Keep in mind, I do not mean to scare you, but people have been denied for having a 'ceremony' because the CO then assumed they were married and doubted the legality of the marriage.

Double check, in Canada a religious ceremony may be considered a legal marriage, thus nullifying your K-1 pursuits. Post on the Canada forum to verify

2 problems I see with your plan

1 - the K-1 is for a fiance, if you marry before the process is complete, you can start ALL OVER from the begining as you would not be able to enter the US as a spouse on a fiance visa - I am sure you can understand why

2 - part of the K-1 procedure is that you marry IN the US. Once the visa is issued, the beneficiary will enter the US, marry the petitioner within 90 days. The beneficiary (in this case...you) would not be able to leave the US until advanced parole is issued AFTER adjustment of status had been applied for.

Now, I am not even sure at the moment that you're July wedding in Canada can work under the terms of the K-1 visa

Have your wife file directly with the consulte, I am not sure how strict France is with the domicile issue of your wife (as in she MUST be living in the US prior to you going there...some consulates allow the spouse to travel with the beneficiary however) Montreal is very very strict about this.

The Cr-1 visa is the one you'll get, it allows you to work and travel right away

You must start the process with you still in France, if she decides she can go to the US at any time. You must interview and do your medical in France

YeaH, last time I went through the officer kinda just looked at me like I was a notorious criminal, and was shaking his head like, "alright, whadda ya trying to pull now mugsy." haha! I asked him if when they scanned my passport my mugshot came up and he said basically! So, I just told him that I know now how bad it looked last time and that this time I was prepared, and then he told me what I needed to do to make sure I could get through, and he told me I would go to secondary every time until I went thru AOS. Help!

I was just reading the visa application form, and there's a part where it says to state whether I've been refused entry to the US. Will I have to say yes if I "voluntarily withdrew" my application for admission to the US (they sent me home due to lack of ties) and also I have a previous visa denial....I'm freaked out as to how much this will affect me and if it could lead to a denial?? Does anyone have experience with this? my previous visa denial was an O-1 (artist work visa) and as i said, I'm not sure if I was "refused entry to the US" since it was apparently voluntary??? Please help me if anyone has gone through this. I'm one month away from NOA2 (well, hopefully....)

A lot of beneficiaries have traveled to the US while waiting for their petition to be approved by USCIS. If your fiance wants to make sure he's covered, he can bring evidence of ties to the UK. A letter from his employer stating when he's expected to return to work, on-going rent, on-going utility bills, and other documentation like that. Also have him bring a copy of the NOA1 as it is evidence that you two are trying to do it the right way and that you are aware of the process.

I've gone to the US from Canada to visit my fiance during this process and was not questioned any more than usual (ie. "Where are you going?", "How long?", "To see whom?"). Keep in mind that my trips to see my fiance were all short (under 2 weeks) and I've traveled back and forth to see him several times prior to filing. However, I'm sure your fiance visiting you in the US will be fine, just make sure he gets some evidence that he will return to the UK in case they ask for it. When I visited my fiance, I took the following as evidence of ties to Canada:

- A copy of my NOA1.
- A letter from my employer stating when I was leaving and when I was coming back.

It's worked out fine for me.

Thanks for the response, Linha87! Unfortunately, I can't rely on the embassy's list of translators because even though I'm a Canadian citizen I have a Vietnamese birth certificate. So what has everyone done for the certification by translator letter if you don't know the translator's name who's going to be working on your document? Am I just freaking out over a really minor thing?

How important is it that the translator's name be typed? Can I just leave that field as a line for the translator to fill their name in on? The reason I'm asking is because I don't know the name of my translator. The people I'm getting to translate my birth certificate will assign me some random agent so not even they'll know until I show up at the place.

Hello everyone, thank you for stopping by to read my message. Please help me out, my fiance (the petitioner) and I just received a noticed that we are approved to be forwarded to a consulate NOA2. It was a really great news for us because we have been waiting for months.

However we made a mistake on our I-129F application. We put down the wrong location for our interview, does anybody know how we can change our interview location?

Also is it possible to do your medical exam and interview at the same week? In my province (I'm from Canada) we don't have medical exam available, I would have to fly to a different province to get it done. I wanted to go to Montreal, Quebec but with some confusion my fiance wrote Quebec City, Quebec.

And one more thing, my passport will be expired May of 2012. Do I also have to renew my passport even though I will be approved this year?

I hope someone can help me out, I am really stressed out! Any suggestions would be so great and appreciated. Thanks and have a great day.

Anyway, I have sent him the guides on VJ which we will both ensure to follow correctly. I am abit worried that we only sent one photo of us together and 2 or 3 of him with my family. The photos were taken when we first met so I was abit shy taking more than one pic with him. I hope that doesn't affect our NOA2.


It shouldn't affect the NOA2 at all, they only need to see that you two met in person.

He should call the office and ask to speak to the immigration liaison that they have and see if they can do anything to help kick your case into gear. No harm in trying.

Please consider the fact that you may not have a green card for 6 months or so after you enter on a K-1. That is why a K-3, spouse visa can be advantageous. K-1 is faster, but you cannot work or go back to Canada to work. Your fiancee must make enough to support you and you cannot work legally until you receive a green card. Marrying and staying apart until the paperwork comes through is an option if work is necessary for you, but either way, he will have to travel TO YOU during this process. Expect 7-9 months for a K-1 and more for a K-3, from start to Visa. I know, you must be trying to figure out how this can be so hard, but it is. That's why we're all here, trying to navigate it more quickly and efficiently.


Hi, sorry you are giving out-dated information. K-3 is no longer being processed at the NVC, they will CLOSE the petition and continue ONLY with the CR-1.

The options for the OP are CR-1 or K-1.

so basically, my fiance in the U.S. files an I-129F. then within 90 days we need to get married in the USA. the problem is, whenever i choose to go back to the USA within the 90 days to get married, if i tell the border that is why i am going into the USA, they are not going to allow me in.
If i lie, i will get in, but once i get married, they will know i lied. i am supposed to go across the border to visit my friends and this just happened to be the weekend we went to the court house to do it? doesnt having filed the I-129F show premeditation to get married, and if so, then i am a liar at the border because of my intent.
and, all this aside, once we do get married, i have no problem going back to canada and continuing to visit every other month or am i allowed to stay and then get a job?


What the heck? did you even READ the guides or check the K-1 time line?

once you get the K-1 you have 6 months to enter the USA. After you enter you have 90 days to get married. YOU CANNOT LEAVE THE US AFTER YOU ENTER ON THE K-1 unless you have AP or green card.

You will have to either have him file a I-129F petition for fiance or a I-130 petition for spouse.

Spousal petition takes around a year.

Fiance is taking close to the same time frame.

I can give you an example, i'm from Canada moved to Nebraska in August 2009. I cannot go to school without a green card to the college or university. Ok so I get my AOS and green card done. Well I can go now but I will be paying NON-resident fees because I didn't live in Nebraska for 1 year. Well non-resident fees are expensive so now i have to wait a year and take some entrance tests after the year is past and then I can go to school with resident costs etc.

Time to do your research and figure out the requirements for your state and for your college/university's of your choice. The program I want to do is a 2 year program for 35k - its crazy expensive even as a resident!

VJ is a website for people to do this themselves. Most advise that it is bad to get a lawyer to help with papers because they have less time than you do, to check your paperwork and follow up with things if needed. Lawyers will make the same mistakes that we ourselves would but they would not check it as thoroughly as we would.

Print out the step by step guide and just cross off the items as you go, ask questions on VJ, use the example forms to help you fill it out and voila, save yourself 100s if not 1000s of dollars by not using a lawyer.

Don't forget, having an EAD or green card isn't a magical job getter. Depending on the state and your qualifications and how many applicants... you may have a rough time finding a job.. so after you wait 3-6 months to get your documents you may be waiting even longer trying to find a job after you get your documents.

I think you need to think about things maybe wait a little longer if you are not ready to get married and if you guys don't have the funds to do this right now it may not be a good idea.

If your unsure of being married than the CR-1 may not be right for you either.

My husbands copy just came from the court, had the signature and the stamp thing on it. We sent a photocopy with the original K-1 petition and he gave me the court paper to bring to the interview.

It will probably be different at the interview since its a different country but my interviewer looked at the one I had and the one we had in the I-129f and he compared the stamps and signatures etc. He then asked me if I knew about their relationship and their divorce then asked if I had ever met her.

No you don't need a valid passport of 5 years. You need a passport that has a valid date of 5 years or more. So you cant have a passport that has only 2 years of a valid date. Uou must have one that was issued that has 5 or 10 years validity.

Original forms means original signatures etc. If the signatures are not original then you will get RFE. If the form is a photocopy of someones hand written original form then it will get an RFE for the original.

That is an awesome rumor because Canada has an agreement like harpa says and there is no "applying for a B2" for Canadians. They just need a valid passport and an airplane ticket or a car and can go to the USA for a trip.

You need to tell these " some people " to educate themselves and stop talking nonsense about B2 visas being needed for Canadians to travel to the USA.
