Yes, I think the US CBP exactly think that. I think the US CBP have had MANY people misuse tourist, fiance and other non-immigrant visas so now they are very strict

Remember, there used to be a time when you married a USC then you were also automatically a USC, there is a reason why that changed. And that same reason is why the border is so strict now

The K-3 is an inferior visa, don't even apply for it. Your process can actually be slowed down by it. If you do marry, file for the Cr-1

1. No, but I'm not sure what country you are from to state even whether USCs are allowed in the consulate. Mine was with me but it really didn't make a difference

2. Tax returns should have still been filed, if the income is not met, cosponsors will be needed

3. 6 months generally, maybe shorter if a medical is about to expire, there will be an expiration date on the visa

Started to make my own topic but then saw this one and realized I wasn't the only one in this boat. We're MAYBE pregnant as well. I just visited my fiance less than a month ago. She just took one PT yesterday and it came back positive. I have no idea where to start our K1 was just started at the end of the month. She is currently the only one of us working and she is working on a work visa as a nurse. Once the hospital finds out she probably will get sent home to the Philippines. I told her she needs to take more tests to make sure she is or not. Since she is on a work visa can we get expedited? What do we need to do now? Besides the obvious pray I find a job soon. Do I need to inform anyone? Or just wait the process out? Please anyone help me we're both excited and scared at the same time. Thanks


Being on a work visa is not grounds for an expedite. Sorry, expedites are reserved for extreme or emmergent situations, or imminent military deployment to a combat zone, not for an expiring work visa and not for pregnancy

Your 18 day overstay is the reason for your denial. Once you overstay the VWP you cannot enter again on the VWP, you'll need to apply for a tourist visa

As someone who was denied entry...twice, it doesn't affect future visas. You may have to explain it and disclose it and be honest about it!

The G325A is submitted with the initial petition to USCIS.

You can't really add to the petition once it is submitted, it is more of a 'set it and forget it' type thing. You can send seomthing to USCIS but honestly they likely won't put in the effort to find your petition and match it with when you sent in. You can add additional information once you reach the interview stage but at a file of 300 pages, what more do you have to add? You'll want to keep your petition easy to approve, they already won't read your 300 page petition.

You want to focus on primary evidences like passport stamps, visas, etc

I can speak for Canada, it is a HUGE issue.

Part of what you have to prove is that you are a resident of the US, not just a citizen, that will enter with or before your fiance. Simply saying 'take my word for it' isn't going to fly

in Canada, they are really really strict about it, US citizens interviewing in Montreal need to have a job and a home lined up in order for the visa to be issued. I am not sure what the consulate in MX will need

The DCF route requires you to be a legal resident for 6 months before applying through the consulate, you cannot simply fly to Columbia and then file DCF

Looks like Cr1 filing from the US is your route.

When your petition is received, it is assigned a bar code. The bar code is swiped everytime the file is handled, whether it be if the file is counted, moved, or placed on an adjudicators desk

So don't put too much weight behind a touch, it doesn't mean anything, they could have simply moved your file from one filing cabinet to another due to a leaky pipe

Actually, the Cr1 does not allow for legal citizenship right away, it allows for legal conditional residency.

You take her to Vegas, you get married. However, she MUST return to Canada.

She may visit, as a Canadian, for up to 180 days. However, she will need to return to Montreal for the medical and interview. SHe can visit for that amount of time, if admitted, during the Cr-1 process

It is not cruel, it is the rules. You have no right as a US citizen to bring a foreign wife to the US. This is why there is a process and steps that must be followed to ensure it is legally acquired.

4-5 months is the estimate for USCIS only, then count on another 1-3 for NVC and then another 1-4 for Montreal to book her apointment. So, look at 8-12 months in total. It took us 10 months start to finish

LOTS of people visit during this process. But like SandP said, bring LOTS of ties to Canada

I was denied entry twice, best thing to do is to disclose EVERYTHING - espeically since you admit you already lied to them.

Keep your visa easy to approve by telling them everything, it won't have a bearing on the visa - just like it didn't for me. The CO simply laughed, pointed at my husband and said "wanted to see him I guess"

Keep in mind, I do not mean to scare you, but people have been denied for having a 'ceremony' because the CO then assumed they were married and doubted the legality of the marriage.

Double check, in Canada a religious ceremony may be considered a legal marriage, thus nullifying your K-1 pursuits. Post on the Canada forum to verify
