Hi,

I heard information about a fee increase that was in affect beginning July 13, 2010. I came across the fee for the K-1 Visa which is still at $455.00, but then read that there is a new fee of $350.00 which is the cost for the interview at the US consulate.
I also read on VJ that the K-1 Visa decreased to an amount of $350.00. I am confused. There is a lot of different posts I have been reading and I am not sure which is accurate. Can somebody confirm what is correct change with the charges for the K-1 Visa?

Thanks so much for the help, it is greatly appreciated. I know I need more than the forms to send, but that is just what we are starting with since he is here with me now. We don't plan on sending them in for a few months, I just want to have everything ready to go. I just have one last question, for form I-129 Part B. Question 18 I am attaching an additional sheet regarding the times we have met. I am just curious as to what other people who have filled out this form have included. I am not sure whether I should just put the location and dates we have met and the length of the stay, or if I need to include more detail than that. Thanks.

I am reading the guides.. I just didn't see what I was looking for. Thanks for the help. I have a few more questions..

1. How much money should be sent with the form, and does it make a difference whether you send a check or money order?
2. For question 20, it asks which embassy I will be applying at. I am in Canada and am not sure which embassy to put. I thought it was only Vancouver and Montreal, but when I googled American embassy in Canada it showed there are quite a few.
3. According to the guide, for question 18 I should put "(mark additional sheet as "I-129F Supplement: Part B, Question 18: Has your Fiance(e) met and seen you)". Do I write out an explanation on the additional sheet of everytime we have met in the past two years?

Hi, I just started filling out the I-129 form that I downloaded and printed. I noticed at the top of the page it says expires 01/31/2010, which would make it expired. I just printed out this form 5 minutes ago, what is going on with that? Also, is there a fee for sending this form? Does a check need to be included? I'm a little confused and overwhelmed by all this procedure, so any help would be greatly appreciated. Thanks in Advance.

You need EAD, final answer. K-1 cannot legally work without EAD or green card.

SSN can be issued to a K-1 visa holder without EAD or green card but has black print " VALID FOR WORK ONLY WITH DHS AUTHORIZATION ".

Once you get your EAD you can work with SSN. Once you get your green card you must go in to SSN office and get your SSN changed.

We used a LARGE silver paperclip to put it all together and had photos in plastic baggies placed in there where they needede to be, obviously held in place by the paperclip or an extra one to make sure it stayed between the apropriate pages.

Dont use fasteners dont make hole punches etc... the USCIS will take ALL pages apart regardless of how you put it together and they REDO IT to how they want/need it. Just go with a large paper clip or one of the big black clips that holds a large amount of paper.

We did exactly that.

Our NOA-2 just got approved, so I think it works fine.
Then again, I dunno.....we included so much stuff on top of that. And yet again, we didn't include a letter of intent.
I'm just saying, photos probably won't brake or make the petition. Just date them, sign the names of any people on there besides you two and who they are (cousins, aunts, uncles, friends), place taken, etc.


heh we included about 25 photos along with emails, cards, envelopes, copys of large mail packaging, movie stubs, pages and pages of phone records and a bunch more ha - at the interview our packet was about 4inches thick!(including whatever papers they added of course)

Our photos had no dates, on the back of the photos I wrote the dates in pen and wrote the names of all the people in the photos as well as wrote the place the photos were taken at and the time of year.

Just send copys, keep the originals for yourself. I brought originals of my plane tickets to my k-1 interview incase they asked for it but they never asked to see originals. I also put copys of itinerarys when I didnt have the original tickets.

Wow! how did they process you without opening the package... How did they accept your AOS without having your files! :blink: That is really interesting, I bet the RFE is for all thos files that they don't have lol.

Im with Rhianner on this one, get the RFE in the mail and make an infopass right away and bring all that in with you.

If you dont make 125% above the poverty requirements for a 2 person house hold(assuming you guys have no kids or anything)you must have a co-sponser. Loans wont help you they dont count as income. Yes your co-sponser can be your parents. You might want to read some of the directions for the I-864 forms and the I-134 to get familiar with them.

The woman at the window I had was really nice, the one the next window over was not so nice lol.. she was yelling at the couple beside me, not sure what it was about but it was a little nerve racking! The guy I got for the actual interview was nice too, he joked a lot and smiled a lot. It was very relaxed for me. The guards were kind of sterile... cut an dry not all that nice but I suppose they cant be to friendly with people as they are guards.

" Unauthorized Use of Credit Card Data " may hold a more serious offence in america maybe? and maybe thats why they have to look into it and see if you need a waiver for it and stuff. From what iv looked around on google (I dont usually trust google for info) it says that its identity fraud/credit card fraud charges for unauthorized use of credit card data.

To me this is confusing. How do you live in 2 places at once? List them in order of where you PHYSICALLY lived? You could not physically live in Indonesia and still be living in the netherlands. I would list it as such

November 1997 - August 2005 - address in Netherlands
August 2005 - June 2006 - address in USA
June 2006 - August 2008 - address in Netherlands
August 2008 - December 2008 - address in USA
December 2008 - February 2009 - address in Netherlands
February 2009 - June 2009 - address in Indonesia
June 2009 - present - address in Netherlands.

(or however it needs to be written)

Don't confuse residence with physical presence. Although you kept your residence in the Netherlands, you were not physically present there. List them in order of physical presence. It will minimize confusition which could delay your case.

If you go for the K-1 then you must marry in the US. If you choose to go for the CR-1 then you can marry anywhere you like.

With the cost of traveling to Montreal vs. the cost of adjusting status, I suggest going for the Cr-1. It is a superior visa if you ask me.

Now, a denial is rare in Montreal (for typical cases) because it is a low fraud country (not to say that it is unheard of). If there is no criminal activity or visa overstay or other illegal activity, and your relationship is solid, you should be fine. However, if the Cr-1 is denied, you may apply again, with all the associated costs paid again, but you will have to overcome the reasons for denial. If you are denied adjustment of status then she will have to leave the US. Either way, a denial will make it VERY difficult for her to ever visit the US.

But again, denial should not be on your radar if your relationship is solid and there are no aggrevating factors

If you marry and get an approved Cr-1 she will need to move to the US within 6 months. When she does, a green card will arrive in the mail

An interview and medical are required for any type of visa. Where in Canada is your girlfriend from? This will determine where the interview will take place (unless it's a CR-1 visa and then it wil be through Montreal)

Like everyone else said, there is no way to switch your visa without losing your fee and your place in line. You would have to start all over again. Please note that Montreal is a slower consulat than most but look at 6 - 8 months for a K-1 and slightly longer for the spousal visa. Since you've already applied for the K-1, stick with that

Touching your file is just that - someone handled your petition. They could have moved it, counted it, filed it, stored it somewhere or they could have transferred it from file cabinet A to file cabinet B because of a leaky pipe.

Touches mean very little, don't put too much weight behind it.

Any and all overstays are illegal - so no, she can not simply overstay without running the risk of complicating your immigrant visa process

She can visit using the VWP however admittance and duration of stay are up to the boarder patrol and she should being STRONG ties to Korea to show that she intends to return.

Coming to the US to marry and return to her home country are perfectly OK. Coming to the US on the VWP with the intention of staying and immigrating is visa fraud and can result in a lifetime ban.
