To be honest if you expect to now change your interview date bcause you booked a vacation, you can expect it to take a lot longer. You should not book anything while doing this process as changing important dates can make you wait even longer for interviews and reviews of your paperwork.

If you are waiting for your interview date, have you gotten packet 3 and done your medical and handed all of packet 3 back? if you have not done this then you have even more problems as all this could go into november.

You can change the name on your passport at anytime you wish to, if you want to wait till it has to be renewed go right ahead, all you have to do is bring your marriage certificate with you everytime you plan on leaving America! Its one extra thing to bring with you and make sure you don't lose but I do understand as passports are expencive if they dont have to be renewed / changed right away. Just make sure to have your marriage certificate and green card with you!

Just an add on,

Yes buy the ticket in the name of your passport, BUT you need to bring your marriage certificate with you when you travel so it proves the name on your greencard if you are leaving america. You will need it to prove the marriage and the greencard to re-enter.

The woman I had at montreal requested a full copy of the DS-160 including the confirmation page, I had a small time trying to find it in all my papers and she said " well you better have it or there will be a problem " I did find it and she said "good thing you did!"

So im guessing you need it but if you already submited it online and it was confirmed I dont know what you would do about that because double filing it might cause a problem too..

Many people file k-1 visa and have FULL weddings. My friend just did that had a FULL church wedding and it was beautiful, she did it on a k-1.

The person talking about expedite for military SO cases is correct only if the person is deploying or deployed to a danger zone will they grant the expedite. BUT because of the military background she already has all the FBI checks and everything as she has to have special clearances, there-for the good news is that it can still be quite quick to process as the checks will not take as long as a regular petition, her information is already logged military grade security, takes about 10 mins to pull up the file lol.

I think you might want to look at another visa maybe or get married and stay in canada? What you are looking to do is very difficult and as others have said will be very difficult to cross the border.

Yes to both questions, it states in I-129F and AOS instructions you need thos things. For AOS how else are you supposed to prove you got married so you can file for AOS if you do not supply a copy of your marriage certificate.

If you are planning to file a K-1 (fiance visa) you will have to marry in the US. You could get married in the US (small ceremony), file the AOS paperwork that then later in the year, have another ceremony in France. If you choose to marry in France, you will have to file a K-3 or CR-1 after you marry. I would recommend looking at the guides to see what is best for the 2 of you.

If you work in various countrys K-1 visa would probably not be the visa for you. the CR1 might be a better option for you.

If she has never had chicken pox before then yes she would need to get the vaccination, I havent heard of anyone getting a waiver for this vaccination and waivers cost around 500$ to file and can still be denyed.

If she has had chicken pox she can ask for a tieter test to check the immunity of varicella aka chicken pox.

AOS fee includes EAD and AP... you could have applied for it. Saddly you are not allowed to travel untill you have the green card or if you have been approved for the green card and recived the stamp in your passport at the interview which acts as a temp untill you get the card in the mail.

I didn't think this was normal. I mean, it does say I can re-apply and send them the package back with the new information. It just doesn't tell me where the signature was missing and I can't spot it for the life of me. I've checked every form as well as all the letters (intent to marry, cover letter, etc.). none missing. Now if it is a case that I accidently sent a photocopy, I would have thought it would make reference to that somewhere. The fact that it says the signature is missing from the 'application/petition' makes me suspect it's the I-129F form and nothing else. I'm just guessing though. They aren't throwing me any specific info.



Its not its weird!! also if it was a case of them thinking it was not an original they usually issue an RFE for that as well requesting the original signed document.

As the other person asked tho also, did they send the entire thing back to you without cashing the payment and everything?

Its not really needed for you to write a letter for her. Its more so important that she has proof of going back to canada like the letter from her employer, rent that will be due etc.

Seeing as the I-129F hasnt been filed just yet it might not be a huge problem for her to cross, but there is still the posibility that they will question her quite a bit depending on what she tells them is the reason for her visit. She needs to be truthfull and not hide anything from CBP - they are trained to see lies.

- Idealy the proof of returning to canada is for when you have filed the I-129F and come to visit after its been filed or while you are waiting for it in its processing times.

You really need to do these things. Sending a letter to USCIS will not help you with whatever the problem is that they are having. I read your other posts and it is in your best intrest to contact your congress and then make yourself an infopass appointment as soon as posible.

yes on the photos name who is in them and put your case number on them in hopes they will connect them with your case, I cannot say they will absolutly meet up with your case or not but having the information on them may help. Also have the information in your letter or they may not have a clue what case you are talking about.

If they send you an RFE for pictures then send the pictures. I don't recomend sending the pictures by themselfs as they will likely not reach your files, things have a way of getting lost when people try to send them without sending it in with the original petition package.

If I was you I would contact your congress man and ask them to do an inquiry on your behalf and see if that gets things moving with your case.

I would send it all again with anything else that you can to prove citizenship ( not sure whatelse you could find as what you gave seems good? silly uscis. ) Its likely they lost it or missplaced it tho too is why they are asking for it again. Send it as soon as you can so that hopefully they resume the case quickly.
