K-1 Fiance(e) Visa Process & ProceduresProof of Affidavit of Support when Petitioner works with the US Air Force

Thank you so much for the quick response Inky. This helps a lot :)

I was really nervous about the I-134 and evidence as well because military taxes and LES are different and I was scared they wouldn't be able to read it correctly.

My husbands taxes show much less than 125% but he makes well over, its because of the deployments being non-taxable. But they know how to read and match up the LES and the W2s etc.

At the interview they did ask me a little about his job, just don't give them too much info. Sometimes its a test to see how much you will talk about it when you aren't really supposed to.

K-1 Fiance(e) Visa Process & ProceduresProof of Affidavit of Support when Petitioner works with the US Air Force
USAF military orders are only needed if he is deploying to an active duty combat zone and you are requesting an expedite.
Statement of service is a good idea not really needed tho.

Tax returns and W2 yes.
LES stubs for the last few months leading up to the interview.

- When I went to my interview for K-1 with my husbands affidavit all we brought were

Tax returns with W2s for the last 3 years including most recent

8 LES pay stubs.

Thats all, and I was approved for the K-1.

K-1 Fiance(e) Visa Process & ProceduresVaccinations
Correct if there is no record they will make you take all the shots and give you a record of you having them.

UNLESS! a titre test is requested. If one of thos is done they can check from the blood work what immunity the person has and that would determine if they need the shots or not.

Most people opt to just have the shots done because it takes less time than waiting on blood tests.

K-1 Fiance(e) Visa Process & ProceduresVaccinations
You only need the first of the series.

You must have the next set and proof from the civil surgeon when applying for AOS.

Already did this, Had to get the first shot of HPV, but by the time I was applying AOS they made HPV non-requirement so I didn't need to finish the shots.

K-1 Fiance(e) Visa Process & ProceduresNOA1 Question
They take the checks out and put them in a safe then send the petition to the VSC or CSC.

The checks get picked up in batches and the petition is put back in the mail to the correct processing center. Then they have to get it out of the mail and open it and assign it to a case worker. Then that case worker will start it when they get to it.

K-1 Fiance(e) Visa Process & ProceduresRejected Tourist Visa
I wouldn't because there is really no need to. They want to see that you met in person. Not that you tried and got stopped, its already going to be in the files when they do the background checks anyways so they will see it. It doesn't hurt the petition that you had a rejected tourist visa it just isn't evidence that they want to see.

You will get an RFE and have to send it in. If the RFE is not responded to in the time given they will close it.

No it would be the address you are going to be processed at. VSC or CSC.

That is no longer needed because everyone sends to Dallas lock box to be sorted out. You can omit the address of service center from the cover letter.

K-1 Fiance(e) Visa Process & ProceduresWho do i contact? Visa pick up
VJ always says do not plan anything until the visa is in your hand.

With Montreal it is never enough time. It is frequently referred to as the Black Hole.
The Canada section on this forum has many pages of posters that have had to wait quite a while to get their passports back from Montreal.

DOS = department of state.

K-1 Fiance(e) Visa Process & ProceduresWho do i contact? Visa pick up
You call DOS to ask them if the visa is printed. If they say yes then ask them if the visa is out for mail/picked up by DHL for delivery.

You should not have made any travel plans until you had the visa in your hand. You will not know if something on it is incorrect and needs to be fixed before you leave and you do not know if it will take long to get your visa out of the consul.

K-1 Fiance(e) Visa Process & Procedureswhen to get SS #?

Thanks for the info. If she would have gotten the SS # based on her I-94 when she first came in would that number change once the AOS was filed, or become void? Just curious.
I appreciate the help!

An SSN number is one number for your life. It does not change.

K-1 Fiance(e) Visa Process & ProceduresAffidavit of Support I-134
If you don't meet the 125% and have a co/joint sponsor that meets it then you have no worry about yourself not having savings. Thats the point of having someone help you by being a co/joint sponsor.

You would only use savings if you have no one to help you out with sponsoring if you were trying to do it all on your own.

K-1 Fiance(e) Visa Process & ProceduresCanadian to apply for a K-1 with a concern about the Affadavit of Support
You don't send the I-134 anywhere but to the beneficiary with all the supporting documents. So the USC would be sending it to you! after he gets the NOA2 in the mail.

Then YOU(the Canadian) bring it to your interview in Montreal.

The I-134 is a required document not a requested document.

Edit to add this for you.

Have a good read of the flow chart it should help you understand a lot more - http://www.visajourn.../content/k1flow

P4 is the official interview letter that you use to get into the consul. Just says you have an interview date for K-1 and the time and date.

It depends on the consul and what they request you do. Email confirmation printout or snail mail confirmation. Either way you need to bring it to the consul or they do not let you in.

K-1 Fiance(e) Visa Process & ProceduresWork related questions
That link says yes to volunteer work not unpaid internships.

Yes you can volunteer. There are many places that you can volunteer at that are not in any position to pay someone to do the job.

Its the unpaid internship that is in question because if a USC can be hired for an internship that is exactly the same or be hired for that job and be paid for it, thats where the danger lies.
Your key word also " technically " would you want to risk everything?

Companies in the US have to look at all USC candidates before hiring a green card holder or EAD holder.

It was not accurate at all for us.

It is an estimate time of everyones personal input VJ timelines. Some people don't update their timelines and some people don't even fill them in. It also does not include any of the 1000s of others going through the process not on VJ.

K-1 Fiance(e) Visa Process & ProceduresBorrowing Money for Affidavit of Support

Are you assuming that, or have you read that?

Granted, you are talking about minimum, $54k+ ($18K X 3 yrs)= $54k, but I have not read anything that states the funds have to be seasoned etc.

Its been said many times on VJ before by seasoned VJ members. Not to mention the fact that the papers ask for supporting evidence with the I-134.

K-1 Fiance(e) Visa Process & ProceduresBorrowing Money for Affidavit of Support
You cant just put money into an account and use it for the affidavit of support. It requires proof of being there for a long time. Money that just appears in a brand new account or in an old account is not going to count for the requirements.

You have to have the EAD card or the green card, your I-94 is going to expire too soon to use it to get an SSN with it.
If you have your actual EAD card you can go apply for the SSN with it.

Online address change and a mail-in address change. You also need to call if you have a current petition pending.

If they are RFEing you for more relationship evidence it seems like you forgot to send any evidence from between the visiting. Keeping in contact throughout the whole thing not just being in person together.

What exactly does the RFE request?

K-1 Fiance(e) Visa Process & ProceduresVisa Expiration
You can call DOS and ask them if your visa has been printed, if it has not then you do not need to worry about it expiring, then you need to ask them if you are in some kind of extended processing and they should be able to tell you if you are.

You will probably get a better answer from calling DOS than calling/emailing the embassy.

K-1 Fiance(e) Visa Process & ProceduresLost US Passport, applying for K1 visa
Look all over for it, if you really cant find it and believe it to be lost, you need to report it.

After that apply for a new one.

You can use your birth cert as proof of US citizenship in lieu of a passport. Passport stamps are very helpful but not everyone gets a stamp in it when they travel eg traveling to and from Canada, my husbands US passport was never once stamped. My Canadian passport was only stamped twice in 50+ trips.

K-1 Fiance(e) Visa Process & ProceduresHow to send my I-129F?
1 large paper clip holding it all together with a contents cover on front, in a mailer that fits your stack of papers.

You need nothing more than that. They take it all apart and organize it in their own folders in their own order.

K-1 Fiance(e) Visa Process & Proceduresexpedite info (help)
For your situation the only thing I could think of for proof would be affidavits from your friends that you are getting food from. From people who saw or were part of when you got kicked out and had your money taken. From The petitioner and from yourself stating the situation.

The only issue with that is affidavits do not hold much weight with USCIS. But no harm in trying it, the affidavits will have to be written very well by the people submitting them to you for proof to send to USCIS.
InkyFemaleCanada2011-05-29 14:09:00
K-1 Fiance(e) Visa Process & Proceduresexpedite info (help)
You have to contact USCIS and request an expedite, they will ask for proof. You must provide proof of the situation then wait and see if they will accept it and grant the expedite. 9x out of 10 they do not.

No harm in trying tho.

K-1 Fiance(e) Visa Process & ProceduresQuestion on proving Domicle

Oh i though I had to prove it, like prove where I would be living when I get to the states. So the petitioner does nnot need to prove where they live with liek a renters lease or anything ?

Nope not unless they are living in Canada with you. If he is living in the US then its fine you wont need a lease or anything.

If you want -
When it comes time for AOS after you are in the USA and married. You can have the friend write up a type of lease to say that you both live there etc as some proof in the AOS package.

I visited the US while waiting on K-1. You absolutely can visit the US while waiting on visa process.

K-1 can be expedite if you are in the military and deploying to an active duty combat zone. Other then that its pretty hard pressed to try and get an expedite, iv also seen people denied expedite with proof of military deployment.

There is no legal citizenship on marriage. You have to wait and follow the lines. Citizenship will be a 3 year wait starting only when she has the green card.
