K-1 Fiance(e) Visa Process & ProceduresWe need your advice!!!
Honestly, don't book any flights until the visa is in your hand. SO much can happen between the interview and the visa being issued. One girl interivewed in Montreal and she had to go back to have her fingerprints re-done due to a computer glitch. Her visa was issued 4 weeks after her interivew

Good luck.

K-1 Fiance(e) Visa Process & ProceduresDoes this seem ok to you?
Just to add, you also want to make sure the paper work gets filed before the 90 days is up so you don't go out of status. Perhaps you should get all the paper work finished before you marry so all you need to do is mail it off once you get married

Good luck.

K-1 Fiance(e) Visa Process & ProceduresWhat if you don't get married?
As long as you aren't married and you meet the "met within 2 years" requirement, sure you can go for the K-1 again. Or you can get married and file the I-130

Good luck.

K-1 Fiance(e) Visa Process & ProceduresCorrect a mistake during the interview?
I don't think so, being born in a city doesn't mean you lived there. I was born in City A but lived my whole life in small town B. I listed that on the paperwork (the small town B - no mention of City A except on my birth certificate) and there were no issues.

Good luck.

K-1 Fiance(e) Visa Process & ProceduresB2 waiver denial
I agree with sachinky. B-2 visas are difficult to get for some people. However, leaving the boy at home is certainly going to help them. Make sure they include a letter from the grandmother indicating that she is taking care of the boy and the expected return date of the parents.

Good luck.

K-1 Fiance(e) Visa Process & ProceduresB2 waiver denial
I am so sorry, that really stinks! I agree with the above poster, call the consulate and find out what happened.

I read an article once that a family was denied a B2 visa to attend the daughter's wedding. What they did was set up laptops at the wedding (and at the house of the denied famiy) to witness the ceremony. It was a pretty unique idea

Good luck.

K-1 Fiance(e) Visa Process & ProceduresWrong name on my visa
You certainly should contact the consulate. The visa should match the name in the passport, if it does not, there could be issues with adjusting status

Get this fixed ASAP

K-1 Fiance(e) Visa Process & ProceduresApplying for a K-1 Visa from WITHIN the US (student status)?
F-1 visas issued in Canada do not carry a home residency requirement, no worries there

K-1 Fiance(e) Visa Process & ProceduresApplying for a K-1 Visa from WITHIN the US (student status)?
visas are used to enter the United States, since you are already in the United States, the K-1 is not for you. You should marry and adjust your status from student to permenant resident.

K-1 Fiance(e) Visa Process & ProceduresVisiting USA from Canada during process
Yes, however admittance and duration of stay is up to the CBP at the time of crossing, to make it easier, make sure your fiancee bring ties to Canada and a copy of the I-129F packet just in case

Good luck

K-1 Fiance(e) Visa Process & ProceduresIf I Apply for a K1, will that cancel my Tourist Visa?
Touched means exactly that, your file was handled. It basically means nothing. It could have been counted, moved, filed, etc. Don't get too excited over a 'touch'

The length of your process can depend on the country the beneficiary is from. For example, if you interview in Montreal, it is a very slow consulate and averages 4 months from NVC to an interview.

Good luck

K-1 Fiance(e) Visa Process & ProceduresPanic!
no, it won't be a problem. I totally messed up both my parents' location of birth on the application. When I got to the interview, I made sure I mentioned it and the CO made a note of it in the file and that was it. Simply putting an 's' or in place of a 'z' I am sure is no problem (since mine was no problem) but you might want to make mention of it in the interview.

good luck

K-1 Fiance(e) Visa Process & ProceduresVisa Fraud??

So less than 90 days = no police certificate.

If she's still worried tell her to 'loose' lose her passport and request a new one - no visa stamps to make them query it.
However it looks like that won't be an issue due to the length of time she stayed.

Let's not get into the habit of advising to actively mislead the US government. You should only report a lost passport if, in fact, it is lost

Good luck.

K-1 Fiance(e) Visa Process & ProceduresCanadian/American Question
Everything is pretty much electronic now, and if you are going in May - you should be fine. Just list an address that can receive documents just in case.

The time from interview to visa is only about 3 weeks (if that) so staying in Canada until the visa is advisable.

Good luck, join us in the Canada forum!

K-1 Fiance(e) Visa Process & ProceduresI-129F Embassy/Consulate Location Canada
If you originally put Toronto, I guess you're from the East? So Montreal will be your consulate. Vancouver and Montreal are the only 2 that process K-1 visas.

However, we put Toronto (we hadnt found VJ yet) and they corrected it for us and sent it to Montreal.
Good luck.

K-1 Fiance(e) Visa Process & ProceduresMy fiance is 19, Can She Apply for K-1
Honestly, we can't tell you what is best for you. Only you and your fiancee can determine what is best for you.

Take a look at the benefits and costs of each visa based on the guides here.

This should help you decide what route is best for you and your fiancee to take

K-1 Fiance(e) Visa Process & ProceduresAlready have B 1 visa, can I enter the USA and apply for K1 visa from the USA
Yes, you can enter the US and petition for the K-1 while you are there. Please make sure you abide by the terms of your admittance and your I-94 and return to your home country on time.

K-1 Fiance(e) Visa Process & ProceduresMarriage after applying for K1 visa (before approval)
She would no longer be eligible for the K-1, like sachinky pointed out. You would then withdraw the K-1, forfeit your fee, and petition for a spousal visa (all fees needing to be paid again)

Sit tight and wait for the K-1. It will certianly put heavy delays on your case if you were to marry now

Good luck

K-1 Fiance(e) Visa Process & Proceduresjust a questions
You can send it but you will have to complete the form again with updated information when it is at the appropriate time. USCIS doesn't do anything with the I-134. So there is so benefit to sending it to USCIS and the cost is you'll just have to do it all again at the right time

Good luck.

K-1 Fiance(e) Visa Process & Proceduresk-1 visa g-325a
You can attach a separate sheet of paper if necessary. Or, you can shorten the address. For example, on the G-325A I simply put Toronto, Canada for the address. It was accepted with no issues and I made sure to put the longer form of the address on later documents which provided more room to do so.

I think as long as the information is clear and your occupations are listed correctly, then you should be fine.

Good luck

K-1 Fiance(e) Visa Process & ProceduresHow do we find out info after I-129F is sent
Not much you can do until the cheque is cashed or you get the NOA-1 in the mail. You will need the account number (either listed on the back of the cheque which will start with WAC or on your NOA-1) to set up an account on the USCIS website. When that is done then you'll receive updates on your case via e-mail

And yes, this is a waiting game. Sorry to say, but get used to it!

Good luck.

You can post this on the waiver forum, member emt103c's husband had an expedited removal. She'll post a reply or you can PM her about the details

Make sure you have exceptionally strong ties to Canada, once you are denied entry, it becomes harder to enter the US. Expect to go into secondary screening.

K-1 Fiance(e) Visa Process & ProceduresVisitation During Visa Process
This is a very common question, if you do a search you can find lots of answers. The short answer is: admittance and duration of stay is up to the border agent at the time of crossing (OK, not so short of an answer). Bringing strong ties to your home country will help, as well as bringing a copy of the petition.

You might want to try posting this on the UK forum to get more specific answers about what to expect

The petitioner of a K-1 visa does not submit the petition to the lockbox in Chicago -- in the case of the OP it will be sent to the Vermont Service Center.

K-1 Fiance(e) Visa Process & ProceduresK-1 visa filing abroad
You, the US citizen, files the petition, not your girlfriend. You will need to complete the paperwork and submit it to the lockbox in Chicago.

These guides will help you through the process. Your girlfriend cannot file the petition in Hong Kong

K-1 Fiance(e) Visa Process & ProceduresK1 Procedure
He should not take the medical and interview on the same day, he will need to bring the results of the medical to the interview (Yes, it will be in Vancouver)

http://www.visajourn...visa_applicants

He must choose one of the 4 doctors in Canada (one in Vancouver, one in Toronto and 2 in Montreal) to do his medical. He can do his medical once he recieves packet 3 which will arrive in the mail.

Once the visa is issued, he has 6 months to use it and then 90 days after entering to marry you. He cannot travel to Canada and return to the US without his advanced parole document. If I were you, I'd delay the process a bit (not send back packet 3 for a few months) to ensure he has time to finish school.

Good luck, come on over to the Canada regional forum

K-1 Fiance(e) Visa Process & ProceduresCan you be denied at the border ?
If the border determines that the consulate made an error when issuing the visa, such as trailmix posted, you can be denied. However, in that situation, the consulate over-ruled the CBP.

Do a search, you'll find the story

K-1 Fiance(e) Visa Process & ProceduresCuriosity
Not trying to sound cold, but USCIS doesn't care about fiance's pregnancy (either foreign or domestic). No expedite and many times a tourist visa becomes more difficult to get due to the presumption of immigrant intent.

K-1 Fiance(e) Visa Process & ProceduresA little help/advice please?

You should not marry when you go visit him on a tourist visa or the equivalent, since that will constitute immigration fraud. You could go either the K-1 or the CR-1 route. The K-1 is a fiance visa, where in your USC fiance petitions for you to be able to go to the US to get married in the States.Time-lines vary between 3 to 5 months i,e in a problem free situation.
The CR-1 is a spousal visa, wherein you both marry outside the States and then he goes back to petition for you to come over to the States.Again time-line vary between 4-5 months. It depends. It will not take a year I think but one never can say anything too safe about immigration.

Good Luck!

This is incorrect. You may go to the US on a tourist visa and marry, then return to the UK. That is not an issue. The only time immigration fraud may be suspected is if you travel to the US on a tourist visa, with intent on immigrating. That's the fraud.

Also, the Cr-1 is not for people who marry outside of the US. It is for people who are married, regardless of where the wedding takes place.

You need to read the guides here and figure out which visa is best. His depolyments may qualify you for a military expedite so certainly look into that as well.

K-1 Fiance(e) Visa Process & ProceduresCan I visit my US fiance while waiting on K-1?
This is a very common question, if you do a search you'll find plenty of answers.

Yes, you can visit, however the duration of stay and admittance is up to the border patrol at the time of crossing (nothing is guarenteed). So, you'll want to bring strong ties to Australia in case you are asked...things like a lease/mortgage, a letter from job or proof of attending school. Anything that shows you need to return. Also, bring a copy of your I-129F packet, that seems to help

Good luck

Non-immigrant visas DO get interviews in Vancouver The non-immigrant visas they deal with are the K-1 and the (dead) K-3. The Cr-1 is an immigrant visa which all Cr-1s go through Montreal

K-1 Fiance(e) Visa Process & ProceduresUS Citizen living in Canada, fastest way to get Canadian fiance to US?
You should NOT have your fiance enter on a tourist visa with intentions of marrying and staying. This is visa fraud.

Have you thought about marrying in Canada now and filing DCF (Direct Consular Filing)? Montreal is a tough consulate when it comes to (re)establishing domicile in the United States. But this is a quick way when ensures minimal separation.

Go over to the Canada forum for more help. Lots of US citizens living in Canada trying to get their SO's to the US

http://www.visajourn...orum/93-canada/

option 1 - is an option but yes, you will face separation
option 2 - the employer does not issue work permits. USCIS does and it is a very long, drawn out process to secure a work visa

Good luck

Yes, you have to wait. Perhaps you missed something when filing out the form, maybe they need some documentation. You won't know until you get the actual piece of paper.

Sorry, this is not an easy process. We got an RFE too and it was about 2 weeks before we got the paper saying what we had to send in
