Question 25 - They actually mean all visits. However, this is a commong question for Canadians. I attached a separate piece of paper outlining that since I am Canadian and visas are not required, and since I have traveled many times to the US for weekend or day trips, I do not remember all my visits but outlined that I never overstayed. However, I listed, to the best of my ability, the trips I made in the last 5 years. If it is listed as a B-2 then list that, but Canadians aren't typically issued visas to enter the US. USCIS knows list, so I put n/a

No, it will neither delay or expedite your case. A DNA test will generally be required if the baby is born abroad. If the child is born abroad, and you meet the residency requirements, the child should have US citizenship. A CRBA should be filed in this case and often a DNA test is necessary.

I say go for the K-1 then. You'll get through heaps faster in Vancouver with a K visa than you will with a spousal visa through Montreal

The K-3 is no longer an option for married couples so completly disregard that one. You can file for the K-1 tomorrow if you like. The spousal visa can be filed as soon as you have your marriage certificate. This can take a while to obtain in certain Canadian provinces (Ontario takes 8 weeks to get the marriage cert.)

Your finaces will not be dealt with at USCIS so you have plenty of time to sort all that out, don't send more to USCIS than necessary as you will just need to complete an updated form at the correct time. No, your income will not work for the support, he needs to show he can support you. And no, you don't need to have an permenant address to file, you can always update the address at the interview if you decide to change it later on

what part of Canada are you from? Eastern Canada will interview in Montreal (a very slow consulate) for K visas, Vancouver for Western Canada. All spousal visas go through Montreal

This looks a lot like the guides section. On just a heads up, you'll need an updated I-134 with all updated info in the future. That's why VJ doesn't recommend you send it into USCIS as it just adds work and doesn't benefit you at all

Since you received your NOA2 according to your timeline, did you call NVC to see where it is? Once USCIS approves it it goes off to NVC. Call them, speak to a live person and don't hang up until they find it

Don't file a duplicate petition until you get this straightened out

Yes you should try and cross but don't expect to get in. Go prepared to get denied (sort of plan for the worst but hope for the best). You'll need to be polite "yes sir" and "no ma'am" no matter how upset you are or how riled they try and get you. When they finally let me in, the woman said "I'll charge you with fraud right now, tell me the truth" so which I replied "yes ma'am, I am telling the truth, here is my proof".

It is heaps harder to get in once you have been deined. Again, did you sign anything or have anything written in your passport?

Trust me, I know how you feel. I was denied entry, not once...but twice! So I get your pain. I also successfully crossed about 3 weeks after my last denial so I know what they are expecting and what you should plan on doing.

Was anything written in your passport? Did you sign anything when you were denied?

Sadly, crossing into a new country is a privledge and no, we dont' have any rights. It's not fiar how they treat us but honestly, they have the power. Suck it up and move forward, if you plan on crossing then PM me and I'll get you well armed!

Entrance and duration of stay is up to the border agent. Have you been denied entry before? That makes it more difficult but not impossible to visit. Make sure you cross with a copy I-129F and ties to Canada to help your crossing

From someone who's been there, it will not affect any application for another class of visa. It will, however, make you visiting the US in the future more difficult. I'm sorry this happened to you but make sure next time you cross that you bring STRONG ties to Canada like a lease, or job or utility bills, etc.

Also, you'll have to declare the denial during the K-1 process but don't let that discourage you. Just tell the truth and it will be fine

This is a DIY site, so most people won't have an attorney. We started this process, before VJ, with a lawyer and the lawyer was not vested in our case. They delayed things, they spent days 'reviewing' our paperwork.

no one can say whether you NEED a lawyer, lawyers can be extremely helpful with difficult cases but if you have a simple case (no criminal record, no overstays, no illegal entries) then you can probably do it yourself

No, they don't know anything. When you call USCIS you can't actually calling USCIS, you are calling a call centre where the employees have scripts and cannot tell you anything other than what you can already see when you log in to check your status. Did you get a tracking number when you mailed your RFE back?

Don't keep calling, they don't know anything. The next step is you should get an e-mail from USCIS saying processing on your petition has resumed. Then, barring any other delays, the NOA-2 should come shortly.

They say it takes 60 days after you send in the RFE to get a response. After 4 weeks if you haven't heard anything, start making noise and speak to a supervisor

Actually, it could mean someone has started to review your application but in most times it does not. You're petition has a bar code and everytime someones touches your petition they swipe the bar code and the 'last updated' date changes. Sadly, they touch your application to count it, move it, or relocate it. It could mean it has been moved to an adjudicators desk, or it could mean your petition was moved from filing cabinet A to filing cabinet B due to a leaky pipe

Don't put to much stock behind touches, some people get heaps of spread out touches during their journey, some get approved with no touches

You look around and pick your line and begin to wait. You look left and see people moving through the line quickly. Maybe they have a super fast cashier, or maybe fewer items than you. You look right and that line is longer than yours. Then you look to the cashier and you see an old woman paying in dimes with a gazillion coupons and you realize, that of no fault of your own, your line is going to take forever.

This works the same way at USCIS. Somtimes you get a super fast adjudicator and sometimes you get one that has a million things to go through in the petition ahead of you.

Any issues regarding the home residency requirement would come up at the interview. USCIS simply appoves you to apply for the visa, not applying for the actual visa (which is what you do at the consulate)

The use of "wife" and "husband' has gotten denails of people on VJ before. I suggest you get out of that habit now (especially if it is in any text messages or e-mails you intend on submitting as proof of on going relationships). One VJ member was denied a K-1 because at their engagement ceremony her father gave her fiance money which was seen as a dowery by the consluate and indicated marriage.

Don't complicate your case. Make it easy for them to approve you. If the term 'wife' is used, it's REALLY hard to take back at an interview

You can purchase a 1 way ticket. A K-1 is a dual intent non-immigrant visa - meaning it is assumed she will be a permanent resident.

However, always advisable not to purchase a ticket until the visa is in hand. A poor woman on the Canada forum is re-booking her flight because her visa package was sent to the wrong address - very costly.

You can delay the paperwork if you like. OR, you can still file. The visa is good for 6 months after it is issued. I'd file now, processing through USCIS is taking 3 - 6 months at the moment, plus an interview wait. So if you file now, you will be able to be with him when he returns in October.

Alternatively, you could file now, request an expedite due to imminent military deploymnent (not sure if there is enough time) and be there by October - hopefully.
