She would not put her current address because she has not been there longer than 1 year. She will put the address before her current one that she was at for 5.5 years

For the employment part, listing 'none' indicates that she is not working. Is this true? The example form lists that spot as blank because the information IS listed above

What more material would she have to show? Regardless, she must put the place of birth of her parents. She cannot leave that blank.

K3 is a visa. Visas are needed to enter the country. When you arrive in the US on a K-1, there is no need for another visa since you are already in the country. When you arrive in the US on your K-1, you will marry within 90 days and then file your Adjustment of Status from non-immigrant to green card holder. When you apply for AOS, you then apply for your EAD to work (can't work until then) and your AP to travel.

If you leave the country without AP, you abandon your adjustment of status

My only concern is that an L visa is a non-immigrant visa. If you intend on being an immigrant, I suggest you file an immigrant visa petition or a dual intent petition like a k visa

No, you don't have to remain in the UK for the entire process. In fact, it is assumed you will return to the US to re-establish domicile. As long as you meet the requirements when you file, you should be fine

Your fiance will have to prove his US citizenship, this can be in the form of a birth certificate or a passport. Yes, you will need your birth certificate eventually - consulate stage. It will have to be the long form, the one with your parents listed. It has to be translated but you cannot translate it yourself. It does not have to be an accredited transoator, they just have to sign it and state they are qualified to translate it (others will step up and fix my mistakes on this)

No, your benefits do not count towards the finances. You have to show how HE can support you. You can find a cosponsor if you can.

I'm assuming you in Eastern Canada (east of Ontario) so you're interview will be in Montreal, I'm sorry but it is a terribly slow consulate

I see your point and I understand you,It is true what you're saying. I want to underline that this is a general idea,I surely don't want to say others what to do; I will enter the US with a K1 visa next year,and me and my fiancèe will get married within few days after my arrival - when I read that the waiting times for the EAD was of 3 months,my jaws dropped...I don't see any major risk in trying to work for example as a waiter in a restaurant for a couple of months while my AOS and EAD will be in processing. Again,this is me - but I simply can't see myself being a charge for my girlfriend and her family for months.

Can you see yourself getting in trouble for working without authorization? And can you see yourself telling the truth about it at your AOS interview or can you see yourself lying about it?

If you wanted immediate work upon entrance into the US, you should have filed for a CR1 spousal visa

And it is true that the K1 was NEVER work authorized. Until February 2009 there were some vagaries in the wording of the I-9 form that allowed some K-1s to "get away" with working. In February 2009 the DHS cleared up the confusaion and changed the wording on the I-9. There was no change in "the law". Such would have required an act of congress. The "change" was implemented with the change of a few words on a form.

Canadian citizens do not receive special treatment. I waited 178 days for my NOA-2 alone. that's special treatment?

US immigration does not recognize unborn children as persons. So until the child is born, it is not an actual 'person' to be recognized on any forms.

No need to include a letter, they will already know you overstayed. No need to 'justify' it. You will be asked about it at your interview, because it must be disclosed on the Ds-230, simply tell the truth then and you'll be fine

If you are filing for adjustment of status, you normally cannot leave the US without permission. (If you do, it will be presumed you have abandoned the AOS process, so it is closed.)

Most people get it while doing the AOS process, since, there is no charge for it (and you can apply for it after you sent in the initial AOS, still free) - just in case they need to travel prior to getting the greencard.

Be warned though, you have to make sure you are eligible for the AP, if you have any overstay over 180+ days, even with an approved AP, you could be subject to a ban upon your re-entry in the US.



So i dont have to send the AP form at the same time as my EAO AND AOS ??
( if 1-2 months from now i need to go back home for something i can still apply for the form for free? if i havent received my green card?)

Me and my husband are in the middle of filling our AOS paper work.. and the AP form , i know its optional.. But what is excactly .. ?
is it for people who are planning on leaving the USA for a bit or is it a permition in case u need a permition to leave the usa ?

If we decide not to do this form(because im not planning on leaving the usa for a bit)
and later on the road we change our mind or i need to go home for a emergency something like that.. can i still apply for the form ?(without the fee)

Hi,

I heard information about a fee increase that was in affect beginning July 13, 2010. I came across the fee for the K-1 Visa which is still at $455.00, but then read that there is a new fee of $350.00 which is the cost for the interview at the US consulate.
I also read on VJ that the K-1 Visa decreased to an amount of $350.00. I am confused. There is a lot of different posts I have been reading and I am not sure which is accurate. Can somebody confirm what is correct change with the charges for the K-1 Visa?
