After first thinking about my orginial answer I would say I was wrong. Doesn't both parties have to sign the application? so that would have Propose first then file. Propose online, mail paperwork back and forth and start the paperwork process. Getting in line for the visa is the important thing in my mind since you will be waiting so long anyway. Just read some of the other comments how they are going crazy waiting for the visa. You will understand where I am coming from

When you arrive to the USA, marry and adjust status, you will become a permenant resident. After a few years you will be eligible for citizenship but you do not HAVE to petition for it.

Many countires allow dual citizenship. I am readying my petition for naturalization now, but will maintain my canadian citizenship as well

K-1 interviews are done in either Vancouver or Montreal at their consulate.  No. the K-1 cannot be processed within the US.

Both, simply because USCIS has received your petition and sent out your I797 - that doesn't mean you won't get an RFE. Further, the consulate may also require more information.

I797 is your notice of action, or your NOA1. It means you are moving in the right direction as Vermont has received your petition. On your I797 you will get your case number which can be used to track your case.

Sadly, it doesn't mean that an RFE isn't in your future, we got ours 6 months after our NOA1.

I faced this same issue during my K1, and in the end, I chose my visa over the wishes of my family. No ceremony. Period. They were pretty upset about it, they said I was being unreasonable and paranoid. I didn't care what they said or thought--I STILL don't care. And you know what? Over a year later, my family got over it and saw the logic behind why I put my visa first.

It ultimately comes down to you and your fiance obeying immigration laws or bending to the will of her family. Her family doesn't have to live with the consequences if she gets denied her visa thanks to a ceremony. Her family won't feel the heartbreak if you and her are removed from each other. So if her family really cares about her, they can wait.

One question I do have is about the I129F question 10 . I have selected X birth in the U.S. under that is the long box for a certificate date and place . I was thinking this was for the selection in the same question 10 Naturalization . I have it now with N/A . I did notice on my birth certificate there is a number on it called certificate number .

No you do not include the support forms, they are not needed at this time and if you do include them you will have to send all new support forms and evidence later when they are requested.

A lawyer does not care about your petition or your situation, just about getting paid thats all. They would care less about your petition than you would. More likely for the lawyer to mess stuff up so you pay them longer and more money.

Get a P.O box or a box at the post office and collect your personal mail from there so your mom doesn't know or see it. Do the paper work yourselves it will save you a LOT of money considering this process is already very expensive. If you make a mistake for whatever reason - it will be free and easy for yourselves to fix it. But this website has fully filled out example forms, offers advise from people who already did the forms etc and you can check quickly before sending something / doing something to make sure everything is correct.

They care about your CURRENT income meeting the guidelines, not your income from 2009 or 2010.

If you want to include the car yes you need to have it professionally appraised and include the paperwork for it. You shouldn't need to do that at all if you currently make the proper income for the household number and can prove that.

After almost 10 months I got a notice today that my file has been transferred to my local USCIS office. Does anyone have any experience with this type of notice? Does this mean it is likely to be approved (or denied) soon now or is it likely there will be months more waiting from this point? Thanks for any input.


When a K-1 is transferred to a local office it means there is an interview ahead for the USC because something is wrong. Cant say what because it could be a number of things.

Though, it still seems that the guy took their money without submitting any paperwork. And he did imply a guarantee of fast processing times (which you're never supposed to do if you're legit), even if he only told the OP that it was his case. He should have warned the OP that not all cases are that simple or quick. Still sounds fishy to me.


Oh yes, the part about the guy taking money and all this - it is very fishy - and your correct about the processing times issue.

It is often best to ask clarification on the ceremony things! Its quite possible the OP does require a K-1 visa and is following the correct path currently - if they do make to the embassy and do get tripped up because it was too wedding like then yes they would have to marry and start all over with an I-130 spousal application - which would be very unfortunate.

OP does not state if they have been in contact or trying to contact the guy who filed this and took his money, that would be one of the first things to do - get in contact and find out what the heck is going on! specially after giving so much cash to someone. If he cannot get in contact or the person appears to be ignoring or "delaying" giving answers its a good bet he/they took the money and threw away the papers. Which would be a very sad turn of events for the OP.

You shouldn't have filed for a K1 and instead filed the I-130 for a CR1, no?

Maybe this scammer saved you some time getting denied for the K1.


Some countrys have cultures that require a wedding ceremony be held before a marriage happens.
Some embassys ask to see this and if its not been done people are denied K-1 visas because they did not follow the norm cultural practice.

As long as the OP is clear that it is a cultural wedding ceremony and they did not marry they should be fine. If it is not the norm or they wore white wedding type attire and everything looks very wedding like then it can pose a red flag and make things difficult for the OP.

Are you filing this now? or are you filing this in April 2014?

If you are filing now then you need your 2012 taxes which are filed this April.
If you are filing in April 2014 then you would be using your 2013 taxes. If thats the case You should not be filling this form out now because April 2014 is a long ways away and you will have to redo the forms.

Nothing to do right now because you are at the 5-6 month wait time now. Doing paper work now will only mean its 5-6 months old and you will have to redo it later again.

You will get notification in the mail of the case number in the next few weeks, you can then make an account on USCIS and put the case number in to follow any updates.

It will only be valid till the date on the I-94 and then expire the same day that expires. Not really worth the fees and time it takes to process for how quickly it expires.

I would just file the AOS where the EAD and AP are free when you file with it and they last a whole year.
