The USC doesn't need to prove support until the interview.
If the USC doesn't make enough money, they need a co-sponsor. It can be a friend, or family I believe. I didn't have to use one, so you'll probably have to do some reading up on it.

As it is though, you can file for the K-1 right now and worry about the support part afterward.

1. It's different per country. Some countries get alot of applications put into Additional Processing. You may want to take a look at the recent Australian timelines, they'll give you an idea.
2. No. Marrying will void the application. You can get a non-legal ceremony done, but you have to be careful with those. If you wish to do that, you'll probably need to do some research.
3. No. Doing so is illegal. You need the proper visa.
4. You can't work until you file for EAD. It's filed along with AOS or afterward. You can probably look for jobs, but you may not accept any of them, since you can not work legally.

If you're concerned about working right away, you should probably get married and file for CR-1. It takes a few extra months but you'll enter the US with a green card and you'll be able to work right away. Not to mention, it takes the guess work out of trying to plan a wedding around a pending K-1 application.

Do some research and see what's best for you two.

Hi Meeah, I looked up non-immigrant visas for you on the Department of state site. Currently, the waiting time for the Montreal consulate to schedule an interview for a student visa (F-1) is about 5 days, the shortest wait in comparison with other non-immigrant visas. However, as Arabella said, for getting a F-1 visa, you need an I-20 from a recognized school in the US, which can take some time.
Also, for scheduling an interview at the Montreal consulate for Work visas, it could take more than 42 days. However, with the current economic crisis, I doubt you will get a job out there.
So again, if you were to ask me, you should try and get the K-1 fiance visa thing rolling, once you guys are engaged. I know Arabella said it takes more than 8 months for the process, but looking at the things at Vermont service center (if you fall under Vermont) and considering the wait times for the Montreal consulate (4-6 months) for scheduling an interview, you can look up to 6-8 months.

Hi Meeah, first of all on behalf of all the members on VJ, let me welcome you ! You have come to the right place for answers. I went through what you wrote and let me start off by saying I am so sorry that your family does not support your decision. I hope in the long run they do !
Anyways, as far as the visa criteria goes, you have quite a few options.
K-1 - This is a fiance visa. In order to be eligible for this visa, you guys need to be engaged and must have met in the last 2 years (which you have). Also, you guys should be free to marry. It will take about 6-8 months for the entire process to be done with. I would recommend you read through the K-1 guides on here. You will have to submit a form, I-129F to the USCIS and then wait for it to be approved (along with the proof of having met in the last 2 years). Once the case is approved by the USCIS, it is forwarded to the NVC and eventually to the consulate listed in your form. Then you have to attend your interview and once you are approved, you have to enter US within 6 months and once you enter the US, you have to get married in 90 days.

CR-1/I-1 - This visa category is for the applicants who are already married. I am sure some of the CR-1/I-1 applicants will help you with this.

K-3 - Another visa category for the applicants who are already married.
I would recommend you to go via the K-1 route but thats just me. Feel free to direct any other questions to me, if you have any!

Well, it has a few stages before that. You send the package off to the USCIS. Once the case is approved, it is sent to the National Visa Center (NVC) for the background checks. After this, the case is forwarded to the consulate listed by you on the I-129F form. Then the consulate, upon receiving your case, will send the beneficiary in Nigeria packet - 3, that is a list of forms you need to send them in order to process your case further. Then you will have your interview.

Hi guys, I hope ya'll are doing okay ! Let me start off by saying the current processing times (according to the VJ guidelines) at CSC is about 88 days for NOA-2 or the second notification. Based on that, you are still under the prescribed time limits and I do see any reason why you should be worried. However, did you receive NOA-1 that is the notice of application -1 ? This confirms that they have received your case and assign you a case #.
You have tons of paperwork to get ready before the interview, but you will not need this until later that is at the consulate/interview stage. Once the consulate receives your approved case from the NVC, they will send out a packet-3 to the beneficiary (I am not sure how it goes for Costa Rica but I think the consulate will send out a packet-3). This packet will have various forms, which need to be filled out and send back to the consulate. Upon receiving these forms, the consulate will assign you an interview date.
Now, this is the time where you need all the paperwork. Police clearance certificates, medical exam results, proof of on going relationship, and the financial affidavit of support (I-134 form) are some of the things you need at the interview stage. However, if I were you, I would wait till I get my NOA-2 as the police clearance and the medical exams are valid for only a year from the date of issue.

Correct, your child needs only to be listed on the I-129f. You won't need passport photo's for the child until it gets to the consulate.

You will need a co-sponsor. You will include them on the I-134 and include their taxes.

  • Current bills, credit card statements etc.
  • Letter from employer, stating that I will return on x-date for work.
  • Notarized letter from lawyer of my lease agreement.


And this was ALL because I said I had a boyfriend in the USA. Good luck and I always think more information as to proof of ties to my country, the better chances you have of not being denied entry.

Hi all,

After much research for the past 3 month this is what I have come up with and please correct me if I am mistake.

My fiance (USC) does not make enough to sponsor me for I-134 for K-1 petition alon. He DOES although make enough annual income when he add child support that he receives for one child. That income is just enough to meet both the 100% for K-1 and 125% for I-485to meet poverty guidelines.

He also pays child support for 2 other children but from my understanding after months of researching, he does not have to deduct the child support that he pays out from his annual income, therefore making enough to meet the income requirements since he also receives child support for 1 child and adds it to his annual income.

The total support would be for 5 people including the petitioner and beneficiary and the 3 children

I want to be on the safe side and make sure that this is correct so that we won't need a joint or co-sponsor.

Any input would be appreciated.

Wow, the responses I have received from posting has left me a bit shocked. I really respect and value each of your opinions and advice. This is my first experience at this, and it has been extremely hard.

My boyfriend and I have definitely talked about marriage, the fiance visa, and basically whatever it takes to be together. We have recently decided that I will just come for the three months, since I do not need a visa to do so, and we will try it out together; living together, learning more about each other. I will stay here in Canada for a couple more months in order to get some things situated, finances and whatnot, and then hopefully purchase a ticket early next year and head down.

On another note, I have never felt so alone in my entire life. As I mentioned before, my family doesn't support me at all. My mother has gone as far as saying I'm not welcome back home, she has taken me out of her will, and even has done a criminal record check on him (or so she says.) This is simply unbelievable. I have never seen my mother act the way she has, and it has taken me back a little bit. My friends have told me to give it time, that she will eventually realize how happy he makes me and she'll get over it. I've listened to her worries, and have had civil conversations with her stating my plans, but she is constantly trying to search for something to end all of this. I have not mentioned before, but I am a law enforcement applicant here in Canada, and I am moving along slowly but steadily in the process. I have been in the process for a couple years, and it has been a dream of mine for as long as I can remember. My mother believes I am throwing my life away. This is coming from a mother who was single, independent, educated, and learned to do everything on her own without a man in her life. She has always raised me to be independent, and strong and to never depend on a man, and I this entire process upsets her that I could have possibly found my soulmate and would be throwing away my career goals.(To her, that would sound ridiculous.)

I have tried explaining to my mother that I am only going down to try it out for three months. No fiance visa, no marriage (although I can't promise what will happen in those three months if things go amazingly well), but in the meantime, I want to re-assure her that I am going on a trial basis. My mother has been very hateful towards my boyfriend, and it's been tearing my family and I apart. I am drained mentally, emotionally, physically... and at this point, I am sure she would stop at nothing to cloud my judgement and change my decisions about going down.

Bottom line, I need to follow my heart. Whether or not I make a mistake, at least I would have taken the risk and learned from it. Isn't that what life is all about? Expereince... living and learning. I have never felt this way in my entire life, and for once I am gonig with it.

Also, to answer a question about my boyfriend coming to visit. He has EVERY intention to come visit but with all the chaos that has been happening with my family and I, he is now a bit scared to come up here. His plan was to come this month and visit, but then things went crazy and I am not entirely sure how my mom would react. We've discussed it, and we both agree that it's a good idea.. and yes, he DOES want to come visit my family, see how great of a person he is, the man that I am in love with.. but things are a bit tough right now and I guess we'll just have to give it some time.

You being canadian (as i got a friend that is married with an american and she's from Toronto) got more time to stay in the states (6 months) than someone from Europe. I don't know if you got the budget to do that and how is your work/study situation but why don't you try to stay that months living together? or if u wanna study something apply first for an students visa? or if your work got another office or related in USA transfer you there?

If not yeh, we thought as well the fiance visa is one of the best. Just take the time and let your family take the time but if you're 150% sure then quit the torcher and go ahead with it! after all is up to you guys and over all it has to be for the LOVE.

Thank you so much for the response. I continue to tell myself to give it time, and hopefully they will respect my decisions in time but if not, I am fully prepared for that as well. They are not feeling what I am feeling, so they have no idea except for my boyfriend and I how we feel about one another.

What about work visas which will allow me to get to the US a bit quicker? I am fully prepared to wait a few months in order to be with my boyfriend, but 6-8 months seems like a really long time, and I honestly don't think I would be fully prepared to wait that amount of time for all this to fall through... meaning, I don't want to be around my family and back in my home town with all this negativity. I just simply want to be with him.. and I know it's easier said than done.

What about a visitor visa? Mind you, I wouldn't be able to work while I was on that visa.. but I am just trying to find the easiest and quickest route for all of this to happen... as I'm sure most people have thought that at one time or another.

Hello everybody.. I just wanted to introduce myself and share a little bit of my story.

I am a Canadian citizen and met my boyfriend online. We recently met after talking for three months everyday, and when I say recent, I mean I just returned home last night.. lol.

My boyfriend is a United States citizen and currentlly resides in the state of Alabama. When we met online there was definitely an instant connection there. After the months went by, we decided to meet in person and give it a shot. Well, it was love at first site and we have had some very serious discussions about what our future plans are. I met his entire famly, his friends, and everybody wants me to be a part of the family. I thought things were going so perfect, until my side of the family had their input. Basically, my family doesn't support my decision, they are judgemental and think I am throwing my life away on "some guy I met on the Internet." I am very determined to follow my heart because it feels right, but I also want the love and support from my family. Nevertheless, him and I have decided we are going to do what it takes to be together.

Now onto the next steps.. which is where I am lost. I know I have to apply for a visa. As far as choosing the visa I need, I have no idea where to begin. I am pretty sure I need proof that I have a job to go to, but I thought that there is a way I would be able to move down and look for employment when I arrived?

My boyfriend and I have also talked about the Fiance visa.. and, if the work visa doesn't fall through we are both fully prepared to apply for the Fiance visa in order for me to move down there.

Bottom line, I'm lost, I'm confused.. this is a first for me and when I stumbled across this site I felt relieved. I am sure there are some of you out there who have gone through or are going through a similar situation. Any information that any of you would like to share would be great, and also any advice about the visas and steps I need to take in order for me to get down to the United States would be greatly appreciated as well.

Forgive me, as I have posted before and all of a sudden I cannot figure out how to post a new topic! I am not sure if it's because my mind is in a million different directions, or if I'm tired, but I will ask my question here. I am pretty positive this question has been asked before but I did a search and it showed no results.

I have posted before about meeting my love, and my family not being supportive. Well, my current status right now is that my family and I have no contact, I am visiting my boyfriend in February and we're applying for the K-1 Visa!

My question is this: After the K-1 visa is approved, what is the amount of time you can wait before entering the US on the K-1 Visa. Is it 6 months and then it expires, or?

I've been slowly reading through the posts, and there is A LOT of information to go over. I am full of all sorts of emotions, as I am sure all of you can relate! I am so thankful I stumbled across this website, and I hope to continue getting advice, feedback and support from all you wonderful people who have been, and are in the same position as I.

Well, I think I have found the answer on my own. According to Passport Canada I can just cross out my old address and write my new address in the passport. So, I assume that when we file the K-1 documents there shouldn't be any discrepancies with my new address.

Any other advice would be great, and if not, this thread can be closed and deleted!

K-1 Fiance(e) Visa Process & ProceduresChange of Address
Hi there,

My partner and I are preparing to file for the K-1 Visa in the next month or so. I recently moved, and my passport and drivers license has listed my old address. I am going to change the address on my drivers license this week, but as far as my passport indicating an old address, when we file for the K-1 Visa should I just put my new address on all the forms? I am worried that it may present a problem that I have a different address on my passport.

PS. This site has been extremely helpful. There are a lot of emotions and thoughts that go along with this entire process, and I'm at the very beginning stage.. I know it's going to be extensive and I'm glad that there is a support network such as VJ to help others like myself get through the process.

Actually, going over the VJ checklist it looks like the only thing I would really need to get done here is a passport photo and possibly get copies of pictures of the both of us here, and then the rest of the checklist can be completed when I am in the US. I thought there was a copy of my birth certificate and passport needed as well. Can somebody point out to me if I am missing something? Thanks!

Oh, that's great. Well, I am going to start gathering documentation and get all my papers in order. I do have a round trip ticket for the visit, but should I bring more evidence to prove I will be returning after the trip is over?

I am visiting my partner in February and that is when we will be getting ready to file the K-1 Visa. I've been looking over the K-1 Checklist and I was wondering if it would be okay to gather my side of the documents, (ie: passport photo, photocopy of birth certificate, etc.) prior to me going down to visit him or if this would present a problem at the border?

I am pretty sure I need proof that I have a job to go to, but I thought that there is a way I would be able to move down and look for employment when I arrived?

My boyfriend and I have also talked about the Fiance visa.. and, if the work visa doesn't fall through we are both fully prepared to apply for the Fiance visa in order for me to move down there.

Bottom line, I'm lost, I'm confused.. this is a first for me and when I stumbled across this site I felt relieved. I am sure there are some of you out there who have gone through or are going through a similar situation. Any information that any of you would like to share would be great, and also any advice about the visas and steps I need to take in order for me to get down to the United States would be greatly appreciated as well.

Wow your story sounds a lot like ours! My mom said to me, "I don't cae how much you think you are in love with him, you must break up with him- he is not God's choice for you." This was because his myspace said he is "agnostic" and because he is 9 years younger than me.

Fast forward 2 years later. My parents ADORE Sean and can not wait for us to be married!

It will work out once your family sees how happy he makes you and vise versa.

Sean's mom was against him moving here to the US. When I was in Canada last weekend, she finally said she "has made her peace" with him moving because she sees how happy I make him!

Your family just wants you to be happy.

So take your time, visit frequently, and only tell them the good stuff (sometimes we tend to complain about our men and that's all they remember . . .).

Oh and the work Visa thing is a stretch, so the Fiance Visa is your best bet.

Oh my gosh!! This is very familiar to my tale as well smile.gif...I am a Canadian woman that met my love online almost 8 months ago now. He has been here with me for 4 months and we are busy making all manner of plans (including wedding!). My friends and family are supportive as are his so we are lucky there. We had a lot of trials and tribulations even getting him over the border to get him here (for no apparent reason...former marine, no criminal record etc) but once he got here...YAY! Everything was better than we thought it would be. And still is. So yes we have also been researching what is the best and easiest way to go about getting me into the States.
I understand what you are saying about the time line and I think some people are not realizing what you are getting at. One person said something like maybe you need to evaluate the seriousness of the relationship if you are not willing to wait 6-8 months or something like that. But I know what you mean. The idea of that long not being able to see him after living with him for 4 months seems UNBEARABLE. But in the end if I must do it...I WILL. But I will not be happy about it. But if it is the only way for us to be together for the long term....hell yeah I would do it. Rock on girl and you hang in there!! MSG me anytime you like and we will commiserate as we are in the same-ish boat! smile.gif

it depends on where the person is getting the medical done / what country.

Generally they look for TB, HIV, Syphilis, drug abuse, alcohol abuse. They check your eyes and make sure all your shots are up to date.

When you get the k-1 its 6 months you have to use it before it expires. Once you use it you then have 90 days to get married. So if you do get it early you can wait to use the visa but you need to use it before the 6 months end or wont be able to use it anymore.

if the person already sponsors 3 people the person has to make $22,887
for two more people 3+2 = 5 the person has to make $32,237

If the sponsor is a lawful permanent resident, they may petition for the following foreign national relatives to immigrate to the U.S.:
•Husband or wife, or
•Unmarried son or daughter of any age.

If the sponsor is a U.S. Citizen, they may petition for the following foreign national relatives to immigrate to the U.S:
•Husband or wife
•Unmarried child under 21 years of age
•Unmarried son or daughter over 21
•Married son or daughter of any age
•Brother or sister, if the sponsor is at least 21 years old, or
•Parent, if the sponsor is at least 21 years old.
