I am not a lawyer, I never claimed to be one so saying that you're 'screwed' based on my post isn't right since my post was a matter of opinion.

I simply stated that some convictions are treated differently for immigration purposes. Trailmix is right, they are probably trying to determine if you are elibile for a waiver (or even if a waiver is necessary)

Different countries view crimes differently - while Canada may have granted you a pardon, the US immigration would like more information on it.

Well, many times it depends on what the crime you were charged with actually was. Because if it was considered a Crime Involving Moral Turpitude then this is generally considered a more serious crime (regardless if it was a Summary or Felony, if there was jail time or a fine) for the purposes of being granted a visa. It also depends if it was a domestic volence charge, a drug charge, a gun violation or gang activity as these are all treated differently than other crimes.

Yes, for immigration purposes pardon's don't mean anything. Often a criminal charge is different than a charge for immigration purposes.

What happened at the end of the interview? Were you given an opportunity to submit more information? Did you submit it?

I used it myself during this process and it really helped me be ready for the next steps in the process. It even has examples of how to fill out the forms, very useful when I got stuck trying to figure out how to fill something out.

And yes, he's free to come to the United States while the process is going on. He just has to make sure he's bringing ties that show he's going back to Canada, but since he comes and goes alot, sounds like he would know about that already. We usually suggest a letter from the employer and a lease contract copy for it.

The only time he's required to be present in Canada during the process is for the medical and interview, which is the last steps of the visa.

Okay. So I should already have all these - for MMR, is there any difference between getting the vaccinations as a baby, like I did and getting them as an adult? I just don't want to have to get a second one if the one I got when I was young will suffice.


The thing about the MMR shot is that generally you only have one shot, but they found out that not all children develop an immunity to MMR with the first shot, thus we get a "booster" shot to help the kids who werent immune the first time.

If you don't want to get a shot without knowing if you need it or not, go get a titer test for MMR. It'll test if you're immune. If you are, bring that with you, if you're not, you need the 2nd shot.

Sounds like you should make an infopass appointment so they can get a hold of your package. Wait for your RFE paper and bring it with you, it might save you some money if it's medical related.
Also bring the NOA1's for your AOS so they can link your package with your file, wherever it is at the moment.

I think in alot of cases, they don't care how you met. Now, I'm sure cases like "The beneficiary already has alot of family in the US and was set up with someone from the US by the family within the us" is a tad bit fishy.

Besides, meeting on the internet is becoming extremely common these days. Besides, one of the requirements of the visa is that we meet in person within 2 years. So what does it matter if we met online or face to face?
I really do doubt they discriminate between face to face and online first meeting.

Age wise, alot of countries have no problem with age differences. Due to cultures in other countries though, the women being much older than the man is looked at very carefully. (Or so I've noticed looking around these boards anyway.)

That would be an Request for Evidence. They need what they listed on the page to go on with your case.

Do you not have plane ticket stubs of visiting your fiance?
If you do, photocopy them and send it, photographs are not the best evidence to use.

They may have lost the letter of intent, do another one for each of you and sign and date them. There's an example of one in the downloads section up top.

And of course, send the required passport sized photographs. Send them as quickly as possible, because the notice said you have little time to do so.

Well, if it was purchased at a financial instution, your fiance should be able to contact them (the FI) and get them to track it and if it's not cashed, all he'll have to do is sign an affidavit and they will issue a new one.

In regards to your visa, hopefully someone with more knowledge will come along to help you with some advice, I just wanted to pass along what I knew about the money order.

Is that what you're referring to? If so, that's for non-immigrant visas (I think) - the consulate in Vancouver DOES conduct the nonimmigrant interviews there, but I'm almost positive that all CR1/IR1 visa interviews are conducted in Montreal.

Perhaps someone can chime in on this, I totally could be wrong.

Just like you, I have been following these posts since quite sometime now. As per my best knowledge, the medical exams include the following :

1)
Physical examination: Applicants are required to have a physical examination (to include complete disrobing), and a mental status evaluation

Tuberculin (TB) skin test: All applicants two years of age and older are required to have a Tuberculin skin test (TST)

Serologic (blood) test: All applicants 15 years of age and older are required to have serologic (blood) tests for HIV and for syphilis. Applicants under age 15 can be tested for HIV or syphilis if there is reason to suspect the possibility of infection. Civil Surgeons and Panel Physicians are required to provide pre-test counseling to all applicants who take the HIV test. If you are found to have HIV infection, the Civil Surgeon must provide you with post-test counseling

Vaccinations: Most applicants need to show that they are current with all vaccinations recommended by the U.S. public health officials.

2) The wait for the K-1 process can be anywhere from 3-8 months. However, thanks to Gary and alla's interview post, we know that VSC has adjudicators working especially on I-129F's just to get "caught up". And with the recent approvals, July and August, you never know !

K-1 visa specifically pertains to get your foreign fiance to the US. Once you enter on a K-1, you have 90 days to get married and the file for adjustment of status.
However, in your case, you are already in the US on a student visa. So, it is better for you to just get married and then file for adjustment of status from your student to a resident.
