Hi everyone!

I am a grad student so I am basically depended on my student loans nowadays.

In order to bring my fiancee to live with me, I am planning to apply the K-1 visa for her. Since my income doesn't meet the requirement, I am going to ask a married couple to be my joint sponsor.

Because I am just making a small income, should both my fiancee and me be considered as a part of the joint sponsor's household for i-134 and possibly i-864 later?
In this case, the household count would be 4.

Or should only my fiancee be included as a part of the joint sponsor's household?

If the second case is true, is it correct that I should not put my fiancee's name on my i-134 and i-864?

The couple's income would be able to support them plus my fiancee. Does it matter if I put my small income on my own i-134/i-864 that may seem like that I "cannot" support myself?

Only the immigrant is counted in the other persons house hold - the US citizen is not sponsored lol.
You have to supply the forms regardless of how little income, as you are the primary sponsor.

This isn't true for all countries. Some do process the visa date as the date of the interview.

will it affect for our petition?

we are still waiting for our noa2 and when they approve it, what passport number should i write down for DS forms?

Use your new passport not the old one. Bring both the old one and the new one to the interview in case they ask questions. But only give them the new one if you pass and get the visa stamped in the new one.

I am wondering about if my Fiancee will be able to travel back to China shortly after we are married. I have heard there is a two year waiting period. She has heard three years. With an elderly Grandmother, it would be comforting to know she would be able to visit. Thanks


When she has her green card she can travel. After marriage you file AOS as soon as possible.

After a year long wait , we got this response..
Our K1 was denied last year because she had a previous petitioner "22 months before" and USCIS said old petition was still active. Old petition was abandoned.

Does this mean we can try K1 again!!!???
I would like to do a K3.. just CANT be away for 30 days because of job and other responsibilities.


K-3 is no longer issued. You would file for a CR-1 after marriage.

You need to find out how to close the previous petition if they claim it is still open. Filing again with the other active petition still active will likely cause a denial again.

But you are saying they still could have approved it without worrying about the 2 year thing with her J1 visa?

We have not filed for a waiver. We just discovered this.

Yes they would have because its on you to be prepared with the proper documents. If shes denied she will be denied at the visa interview.

Use the link you posted and research - check the page they have that tells you if she is subject to the 2 year requirement.

In line 14 of this document. It asks for "Spouses Name"

Problem is we aren't married yet. So how is this approached. There isn't anyplace to put my name on the document. I am the American. She is the Canadian and it seems like I should put my name on the the Spouse section. BUT if I say I am a spouse, aren't we saying we are actually married, when we aren't?

The whole idea of K1 visa is to get married after the visa, so I am confused as to what to do with this form.


I just pulled out my DS-230 from Canada k-1 application.

You put N/A in the spouse name area and N/A in spouse address.

I'm snooping thru different topics on the forum and i've seen "alien registration number changed" on a few timelines. Can somebody tell me what that means?? I went to the USCIS website yesterday to register for updates based on a post on this forum. That felt like doing "something". It says on that site that as of the end of Dec. 2012 average processing time for CSS is 5 1/2 months. I'm wondering if anybody is getting their NOA2 back in that amount of time these days. The A number shouldn't change. Once you are given it, it is yours for the rest of your life even after you become a naturalized citizen.

I have made an appointment to get my fingerprints done tomorrow at my local Police Department. Then I will send them to Canada on the form they requested, so they can do a police clearance for me. It costs 69.40 british pounds to get these fingerprints done (around $106 U.S.Dollars), plus $25.00 Canadian Dollars to do the Canadian Police clearance. Expensive fingerprinting!

I am the beneficiary. I was in Canada for 2 years. I came to Canada from the U.K. as a visitor (my ex husband was Canadian), and overstayed my visit! However , i left Canada March 2011 and never went back again. Do i need a police certificate from Canada? If so, would i have trouble getting one because of this? (I never got into any trouble with the police at all over there.)
Also.. do you think the fact that i overstayed in Canada will be a problem in my K-1 application?

Would just like to add that i have never overstayed any visits during times present in the U.S.


I'm not sure where you are in the process but filing for a police certificate from Canada when you are not in Canada requires fingerprinting to be done and sent to them and it can take a VERY long time. You may want to apply sooner rather than later, I have seen some requests take 4-5 months to get the police reports back.

If you are a Canadian living in the US as a LPR the Canadian government will pay EI if you can't find a job or lose your job? How long does this benefit last and do you have to continue paying income tax in Canada?


Yes you continue to pay and file taxes in Canada when you collect EI. No you cannot collect it if you lose a job in the USA, its only for the period where you do not have one. The only way to get it is if your previous employer filled out the papers correctly stating you left because of family relocation. If they don't put the correct thing then you cannot collect.

Well, my husband was questioned over an hour and was asked all the questions at his interview plus newer one to see if his answers matched two months prior to his interview. His POE was New York, and many were questioned not just my husband.

So yes, they can question him.


Sounds like he got profiled on entry. Thats not a usual occurrence when you enter on a K-1.

Yes I called DOS back when I was trying to get information because NVC would not respond, when calling DOS the person said my case was only at NVC for 2 days and the embassy had it and already sent me my forms. They were WAY more helpful!!

Even though its expensive you should really be phoning them not Emailing. You would get the answers to your questions right away.

If you call DOS ( department of state ) you can get way more information from them than NVC usually. Such as if the embassy has it already and if they have sent you anything from the embassy.

I see no requirement for tax returns at all. I lived out of the country the year before and didn't work before that as I was in school. I'm just sending my return for 2012 and it will just have to do I guess


US citizens are still required to file taxes even if they are not living in the usa.

The instructions request 3 years of tax returns. You need to read the 864 instructions.

Do I really need a letter from an officer at my bank stating: When I opened the account, how much was deposited last year, and my current balance? It's not a problem, but I was just planning on submitting screenshots of my online bank statement. Obviously, I'm also submitting original paystubs and a letter from my employer as well.

Also, it appears that I don't need to show my taxes from last year? The instructions say nothing about it unless you are self employed...I may include a copy of what TurboTax sent me just in case...

Any thoughts or advice? I'm sending this off to my fiancee today or tomorrow at the latest.


You only need a letter from the bank if you are trying to use savings as your proof of support. We didn't even include any screen shots of bank account at all.


If your income is over the requirements then you do not need to provide any bank information at all, just your income information, pay stubs, 3 years tax returns, letter from employer ( optional ) etc. Most embassys follow the guides for the 864 do not forget. So you will want 3 years of tax returns.

Generally you get a text first that your case has updated and when you check it online on USCIS it would say you were approved. Then later you get your letter in the mail.

I would suggest trying to contact them after 6 months not before, They will likely tell you to wait 30 days and call again tho which is the most common response they give.

Contact MTL via email, put your MTL number as the subject. Tell them about the situation and ask if you can speed up the process. There is no harm in asking, Montreal has been lenient before in these types of situations.

Or call the DOS and ask if P4 has been mailed yet. If it has she should be able to go online and book her appointment right now.

When I make a copy of my passport to show proof of entry/exit, should I use a color copier? Does it matter? I prefer not to spend the extra money if it is not necessary, but if it will make a difference I will definitely do it.


Black and white but if you cant see the stamp very well in black and white sometimes color makes it more visible.

Being in the military does not give it a higher chance or anything. You do have the privilege of applying for an expedite if you are active duty military and deploying to a dangerous location.


Sometimes military applications are processed a little faster but not always. Its completely dependent on your background checks and hers + the childs. The more information you give them the less chance of hang ups and slow downs you have.

Same goes for Air Force. Have to go through forms and special clearance and get a letter that states you are able to marry the person you choose to marry. Then every year or so you have to fill out all the forms and stuff again.

The only thing I do not know and have been looking for is if when the FN becomes a US citizen by naturalization if they are able to update this and not have to do the forms anymore. I read somewhere that they do in fact need to update the forms stating the FN is now a US citizen but cannot find it anymore.

AP = Administrative Processing. When they process your case due to changes/updates/putting it into the system/Issuing embassy case numbers etc.

Hi,

My NOA2 was received on 3/8/2013. I received (called in to get our case #) on 3/21/2013. Today I receive an email following up to my email request to update the beneficiary's mailing address. Within the email the following text was displayed "This petition is currently undergoing necessary administrative processing. You will be notified with further instructions when the processing is complete." I know there is nothing I can do. But I need to understand what this is and what this means. Does this mean now the embassy may put us in AP if they approve us at the interview? I can't believe this. I everything seemed like smooth sailing. I followed the guides on this site prior to submitting my K1. I seriously front loaded that application with everything! My name nor my fiance name have a middle east origin. My fiance has never been in the US. I have never been convicted or involved in a crime. I just don't understand why we were picked or better yet how much time does this delay take from me and fiance being united.

Anyone who has had this experience (K1 specific), especially through Jamaica please advise? I do not know exactly what this mean and how long to expect. :crying:


Sounds like its because you requested an address change to the beneficiary. K-1s do not usually under go AP at the NVC stage unless information changes and it needs to be updated. I would not worry much about this right now.

So they have been waiting for a phone call for almost 15 months? Or did you mean Feb 2013.

If they are married they cannot have applied for a K-1 visa because it is for unmarried people only.

What did they file for, when was the interview, were they given a paper at the end of the interview and what is on the paper. We need a lot more information to help with this.

I plan on getting my job next year so that by the time the interview comes up I can prove I have enough money to support. Will I need to present years back of W2's or will check stubs suffice? If so about how many? I know I will need a letter of my employer, what else do I need? Has anybody had any experience with this? Please Help!


W2s are required if you are using tax returns instead of tax transcripts. Just order the transcripts from IRS online or by phone and you wont need to use W2s.

I haven't encountered that... 30 days. I know it should be recent , closer to interview date. That's why its better to get those copies right after you know or interview sched has been set. Hmmm, wondering how recent? or at least? guys who just gone with this, can you pls. :help:


As I have already stated this dated within 30 days letter of intent is specific to Canada US embassy. You need to check with YOUR country in your countrys forum section.
