I'm not sure of your question, are you thinking of visiting your fiance in the US? Yes, they can deny you entry for whatever reason whenever they feel like it. They will likely claim 'lack of ties' to your home country. When do you travel, bring strong ties to SA when you travel to the States.

The documents don't need to be notarized.

If you have begun the K-1 process it will be difficult for you to obtain a work visa. Many (most in fact) work visas are non-immigrant visas which means to be approved for one you'll have to show that you intend to move back to Canada once your work visa expires. To do this, you'll have to show that you do not intend to immigrate to the United States - this will be difficult to prove if you have a K-1 in process which states that you do intend to immigrate.

Not impossible but your chances of being approved a work visa with a pending K-1 application drop substantially

Honestly, USCIS won't care about your overstay or your excuses. If it becomes an issue it will become one at the embassy (and they won't care about your excuses on paper either, they'll ask you about them) so to me, the paper explaining it is useless

Do not list that you 'lived' in the US during your overstay. You were still a French resident, put your French address for the time you were visiting the US.

We started with a lawyer because we hadn't heard about VJ yet. They slow up your case substantially because they have no vested interst in turning documents around quickly or even following up beyond a phone call (which you can do yourself)

After we found VJ we fired our lawyer and the process went MUCH smoother after that. Many veteran VJ members are well versed on the process.

Unless your case is particularly complicated, a lawyer is not necessary. This is a great community for support and advice

Here's my concern. An R visa is a non-immigrant visa. It will be difficult to prove you don't have immigrant intent when engaged to a USC (which they will know at the interview regardless if you cancel the K petition or not). Secondly, using a non-immigrant visa, like a R visa, when you have intent to marry a US citizen (as evidenced by the fact you filed a K visa) is visa fraud and can result in a lifetime ban.

I'd wait out the K-1 visa, it is the most productive way to get what you want (a life and job in the US) if you ask me.

But certainly consult a lawyer to see what your options are

Citizenship is acquired a multitude of ways. Most commonly birth right, being born in America or being born to US citizen parents.

Then comes naturalization after being an LPR for a number of years

LPR = Legal Permenant Resident (ie green card). This is gained a few ways. You can have an employer petition for a work visa for you then you can apply for a work based green card. Alternatively you can get a spousal visa which allows your spouse to enter the US as a permenant resident (like I, and many other spouses here did). There is also the K-1 visa which allows your fiance to enter the US, marry and then adjust status to an LPR.
There is also the green card lottery.

As I stated in my previous post, if you have your green card for 5 years (ie through a work based green card or winning the green card lottery) you can then apply to naturalize to a US citizen. This gets lowered to 3 if you got your green card through your spouse.

These are the most common ways, not all the ways. I suggest you begin reading and familarize yourself with the processes and find the one that fits your lifestyle - don't try and fit your lifestyle to a visa

I also don't understand how you intend for him to legally seek citizenship. Citizenship through naturalization is awarded to those who have been LPRs for 5 years typically or 3 years if their residency was acquired through marriage to a USC

Coming in as a visitor, he cannot seek naturalization.

However, that doesn't seem to be your question. You seem to be seeking advice on how to proceed with your fiance without applying for the visa (6 month visa vs. several shorter visits)

Spending more 'in person' time with your fiance is never a bad thing. This way you can get to know each other as people, not as images on the other end of a computer.

Canadians do not need a visa to visit for up to 6 months at a time. To do this, you simply plan a trip. However, if your fiance gets asked his proof of ties to Canada, what can he show? A job? A lease/mortgage? A letter from his son's mother will be good with an expected return date.

I do not suggest filing for a K-1 visa then seeing how it goes. The K-1 is for couples who are committed to living in American and marrying. Your comment of "would like to consider living together prior to our formal engagement " suggests you are not at the filing stage yet

You may file the K-1 fiance visa which will allow her to come into the US and marry you and adjust status to a permenant resident.

You may also marry then file for the Cr-1 spousal visa which will allow her to come to the US as a permenant resident.

Where in Canada is your fiance? There are only 2 consulates in Canada (Montreal and Vancouver) who will interview for K/CR-1 visas so depending on where she lives, she will either go to Vancouver (if she lives in Manitoba or westward) or Montreal (if she lives in Ontario or eastward)

I am a Canadian Citizen living in Ontario (Toronto) and in IT profession. Have worked in US on TN1 Visa in the past for two years.
My Fiancee a Permanent Resident (Green Card Holder) living with her teen age daughter in New Jersy state. I also have three kids two are above eighteen (18) years and are studying in canadian Universities. My only daughter is thirteen (13) years of age. I wish to keep my daughter with me in US.
Me and my fiancee are planning to marry soon and I would like to settle in US along with my daughter but so far I have no status in US to start/ find my/ any job there.
My questions are:
1- what type of form can be submitted by my fiancee that I should be eligible to start work in US?
2- How long is the process?
3- How my daughter can stay with me and start her schooling there. Currently she is in grade 7 in Canada?

Your fiance cannot petition through the consulate in Toronto unless she is a legal resident of Toronto/Ontario. You already said she is not so this is not an option for you. It is also not an option for you because the I-130 is for married couples and you already said you are not a married couple. So I'm not sure what you told your immigration attorney but this is incorrect information based on what you said above.

The quickest and easiest way to get you to the US where you can live an work would be to get married now and have your SO send the I-130 petition now as a green card holder. When she becomes a US citizen she can then upgrade the petition

According to the immigration timelines, you're looking at about 80 days until your interview (which is great!). You can still travel, but like mustafa1232 says, bring ties to the UK and an interview letter is a good tie, showing you are going to return to attend.

Remember, once you marry within the US, you cannot leave until you file AOS and get your AP (advanced parole). This will allow you back into the US after you leave.

What province are you from? You can simply google "(province) long form birth certificate) and it will come up as to what government office you will apply for one.

Your medical can only be scheduled once you have your information from 'packet 3' which is sent to you after your approval and your petition is sent to the embassy (either Vancouver or Montreal). I'd plan on 2-3 weeks before the interview to schedule the interview. You will also need your nation wide name check for your police certificate (unless you have a criminal record)

If she's been for 6 months already, she should return to Canada. Typically it will take between 6 and 8 months to process the visa, although it has gotten better, Montreal is a slow consulate for scheduling interviews. She can visit again after she returns to Canada (she needs to be sure not to overstay - remember it is not 6 months but it is 180 days). However, after staying for 6 months already, it might be worth while to spend some time in Canada in order to show that she is not 'living' in the US.

Yes, while you are in the US visiting you can file the I-129F for the K-1.

Separation is part of this process. After visiting for 6 months, the Customs and Border Patrol will want to see that you are not 'living' in the US and you are spending more time in your home country and not in the US. While you plan could theoretically work, you'll want to be sure that you have strong ties to Australis when you travel in case you are asked to prove that you intend to return to Aus.

But basically your petition has a bar code on it and any time it is handled, the bar code gets scanned. Now they could handle your petition to move it to an adjudicators desk or to move it from filing cabinet A to filing cabinet B due to a leaky pipe
