I would send it all again with anything else that you can to prove citizenship ( not sure whatelse you could find as what you gave seems good? silly uscis. ) Its likely they lost it or missplaced it tho too is why they are asking for it again. Send it as soon as you can so that hopefully they resume the case quickly.

So shes got all the paperwork stating that its her cousins record not hers, I suggested getting a statement from the parol officer as well in the PM, that could help too. As long as shes got all this evidence and she turns it in quickly to the embassy they should look at her case again.

If you are denied they usually hand back your passport and give you a sheet stating the reason why you were denied and tell you that they are sending the petition back to USCIS for further review.

Did she get a paper requesting this information? generally if you are missing something they hand them a paper stating what they need to bring back/ send to them, what does the paper exactly request if she did get one.

It sounds kind of weird that her cousins name was put in her name and doesnt make sence.

My husband and I had to take out a loan to pay for our AOS after we got married, and we also had some help from the family to afford half of the k-1 medical cost as well as some of the moving cost.

I would contact USCIS about it and ask where it is, you do need it for AOS, and im not sure about your embassy but when I was at my interview for k-1 they wanted to make a copy of it as well so it was lucky I had brought it with me. Replacement copys cost a lot of money if its been lost.

For the paystub part of your question, we submitted 6 paystubs, most people also submit a letter from their employers. - You want to use as many recent paystubs as you can.

I think you can put " see attached " and attach a sheet listing the question number and the question with the answer of the 2 jobs with all their information. - We had to do this for a few other questions on different forms and it was accepted. Somone else may know different for the I-134 tho.

Question 10 and 11 we filled in exactly as the examples showed.

it is part yes, the beneficiary will have other forms that they have to fill out by themselfs and also have to book and have the medical appointment. most of packet 3 is brought to the interview only some of it is sent in early.

packet 4 is just the interview date.

I assume you are driving back, the only border guard you are going to see is a Canadian border guard and they don't care if you have been in the U.S. for 100 months - they are not concerned with your potential overstay in the U.S.

Now back to your question - you are basically saying - is it ok for me to overstay in the U.S. - no it's not ok, don't do it.


Nope shes flying back, her other post states asking if she should change her tickets. Hence why I said CBP would pull her aside go in her bags and grill her.

Phone bills are great if they show both your number is the UK and his in the US. For letters to be accepted, the letter must be in it's original envelop with the stamp. E-mails and chat logs are good too

This evidence, and things like pitures, are secondary evidence, focus on things like primary evidence - boarding passes, hotel receipts, e-mails to the landlord explaining your situaiton is good if it contains both names, etc.

Just to clarify your terminology, the K1 is the visa, the I-129F is the form your fiance will file to petition for the K-1 visa. There is no K-129F.

You can still go and visit, length and admittance into the US is up to the CBP at the port of entry.
Once you are admitted into the US on the K-1 visa, you MUST marry in the US within 90 days of entering
If you are living with your parents when you file, then list it. NO problems living with your parents

Local police is fine as long as it is a Canada wide name check. The document MUST have CPIC on it or state that it is a search of the National Records Repository on it. Anything else won't be accepted by the embassy

You need to know this won't be approved.

If you are bent on filing, here is what you need to do. You need to prove that her life is in imminent danger. you need to prove how she is unable to fix the situation herself. You need to show why she cannot simply move to a safer area.

A letter from you saying "I've been told by her mother that...." is not sufficient since that is strictly hearsay evidence. You need a doctor's note (likely) showing deterioration of her mental state as a result of her situation at home. You need evidence of this 'abuse' - police reports, pictures taken in a hospital, records of treatment.

USCIS reserves humanitarian expedites from SERIOUS situations. Although I sympathize with your fiance and agree her situation is likely pretty terrible for her, USCIS is heartless and won't care that she is having troubles at home.

I think it is possible to visit, however duration of stay and admittance is up to the CBP. After being granted a K1 she will likely have to show STRONG ties to Korea to prove she intends to return and not simply try to adjust status from a tourist visa, which we all know is visa fraud.

Yes, she is at the mercy of the CBP. If the CBP only allows her to stay for a month, even if she has a return ticket to Canada 6 months down the road, then she will need to plan to return when the CBP tells her to.

A letter from her employer is good, not saying she'll lose her job, but more like when she is expected back. The return ticket is good but it does not guarentee her duration of stay.

You REALLY want to watch your terminology. She is not living with you, she will be visiting for an extended period of time. If the CBP thinks she is living with you, thus circumventing immigration laws, then she will likely be denied. But a letter from you saying she'll be supported until she leaves, perhaps even state when that date is.

Generally, from what I understand, the beneficiary of a B2 visa will have to show not why he/she wants to go to the US, but why they NEED to come back to the home country. The more evidence the beneficiary presents, the better the case.

A lot of times when the answers to the question why do you want to go to the US is "to visit family" the CO assumes that the ties to the family are stronger than the ties to the home country. You need to show that ties to the home country are stronger than ties to family. Don't compare your case with other people's case since each case is adjudicated individually.

I agree with Otto_and_Karin, unless you have additional ties to show, another attempt at a B2 visa will likely be denied. Build a stronger case and then try again

I'd focus on having your fiance build as many ties to his home country as he can. It is about showing the CO why your fiance HAS to return to his country, not reasons for visiting the US

Admittance and duration of stay in the US is up to the CBP at the port of entry. So to answer your question, while it is perfectly legal to visit, you may be turned away if the CBP is having a bad day.

Your daughter is a legal adult right? I don't think she can travel on a K-2 which is for children where the marriage occured while the child was under the age of 18. You can petition for her once you become a resident.

If you get married during the K-1 process, then you forfeit the K-1 and you will have to refile. The I-129F does not carry over. This also means paying the filing fee again

The I-129F does not need to be filed with the I-130. You have the option of doing that if you want to go the K-3 route but if you have been doing your homework, K-3 is virtually obsolete and not worth your effort (unless you'd like to post what country you are from then maybe the answer would be different)
