both have drawbacks. Read the guides for a more comprehensive breakdown of the process and the visas

In GA you have to be a legal resident in order to get a driver's licence. Each state is different. I suggest you contact your DMV and found out what you need to do in order for a driver's licence to be issued

We used a lawyer, and th significantly slowed our petition down. They simply aren't invested in the process so it takes them days to send back mail which you could do yourself the following day.

He could always visit during the process, admittance and duration of stay is up to the CBP at the POE

You need to make sure you guys aren't using the TN visa to get around formal immigration laws. If your fiance truly wants to go to the US to work (and keep in mind a TN is not a guarentee) then by all means she should apply. If you are using it in order not to be separated during this time, then you should apply for the K1 since misuse of a non-immigrant visa is fraud and can result in deportation and a ban

If you go for the TN route, have a work visa should not affect her adjustment of status.

I came to the US initially on a student visa, and although your work is restricted on a student visa, it can be done.

I agree, if you both are just starting your studies a student visa might be the way to go.

Full immigration is a huge investment in time and money, not something to be taken lightly - and it is certainly not an easy process.

If you're going to get legally married before applying for a visa, you have to do K-3 or CR-1. CR-1 is faster from what I've seen and you get a green card a few weeks after arriving in the US, unlike K-3 where you have to adjust status in the US.
CR-1 is also cheaper.

If you don't wish to get legally married in Hong Kong and just have a ceremony with nothing legal binding it, you can then file for K-1, since you're still engaged and not legally married. (Since you didnt sign a marriage certificate)

I'd look into the visa options for your country in the other sections, they'd usually have better advice since the consulates vary as to what they're looking for per visa type.

They could make you wait a few more months.

It could be them taking the check out, it moving from desk to desk, or they're working on it.

The time is different between consulates and how fast you send paperwork.

And yes, once it's filed you two can visit eachother.
My fiance's visited me and is visiting me again, because my consulate takes a long time with interviews.
I could have gone to the US, but we decided he'd visit me instead.
You just have to prove you're going back and not staying in the US permanently. The NOA1 is actually a pretty useful piece of paper that can help you show that you're not getting married and staying in the US, since marriage voids the visa out.

You have to have your legal wedding in the United States, there's no way around that. If her family can get there, they can be part of it by all means, but if they cant get there and you want to do a wedding for her family, after she gets her green card and is able to travel again, you can have a non legal/ceremonial wedding in Columbia.
It seems quite a few people do this, since it's hard to get all of everyone's family in one place.

Hey Ben and Sam, I saw your reply and I must say, thanks a ton for all that relevant information. You have no idea how much I am freaking out about this trip. I swear I have no intentions of staying there, I just want to visit before the interview.
I am currently in school so I will try getting 2 letters from my academic counselors stating that I will be returning as soon as the semester commences. Plus, I have a job so I will try and get a letter from my employer. Also, a copy of my return ticket.
Also, if we get into that "I-129F" questioning, I will keep the entire package with me just like you do. Is there anything else I can do to convince them that I will be returning to Canada?
Do they have any record of me already having applied for K-1 ? And hey, please let me know how it goes for you when you go for thanksgiving. I hope you just glide through past the customs.

I want to be completely honest with them but at the same time, I don't intend to divulge any "extra" information...If you know what I mean.
And is it true that if they make up their mind to deny you an entry, you are banned for a period of 6 months/1 year ?

Is it more difficult to enter US after submitting packet-3 to the consulate from Canada ? I read some posts on vj which said that after you submit packet-3, the consulate enters your passport # in the system which pops up at the POE. Would visiting on holidays like Christmas make it easy to enter?

Once the visa is issued, the alien fiance has 6 months to enter the US. After entering the US, you have 90 days, that is, 3 months to get married. I hope this helps !!!

Once the petition is sent to the embassy, we are supposed to get our police clearances, thats what I am aware of. For Canadian police clearance, how do I go about ? Can I get it from a local police station or is it necessary to get it done from RCMP (Royal Canadian Mounted Police)?
