I'm sorry, you cannot expedite because you got bad advice from a lawyer and you certainly cannot expedite because you planned your wedding. I could almost see for the business - maybe being a financial hardship - but then again you based that decision on bad advice, sadly that is not USCIS's problem.

I wish you found VJ earlier, we all would have told you to NOT MAKE ANY PLANS until the visa is in hand.

PS - of course your lawyer told you that, he wants to bill you for filing the expedite. As you just learned, USCIS doesn't expedite for weddings alone. Sorry, but he obviously lied to you!

I agree, why can't he sell his business now and wait for the visa?

Was it more the 180 days but less than 365? Then it is a 3 year ban from the US. You will need to diclose the illegal presence (because chances are they already know and lying about it will cause heaps more problems)

Yes, you'll need an I-601 to show how you'll suffer extreme hardship if he does not come to the US with you.

I also suggest you check the PI forums to see what needs to be done to take her daughter out of PI. If she is still legally married in PI, does the father have rights? Can she just take her daughter out without permission? Plus, if she is still legally married in PI, will that be an issue with the US government?

All these questions need to be answered before you do ANYTHING. Please consult the PI forum where there are more knowledgeable people about local PI laws

As someone with experience, her denial of entry will not be an issue. She'll need to declare it and be honest about it.

As someone who was also accused of silliness at a POE, as long as she told the truth and continues to tell the truth if asked about it, she will be fine. They can accuse her of anything they want but unless they gave her a misrepresentation charge she'll be ok (was there anything written in her passport?)

She'll have a difficult time obtaining another tourist visa. She has an overstay, a fiance in the US, and obvious ties to the US (perhaps lack of ties to Latvia since she travels to much to the US? What are her ties to Latvia? What shows she MUST return to Lativia?

Unless you have a criminal background, you only need the simple background check. As long as the background check is CPIC or a search of the national repository then you're good

I agree with what Inky has said. My husband and I have been together for 5 years this December. Out of those 5 years, he has been deployed, gone for training/schools more than THREE years. Being a military spouse is not any easier once you're living in the US. It's tough to be sure, and I miss him like crazy when he's gone but I knew what I was getting when I married a soldier.

Yes, this means that your I-129F petition has been approved. Your application Center was Texas and thus before they transferred it to CSC, they must have looked at your file/case and I am guessing in order to make things easy for CSC, which is back-logged, they must have pre-approved you from TSC itself thus making it easier for the CSC folks.

If you know for a fact you forgot to sign I recommend you try to find a way to send the signed new copy to them & catch it up to your petition...now I am not sure if this can be done, someone on here may say it can't be done. But it sucks to get an RFE after 5 months...that is where we are, after our 5 month mark, now on day 7 after the RFE email notice waiting to even find out what the RFE is for!
Won't tell us on the phone, told us it will come in the mail with in 15 days... :wacko:
So to spare yourself sadness later, maybe try to send it to them somehow...

Unfortunately you can't send a correction prior to getting an RFE because it will just get lost in the sea of paperwork at the service center. This is because they have no way of matching up your correction with your submitted petition (I don't know how or why, it is just how they roll). You'll just have to wait for that RFE to arrive after five/six months and send the correction from there. Once you get an RFE, and send your correction, it typically takes two to six weeks for you to get the approval if you did everything else right. Sorry to hear about this. It's silly that such a minor mistake can cause such a major setback.

The age of majority depends on what province your girlfriend lives in.

Alberta, Manitoba, Ontario, PEI, Quebec, and Saskatchewan is 18 years.
British Columbia, New Brunswick, Newfoundland, Labrador, Northwest Territories, Nova Scotia, Nunavut, and Yukon is 19.

So since your girlfriend is in BC, she must be 19 to consent herself to marriage. If she is younger she will need consent from her parents. Have you done all of your research on the K1 Visa and are you sure you don't want to wait another year until she is old enough to consent herself? You're both still very young, and this process is long, expensive, and difficult.

The success of filing for a second time depends on why they were rejected the first time. Often people get rejected for obvious things as iampatricias stated. Some more reasons why a petition may be rejected:
- Lack of evidence that petitioner and beneficiary met within the last two years.
- Lying on the forms.
- Petitioner is a blood relative of beneficiary or there is suspicion of relation.
- Not enough evidence of a bonafide, on-going relationship.
- Petitioner and beneficiary are married and not simply engaged.
- Petitioner and beneficiary engage in an activity that would qualify them as married (ie. having a wedding prior to the beneficiary arriving in the US with their K1 Visa even if no official forms are signed)

third, once petitioned, how long does it take from the first mailing of forms to actual visa to be granted?


When you first mail your forms, you should expect your Notice of Action 1 (NOA1) to arrive shortly. Most people get their NOA1s within two weeks. Some take up to a month. Once you get the NOA1 you start counting down the months until your Notice of Action 2 (NOA2). Presently, how long you have to wait for the NOA2 depends on which service center you get. At the moment, the California service center is around two months ahead of the Vermont service center. But Vermont appears to be moving a bit faster. So while no one can give you a guaranteed range of months, expect 5-6 months from your NOA1 to your NOA2.

It has taken more than six months for some people. There are some folks on this site at the moment who have been waiting over six months, some waiting over seven, and even a few who have waited for eight months or more and are still waiting. How fast you get your NOA2 depends, again, on what your service center is doing and whether or not your case is straightforward. It also depends on if you get an RFE (Request for Evidence) which will slow you down by a few weeks as well. So while we don't like to think about it, I do suggest that people filing for a K1 hope for a speedy NOA2 but also expect to wait a bit longer than normal for their case to work its way through the system.

Your fiance is the beneficiary, correct? Unless he plans to financially sponsor himself, then he will not need to prove his income. You will be the one who must prove you make enough to sponsor your fiance once you two get your NOA2.

I don't believe USCIS cares how long you've been in a relationship. The key factor they look for is if you two have met in person within the last two years. For some countries, having a relationship with the person for a longer period of time is extremely useful. But if your beneficiary is from a low fraud country, you don't have to worry about this much. Once you reach the consulate level after the NOA2, you will be required to prove that you two have an on-going and bonafide relationship. But in terms of how long you've been dating, I don't think that matters.

and at the present time i dont really have much evidince picture wise, i have pics that include both of us from only one occasion, but we do talk every single day. im thinking bout going back in june for couple weeks, so maybe i could take some more pics and what not, who knows we'll have a engagement ceremony maybe, but just incase i cant go, you think these will be proof enough..and we dont chat much online, there are only emails we exchanged on fb, which are in a diff language anyways, but like i said, we talk on thephone every day so no need for chat. but i tried to save as many text messages as i could just because i liked his texts..will those help also?


Anything that proves you two have a relationship will help your case. Again, when filing the I-129F you will need to be most concerned about USCIS seeing that you two have met within the last two years so for the filing of the I-129F, you should present flight ticket stubs, hotel reservation receipts, car rentals, etc.

You will need evidence of your on-going relationship at the consulate level. So if you have emails on FB print those out--consider getting them translated, get your photos together developed and date them, have your phone records where you called your fiance handy, send letters to each other and bring those, if you mail presents to each other bring evidence of that, save your text messages and print those out, save your flight ticket stubs and itineraries, save your hotel receipts, car rental receipts, receipts from restaurants, shops, etc. Anything to prove that you have gone to see your fiance and that you two are still communicating in a loving and on-going relationship will help your case at the consular level. Again, how closely the consulate looks at your relationship will depend on the country your fiance is from but people generally suggest having more evidence than you need just in case.
