Yes travel days do count. Repeating what people have already stated, if this becomes an issue, it will be at the interview stage and you will be asked about it. A 1 day overstay will not trigger a ban or need a waiver. However, any overstay is not permitted.

I wouldn't count on visiting the US until you get your immigrant visa

I would advise against this. Married people change their names, not engaged people. You want to avoid the possibility of the CO making the false assumption that you are married and therefore inelligible for the K-1 visa. I think if you wait to change your name until after you are married, it will make this process easier on you.

As a former F-1 in the US, you do not need an interview at a US consulate in Canada. You do, however, need to apply to and be accepted to an accredited US educational institution. The school typically will require that you show you have substantial funds to support yourself while there, this ranges from school to school but is typically around $20,000. This does not mean you have access to it, it means you actually have a bank account showing you have it.

Work visas are hard. You need a US company to sponsor you detailing why they cannot hire a USC for the same job. You cannot apply for a work visa and then just go down there and look for work. The company must have already offered you a position.

Your fiance can visit during the process on the VWP. Admittance and duration of stay is not guarenteed. He'll need to bring STRONG ties to Ireland, such as a letter from work indicating the expected return date, a lease/mortgage, utility bills, etc. Further, I suggest flying through somewhere where he will go through customs in Europe. In case he is denied entry, the cost of the return ticket will be cheaper

I don't doubt that you absolutly love this girl and want to bring her to the US. I am concerned about her. I am concerned that, although she may say she is, she is not emotionally ready to be a wife. It is a huge committment and one that she may not be prepared for once she arrives in the US. Plus, she's a high school student, let her be a high school student and enjoy all those wonderful parties, football games, homecoming, prom, etc.

If you honestly want to marry this girl and aren't going through the 'oh my gosh, I love her and HAVE to be with her' impulsivity then please follow your heart - but be prepared for a trying journey and marriage

Yes, she will interview and have her medical in Toronto.

You could have all the forms ready to go, filled out and signed, as well as the supporting documentation so incase she is in India when time comes to submit the forms, you could simply mail them in for her.

IF, and that is a big if, the interview is scheduled before she returns to Canada then you would need to contact the consulate in Montreal and request another interview date. The medical she schedules once the interview has been assigned so you won't need to reshedule that, just schedule it when she is in Toronto.

Read the guids, particularly LingChe's short cuts to complete all the necessary forms before she goes to India. She doesn't have to date them, you could do that at the time of submission

1) It shouldn't. As long as she is a legal resident then she can interview in Montreal (this is where the interview will take place since she lives in Toronto). When your case gets to NVC you'll want to send in both passports so they are aware of the citizenship situation.

2) She will need to do her medical and interview in Canada but hopefully she'll be back in Canada by then. Plan on 8 - 10 months from start to finish. The Montreal embassy is terribly slow

3) No, you cannot live together in the US. She may visit but admittance and duration of stay is up to the border agent upon entry. She'll want to bring strong ties to Canada, such as a lease, mortgage, employment letter, to show that she intends to return to Canada.

Note - if you get married in Ontario, you'll have to wait 6 - 8 weeks before you can apply so you have the marriage certificate (yes, it takes that long to get).

I'd say your best bet is to file the K-1 since you can file that now (not wait for the marriage cert. etc) and it is generally faster, but more expensive, than the spousal visa.

However, if you want to apply for a spousal visa, apply for the CR-1, not the K-3. The K-3's usefullness has diminished substantially over the years. It's slow, expensive, and no benefit to you since you'll interview in Montreal

Gary_and_Alla makes an excellent point, applying for a work permit may give the false impression that you are more interested in going to the US for work and not for love. London is a low fraud country so it is unlikely that this will happen but it is something to think about

I should have been more clear - you won't be issued a work permit and a K-1 at the same time, however you will have one cancelled when the other is issued. If you are granted a work visa, then when the K-1 is issued, the work visa becomes invalidated (I know from personal experience on this one) which will be another issue once you cross over on a K-1 visa and no longer are authorized to work.

You can only really be issued one visa at a time, once K-1 has been issued and you enter the US, there is no 'work permit' to get other than your EAD. So you can either be given a K-1 fiance visa OR a work visa - both will not be issued to you.

In order to apply for the H1B (dual intent) you'll apply by April 2010 for work starting in October 2010. Most other types of work permits are considered 'non-immigrant' so that would mean you have to prove that you do not intend to live permenantly in the US. This would be next to impossible since you filed for a K-1 and thus, have intentions to live in the US permenantly.

Your 'work permit' will be the EAD you get when you apply for adjustment of status.

1. Since you list that you live in Toronto, you'll interview in Montreal. Look at 8 - 12 months because of the backlog in Montreal for interviews. This can be filed immediatly once citizenship is acquired

2. Expensive and does not do you any benefit in saving time. Time is still 8 - 12 months after marriage

3. CR-1: Best in my opinion because it allows for immediate work and travel. Time is slightly longer, about 9 - 12 months after marriage.

Note - since you are marrying in Canada, you will need to wait 6- 8 weeks before filing after marriage so you can send in the marriage cert. The solemnization of marriage is not sufficient, you'll need the registry of marriage or the marriage cert. to file. Since this is the case, the K-1 may be faster for your situation.

4. You cannot DCF unless the USC is a legal resident of Canada. Since she doesn't reside in Canada, you cannot DCF

5. I do not want to get into this debate but from what you say, it sounds like this is your riskiest move

Because Canadians are offered very generous visitations to the US, do not let this cloud your preceptions of the immigrant visa process. Where is your fiance from? She will either interview in Montreal or Vancouver.

The K-3 is pretty much obselete for most cases, however it can be beneficial for those from Canada depending on your situation (where you'll interview, if your fiance wants to continue to work in Canada for a time after the visa). But more information on your situation will be necessary.

The K-1 fiance visa is for anyone engaged. Cr-1 is for married couples and is a superior visa to the K-3 generally as it allows for work and travel immediatly upon entrance and is a faster, cheaper route to a green card.

Start with that link I sent you and figure out what visa is best for you.

Just so we don't confuse terms, Canadians dont' travel on the Visa Waiver and the duration of stay is up to the Border Patrol at the time of entrance. And no, you cannot move and work right after marriage. If you wish to move with your husband after marriage, then you'll need to apply for the appropriate visa. You can go fo the K-1 visa, which is for someone who is engaged, or you can go for the Cr-1 (better than the K-3)

Going to the US with the intentions of marrying and staying, while traveling as a tourist, is illegal and can result in a lifetime ban from the US.

I was denied entry twice, it is difficult to get back in once you are denied. If you are denied for failing to produce strong ties, then going right back the next day will simply yeild another denial. You'll be given a piece of paper which outlines what they consider strong ties, and unless you have what's on that paper, you'll be denied again.

I think you'll be fine, but bring ties just in case they ask!

I have psoriasis and it has made 3 of my 10 fingerprints permenantly damaged. It was not an issue for me at any point throughout the medical exam. It is not a contagious condition and you'll be fine. If it will make you feel better, you can bring a copy of a diagnosis from a doctor to your medical exam. I did not do this, largely due to the fact my disorder is plainly visable, and they asked me about it and moved on.

You applied 2 months ago, you are within normal processing times. That is what you will hear. I'm sorry but the waiting is the toughest part. InfoPass, in my opinion, is not for people just looking for a status update. Besides, since you never made an initial inquiry, you won't have the service ID number which you are requested to bring to the apt.

We waited 178 days between NOA-1 and NOA-2 so I know how difficult it is to wait. But unless you fall outside their processing goals, very little can be done for you and, in my opinion, is not worth an InfoPass apt.

It's not a stupid question, it's a very common question.

Your petition is bar coded and every time someone touches your petition, the bar code is swiped. This updates the date on the USCIS website which, hopefully, you've registered for so you can see if that date has changed.

"Touching" a petition can mean it was counted, moved, filed, read, etc. It can mean approval is near or it can mean that it was moved from filing cabinet A to filing cabinet B due to a leaky pipe in the room it was stored in.

If you have not registered on the USCIS website to receive updates on your case, do that soon.

Yes, the Cr1 will interview in Montreal, however your adjustment of status will cose $1000+. Although Montreal is far, it may be cheaper, even with travel costs, to go for the Cr1.

When you enter the US, on K visa or Cr1, you won't need to leave Canada to adjust status. However, you cannot leave Canada when entering on a K-1 without travel authorization and you cannot work without work authorization.
