any tabs, seperators, file sliders, folders, binders etc get thrown away as soon as they open the package. They take a part the file, place things the way they want it in their own folders with their own clips. Dont waste money that you dont need too on seperating pages and sections, just use the cover letter to state each section.

The ammount sounds correct, only thing I dont see is passport stamps to go with the ticket recipts/itinerarys.

Seperate the pictures, on the back of the passport ones your names need to be on it.
On the back of the family photos, names, dates, places need to go on it. I also put relations ie "fiance father Robert" etc so they see relations.

Just used a giant paper clip, clipped it all together in order. Stuffed it in the envelope ( put the address on first before u stuff it all in makes it easier to write on )

Make sure the check is RIGHT in front of it so they cant lose it.

J-1 is a special visa which routinely has a 2 year home residency requirement, meaning the beneficiary must return home for 2 years before being able to return to the US. It is not just for British citizens, in fact, many beneficiaries of J-1 have a 2 year HRR

To the OP, as payxibka said, you must first petition for your fiance. After that, he may apply for the waiver to be able to return to the US without staying in England for the full 2 years as per his visa requirements

Also, don't book a flight until the visa is in your hand. Too many people on here have been anxious to book a flight and then they end up paying huge fees to change it because something doesn't go their way

It has gone quickly! But MRStee is correct, you do not have a visa yet. The petition has been approved which is required for you to apply for the visa. If you followed that link I sent you, you will see what else has to be done. The embassy will send out information to you that will need to be returned before the interview can be scheduled. You will need this to schedule your medical (which will be needed at the interview) and you will need to get your police certificate.

We got an RFE and it was not a big deal to correct. It slowed our case up a bit but other than that it wasn't an issue

1- If we were to petition, then apply for the k1 visa, and it was accepted, would I not be allowed to enter the US until we plan on being married within the 90 days? Say if I crossed in March, and we were aiming for marriage in September, would the K1 automatically start ticking from when I first crossed, or can I choose to not use it until later on? and just cross using my nexus on weekends? After you petition (and it's approved) you must then apply for the visa at the consulate. This is a multi-stage process. But you can visit between petitioning and receiving the visa - admittance and duration of stay is up to the border guards so make sure you bring ties to Canada. Once you enter using the K-1 visa, you have 90 days to marry.

2- Seeing as once the K1 Visa starts, I can't come back into Canada for the 90 days. Can we not just skip this step entirely? I would then work in Vancouver until the wedding date, visit her on weekends, and then just enter using nexus and marry and then begin the paperwork? I feel like the K1 would cause more restrictions than anything else. I would not be allowed back in Canada to visit family, I would not be able to work those 3 months before the wedding, and I would be out a fair amount of money for the process. If you enter using a K-1 visa, you may leave at any time. You cannot, however, re-enter the US without your green card or your advanced parole. This is issued after marriage and after your AOS has been applied for (AP applied for separetly). And no, skipping steps is generally not permitted

3- Does the K1 Visa shorten the time it takes to receive permanent residence status after the marriage? Not really, the benefit for you is that you will interview in Vancouver, interviewing in Montreal for a Cr-1 (spousal) visa will lengthen your time because Montreal is a slow consulate. However, once the K-1 visa is given, you must then apply for your adjustment of status. This, plus the entire K-1 process, may be longer than a spousal visa. However, a spousal visa will allow you to travel and work immediatly upon entering the US with that class of visa

4- Given our situation, me in Van, her in Seattle, and visiting on weekends, what would be the best course of action? Any recommendations? Depends on what you value. The K-1 is slightly faster to get you to the US, but you'll have to deal with the working and traveling restrictions. You can interview in Vancouver vs. Montreal (quicker), and the length of time to the actual green card is longer. I suggest you begin reading up on the 'guides' tab

A student visa requires her to apply for and be accepted to a US university. Then she can apply for the F-1 student visa, which is a non-immigrant visa. She wil need to show that she intends to return to Chilie after her studies. If this is not what you want, and you want her to come to the US and stay, begin reading up on the I-129F fiance visa (begin with the guides up at the top here)

You, for the k-1 visa from Canada, are looking at maybe 8 months, longer if you will be interviewing in Montreal (what part of Canada are you from? Westerners will interview Vancouver and Easterners will interview in Montreal). Your case can be slowed down by not returning documents to the consulate right away.

I suggest your fiance petitions now. Then when your case progresses and you are required to submit futher documents after the USCIS approval but before the interview, you delay this. This will delay your case allowing you more time to finish your studies. Then, once the visa is issued, you will have 6 months to use it.

Once you enter the US you may leave at any time. However, note that the K-1 is a single entry visa meaning you can only use it one to enter the US. You cannot enter the US again until you have Advanced Parole which you apply for after you are married and have filed your adjustment of status.

Yes, if the US citizen does not make enough money to satisfy the income requirement, then a co-sponsor is needed. Generally they will not outright deny you, but this can delay your case significantly if you are not prepared.

I think the big question here is how did you answer question 20 on the I-129F, the one that pertains to which consulate the beneficiary will apply at? are you sure you put Kiev?

Contact NVC immediatly if a change in consulate is required. Also, call the consulate that the petition has been sent to have it returned to NVC to have it sent to the right consulate

Further, are you absolutly sure you cannot appy in Paris? Who told you that? I'd contact the consulate in Paris to be sure

I think asking us what USCIS will think is not really fair because each adjudicator is going to think different things. One may think that this girl really wants to come to the US to be with her fiance and is looking at all avenues. One may think, however, that she is just interested in coming to the US by any means necessary. Others may not think anything at all and adjudicate the petitions separatly.

They may deny her visa, I have no idea about the terms of her application. But if they do, it will not affect your K-1 but you will have to disclose it at the interview.

Visas are used to enter the country. So if she is already in the US on an H1B then another visa is not necessary, she will then marry and adjust status through you. The good thing is H1B's are dual intent so they will assume she will immigrate at some point.

Keep in mind, the H1B is a long process as well, your K-1 will likely be processed before the H1B

So, you'll interview in Montreal. The good thing is only 3 cities in Canada have approved doctors to do your medical and Montreal is one of them. Also, you should work on getting your long form birth certificate (google Quebec Long Form Birth Certificate) as you will need this and inquire about your police certificates. Those you can do now so you won't be scrambling at the end.

Diana, where in Canada are you? This will affect where you will interview for the visa. If you are in Western Canada you will interview in Vancouver. If you are in Eastern Canada, you will interview in Montreal.

I hate to be the bearer of bad news, but I think you're looking at longer than 5 months. Canadian consulates are incredibly slow at the moment, espcially Montreal who is averaging about 3 months for an interview.

Patience is part of this process, we've all been through it and thankfully they are moving faster than when we were processed

Your entire file is in the brown envelope. It MUST remain sealed (if you miss the warnings in the envelope) as it can only be opened by a US immigration agent. If you open it, they will not process your fiance and she will have to go back to the consulate to have it resealed.

I was denied entry twice before we applied for our visa. It is certainly no fun so make sure you have strong ties to Canada before you attempt to cross, plus - include a copy of your I-129F packet

If denied, it will not affect your K-1 application. You will have to disclose it and answer questions about it, as I did, but you'll be fine if you tell the truth
