K-1 Fiance(e) Visa Process & ProceduresJAMAICA K 1 QUESTION
I don't think it's an issue. If it would make you feel better, you can get a letter from the father and mother outlining the situation (ie - why the mother didn't list the father on the birth certificate and when the father learned of the child etc).

However, I don't think you'll need it but if it makes you more confident at the interview then it can help!

Good luck.

K-1 Fiance(e) Visa Process & ProceduresJAMAICA K 1 QUESTION
While I cannot attest to what you read, if you do some reading on this site, you'll see that many people do have have father's listed on the birth certifacate and have no issues with approval. How did you list the father on documents? Did you leave it blank or did you list it as 'unknown'?

This is the 21st century, father's are not listed on birth certificates, it's a fact of life these days. USCIS, NVC, and the consulates know this. Besides, if it was truly an issue you'd know before you got your NOA-2 from USCIS.

Good luck.

K-1 Fiance(e) Visa Process & ProceduresTranlate Chat Logs for I29
Things you send to USCIS should be translated, otherwise how do you expect them to read them? All official documents must be translated as well.

You could send a few of them with the I-129F but this is secondary evidence. You'll want to focus on primary evidence like bording passes, passport stampts, etc.

Good luck

K-1 Fiance(e) Visa Process & Procedurespre existing medical condition for k1 visa
That really depends on the medical condition. I had a pre-existing medical condition which I brought documentation to my medical explaining the nature and treatment history of it. I have a skin disorder and since the medical treatment is relatively minor for it, adding to a health insurance in the US was easy since future treatment for it will not be very much

Again, it all depends on the condition

Good luck.

K-1 Fiance(e) Visa Process & ProceduresG-325a form a couple of questions
The last thing you want to do is give the impression you were living in the US, especially if you got 'told off' by immigration for doing such. Since you entered on a tourist visa you were not actually 'living' in the US, you were visiting.

However, you mentioned a student visa, did you actually enter the US on a student visa? If you did then you could list the dates you were in the US on a student visa as living there.

Good luck

K-1 Fiance(e) Visa Process & ProceduresInformation needed for K-1 Visa
You can certainly ask for an expedite. However, I suggest that when you do ask you include the following:

What evidence do you have that her life is in immediate danger. As in how do you know that they will kill her?
Why can't she move to another location that is safer? Why must she remain in such a dangerous city?

Many cities in this world have high crime rates, however this does not qualify for an expedite.

In this situation I doubt that you will get an expedite.

Good luck

K-1 Fiance(e) Visa Process & Proceduresmake a mistake in 129f?
You're fine. We listed Toronto as the consulate we'd like to interview at and NVC automatically adjusted it for us to interview in Montreal. Nothing can be done now at the USCIS level. Is Rio the only consulate that does K interviews? If you continue to be concerned, call NVC when your case gets there and ensure the correction is made.

Good luck.

K-1 Fiance(e) Visa Process & ProceduresTraveling while waiting for visa
I lived with my dad, I was in between jobs, basically no ties and I took the generous entrance that Canadians are given for granted.

I think you'll be ok with the ties you have

K-1 Fiance(e) Visa Process & ProceduresTraveling while waiting for visa
I was denied entry twice, it had nothing to do with telling the truth. I lacked sufficient ties to Canada when I tried to cross. When I gained the ties they wanted, they admitted me

You'll be fine. Always tell the truth yes, but be prepared with ties just in case

Good luck

Both of those are excellent, have your landlord's letter outline how long you've lived there, the rent you pay, and when you're epected back - another option would be a doctor's apt card (if you have one), or a job letter indicating your date of return.

Good luck.

You will have to disclose the denial and likely be asked about it at the interview. Tell the truth and it will have no effect on the K-1 visa

K-1 Fiance(e) Visa Process & ProceduresHonest opinions please :)
You name does not change automatically when you marry, you must take the steps necessary to change all your identification to your married name.

Your passport is not invalidated when you marry, your name is not officially changed. You can do that at any time back in the UK. You'd want to do that before the interview as they issue the visa in the name in the passport and the green card with the name on the visa.

Good luck.

K-1 Fiance(e) Visa Process & ProceduresHonest opinions please :)
Yes - the CR-1 is for married couples. You can marry him at any time, as long as you abide by the terms of your visa and return home. After you have your marriage certificate, you can apply (you NEED the marriage cert to apply).

The wait time varies but yes, 6 - 10 months seems to be the average.

Once you are issued the cr-1 visa and enter the US, the green card will be mailed to you. Remember, there are no US consulates inside the US.

The I-129F is the petition you fill out for the K-3 visa. The K-3 visa was faster about 3 years ago but is an obselete visa. Stick to the Cr-1

Since I'm not from a VWP country I am not too sure about I-94s

Good luck.

K-1 Fiance(e) Visa Process & ProceduresHonest opinions please :)
Certainly not silly questions.

You first must get engaged. Once he files then yes, hopefully in 1 year you will be granted the K-1 visa. When your visa is issued, you have 6 months to enter the US. Once you enter the US, you then have 90 days to get married and apply for your adjustment of status from a non-immigrant to a green card holder. When you apply for your adjustment of status, you also apply for your employment and travel authorization (this takes up to 90 days - not 6 months). You can leave at any time to return to the UK. You, however, cannot re-enter the US unless you have been granted your travel authorization. So your plan of leaving the US to work in the UK won't work because you won't be granted your travel authorization (they will generally be approved at the same time)

If you file for the K-1 and then get married before the process is finished, you will have lost your K-1 application, and fee, and you'll have to apply as a spouse

Good luck, welcome to VJ!

K-1 Fiance(e) Visa Process & ProceduresVisiting the US while K1 is processing
We cannot tell you the likelihood of you being granted entry as that is totally up to the border patrol. The stronger ties to Canada the better your chances are.

However the K-1 visa may (or may not) work against you as it is clear that you have intentions of eventually living in the US as an immigrant. The CBP are trained to suspect that all tourists have immigrant intent until they are proven otherwise.

Good luck

K-1 Fiance(e) Visa Process & ProceduresI'm A Newbie: Need K1 Form Help Please
You enter 'none' if you do not have what they are asking for. Such as your middle name, if you don't have one then put 'none'

N/A is put if the question does not apply to you.

If you get an RFE it will delay your case, it won't cost you anything to fix it save the cost of shipping the documents to them

Good luck.

The touch that early usually means they could have moved it to the appropriate area or they took your check out of your package to cash.
That's what I take it as, anyway.

K-1 Fiance(e) Visa Process & Procedureswhat vaccinations
Just the ones in his age group.
He doesn't need to get the ones in the other age group, I think some of them were introduced when we were older so they're not applicable to us.
Like, I dont have Hep B or the other ones in the age group younger than 19 or 18 or whatever it is.
Just worry about the ones in his age group bracket on the website and you'll be fine.

Maybe try PMing that user to see what he/she did?

If it's so illegal to get married in the US to someone under 18, why do they allow under age marriage with parental consent? It's perfectly legal to marry someone under 18 in the US, the requirements vary by state.

Regarding my age... I'm 21.

I'm aware of the stereotypes of what I'm trying to do and taking that into consideration... I'd appreciate legitimate responses, but kindly save the obnoxious jabs. I'm asking for guidance, not ridicule.

Hey, for your FYI what you are doing is ILLEGAL. you are an adult and she is an underage GIRL!! can't you figure that out? I got a great idea why dont you date someone of LEGAL age? or wait till she is of legal age? But maybe those are hard concepts for you. I don't know. Smells like a Troll

You know, there's "legal age of marriage WITH parental consent".
The fiancee's parents consented.
So I don't see the problem here.
If it's sex related, you may as well go have a ton of people arrested. I'm sure a fair share of people had sex before they were "adults" by legality.

Well, since you stated that she's of legal age to marry with parental consent, you're probably going to have to get statements from her parents saying that they're okay with her marrying you. I'm not sure if you should get them notorized or not, I dont think it'd hurt.
If she's two months away from turning 16, I'd wait till she's 16 to file. It might make it less complicated.

All #######'s aside, maybe you should wait till she's like 17 or 18.
She's hardly even a teenager. Teens usually dont know what they want at that age, and they're still going through growing up, especially mentally.

Good luck, otherwise.

It actually is the country a bit.
I mean, if you look at the middle eastern countries, there seems to be an awful lot of common first and last names, and it takes a while to fish around them.
I mean, why else would most people from the middle east go through extra processing?

But like we mentioned, it's mostly name checks and how the embassy processes things is what holds people up.
RhiannercakesFemaleCanada2009-12-03 01:11:00
K-1 Fiance(e) Visa Process & ProceduresTime
Depends on the country, mostly.
Some countries have to go through extra background checking due to names being so common.
Some countries (like Canada) are missing employees at the consulate, so they're backlogged.

Most common hold up seems to be name background checking though.

K-1 Fiance(e) Visa Process & ProceduresVisiting U.S. while K-1 is pending
Yes.
But she must bring ties to prove she's coming back to Canada.
The NOA1 for the K-1 visa in my opinion is good to prove she's not going to marry and stay down there, since it'd totally void the visa. Of course, I wouldn't rely on just that.
Other good things to have is a return ticket, letter from employer saying that she's expected back and by a certain date, a copy of a lease if she's in an apartment, etc.
