If the baby is yours and you are a USC, you would likely not be filing for a visa because the baby would be born to an american parent and there for the parent is able to file for a CRBA (as long as the guidelines are met) and a US passport. The mother would need a K-1 if you are not married.

Iv seen people post on VJ that their K-1 petition was approved with no photos or only 1 photo.

I'm sure you have time in 5-6 months to gather more phone records and chats to include at the interview time as well as maybe an extra trip thrown in? (if you can afford that)

The USC applies for permission to Sponsor them.

The Beneficiary will be the person applying for the Visa at the US Embassy.



No not wrong, The USC sends the K1 - K2 application to USCIS. Then when the time comes they go to the interview for their visas. THEY themselfs do not apply for it.

To make things clear and also address questions in the replies...here is a bit more information:

1. Yes, once in Australia, the mom will apply for the K2 for her 10 year old daughter. My fiancee will, of course, be applying for her own K1 visa at the same time.



Um the mom can't apply for the K1 - K2... The USC who is bringing them to the US has to apply for the K-1/K-2.

You can apply for the SSC before you are married if you wish, just as long as the I-94 is still valid. I applied after I was married to get my married name on it instead of maiden name. Some SS offices are lame and make it a big deal to get your SSC but yes you can apply before marriage. Bring the passport with valid I-94.

Yes, that 'work authroization' stamp is no longer actually work authorized. Although it is still liberally given, it isn't an acceptable document as outlined on the I-9

Sorry - you cannot work in the US without your EAD or green card

Also when making your decision, k-1 visas are process in Vancouver and Montreal, Spousal visas are ONLY processed in Montreal. Something to think about

oh, and Montreal is terribly backlogged. Look at 8 - 14 months from start to finish of this process

Sorry, no way to obtain an EAD or 'work authorization' before you move to the US. If you move on a K-1 visa, you MUST have your EAD or green card before you work. Both of these require you to be married before you get it

If you are looking for immediate work when you enter the US, look into the spousal visa

Answer the questions on the form literally. If they ask for your name, don't list anything else but your name.

Unless you have a complicated case, the interview is fine, read the conlsulate reviews to know what to expect

K-1 is not work authorized. No matter what stamp you get in the passposrt, you cannot work on a K-1. The K-1 with a 'work authorization' stamp used to be able to be used, but the updated I-9 no longer recognizes it.

As soon as you enter the K-1 is no longer valid, visas are for entering the country and the K-1 is a single entry. The I-94 she gets will be for 90 days.

In short, regardless of what stamp you get, you cannot work unless you have a green card or a work authorization card

You are confusing F-1 with K-1

For an F-1 student visa, YOU, the US citizen, does not need to be employed. Nor do you have to have apply within 2 years of meeting her

The F-1 is a non-immigrant visa. Your girlfriend would have to apply to a US school, be accepted, and then begin the F-1 process. SHE would have to show how she can finally support herself while in the US (which can require her to show $20,000 in available funds per year - at least that is what it was when I applied in 2005). Plus she would have to show strong and compelling ties to China to show that she MUST return after the F-1 terms have been met

Now, are you looking into an F-1 student visa or a K-1 fiance visa, they are 2 very different visas

The ties they look for are a least/mortgage, job letter with an expected return date, utilities, car lease, bank account with sufficient funds.

If that is lacking use something like a doctor's apt. card, a wedding/graduation invitation, be creative

After the 2nd time I was denied, I attepted 2.5 weeks later and was admitted with HUGE scrutiny and was only given 2 weeks in the US. They refused me for lack of ties to Canada and I had everything I already listed and more, and they STILL weren't sure they'd admit me

PS don't you think if there was a way to speed up the process we'd all do it? barring imminent deployment to a combat zone, SERIOUS medical issues (as in one of you are on the verge of death) or extreme humanitarian grouns..uscis expects you to suck it up and wait

You need HEAPS of ties to Canada if they refused you because or lack of ties, more complex if you have a K-1 in proces

But I'm married now, GC holder about to remove conditions

All your questions about entrace are at the sole discretion of the CBP. They may let you in a day later or refuse you 3 months later
