K-1 Fiance(e) Visa Process & ProceduresIs w2 and 1040 the same?

How many pages is the tax? Do I need his tax for the last 3 years? Thanks for the quick reply.

He should know how many pages it is if hes filing his taxes! he could always order a tax transcript from the IRS for free too and send that instead of all the pages and w2.
I just ordered transcripts online for 2009 and 2010 and they arrived in about 4 days. He could also have them faxed to himself if he has access to fax machine.

K-1 Fiance(e) Visa Process & Proceduresi-134 help!!

yes, but will there be a problem because when showing income, the bank account is not in her name... and they are asking for bank information such as when the account was opened, total income on the account for the past year, and the present balance.

You do not need to fill that in, it is not required. Bank account does NOT matter unless you are using a large sum of savings to sponsor with.

You are using income. You would be using tax returns with w2 or transcripts. Paystubs for the last few months leading up to the interview. A letter from the employer.

Please see the example form if you are concerned. http://www.visajourn.../Form-I-134.pdf

We NEVER used any bank info at all.

Bank account doesn't matter. Its the INCOME that matters for sponsorship.

K-1 Fiance(e) Visa Process & Proceduresaffidavit of support with co sponsor
You are petitioning and sponsoring. You must send an I-134. You cant not send one.

Sending the I-134 now is a big waste. You will have to redo it all and send it again when you get the NOA2.

I-134 and supporting documents must be dated and signed as close to the interview as possible.

K-1 Fiance(e) Visa Process & Procedurescurious about suspicion at the border
Most border guards know NOTHING at all of the process. They are not properly educated on it, and most of the time they give 100% wrong answers about it.

When I crossed with my K-1 my POE only 1 of 15 border guards (that were working at the time) had done a K-1 and it was so many years ago they couldn't remember how to do it.

K-1 Fiance(e) Visa Process & Procedureshow to predict where the application will be forwarded

I thought this information didn't apply since a while back... which is why I raised my question.
Anyhow, we shall see in a couple of days where my application ends up.

Thx

It still applys, the only difference is that you are not sending it to thos places anymore. Everyone sends it to the new sorting facility in Dallas instead. Its to help save the inbox from backing up in VSC and CSC.

K-1 Fiance(e) Visa Process & ProceduresGot NVC case num - now few questions

1. you can call the embassy and ask if they have encoded your case into their system already.
2. just wait for the packet, i dont think personal pick up is allowed :)
3. yes, pay the visa fee in advance.

have you finished medical exams already?

Most of the time you cannot have the medical before you have packet 3.

Most embassys have different methods of giving out packet 3. Some have to be picked up, some are mailed and some are available online.

You pay the visa fee when you are requested too by most embassys. Not just "whenever in advance" But it is usually requested in advance and requested to be payed at a certain location or through a certain web-portal.

Almost all embassys will not pick up a phone and most have NO phoneline at all. Only email or fax contact which is almost never answered. The best way to get information when you are at the embassy stage is to call DOS.
InkyFemaleCanada2011-04-26 22:25:00
K-1 Fiance(e) Visa Process & ProceduresGot NVC case num - now few questions
Call DOS and ask them if the embassy has the case and has logged it yet.

After its been logged they send packet 3 or the beneficiary can pick it up (depending on what the embassy does for that part)

K-1 Fiance(e) Visa Process & Proceduresprocess for K-1 visa!!!! help!!!
Suggest you check the guides.

You have to leave the USA if you file the K-1 or the CR-1. You have to get documents from Canada and have a medical and interview in Canada.

K-1 gets a work permit after applying for AOS which is a long way after the K-1.

CR-1 gets the green card a few weeks after entry.

This is all explained in the guides.

Here is the comparison chart. http://www.visajourn...content/compare

To see the guides for full steps click on the guide button and select the guide you need.

If you rather marry and then apply for AOS inside the USA you can do that too. With that you would apply for I-130 and I-485, fill out all the paper work for both of thos and attach all supporting documents for them and send them together in the same package. With two separate fees.

Your fiance has to sponsor you and must meet 125% of the poverty guidelines regardless of what rout you take.

K-1 Fiance(e) Visa Process & Proceduresmoving?
If its the USC they would go to the USCIS website and fill out a change of address form then call USCIS and notify them on the phone as well.

If its the foreign person then they would have to call USCIS and notify of the change of address because if they are not living in the USA it seems you cant fill out the forms. (unless they fixed it recently) Because the forms ask for state and zip codes etc.

Make sure to sign up for mail forwarding so the mail will be forwarded to the new address for a while.

K-1 Fiance(e) Visa Process & Procedureswhat exactly is the medical exam?
Yes there is blood tests. They do drug tests.

There is xray / TB skin tests.

There is a physical check up there is a questioning, there is a vaccination check and if you are missing any they have to give them to you.

Its an medical exam to see if you are mentally and physically healthy. That you are not going to spread disease to Americans/other people.

K-1 Fiance(e) Visa Process & ProceduresNot allowed to submit K-1 at Vancouver Consulate.
Nope, all you go to the consul for is the interview. Nothing else!

You could have your medical in Vancouver and go to Montreal for the interview.

I'm not sure about you having to use Montreal because your not a PR or such.

One time trip for the interview, although you will somehow need to get the medical done too. So maybe two trips, but that's it.

Medicals in Canada can be done in Vancouver, Toronto or Montreal. The OP would not have to make two trips.

K-1 Fiance(e) Visa Process & Proceduresmy permanent resident cart will expire, how to renew?
You don't renew a 2yr card, you have to send removal of conditions for a 10yr card.

You are going to need 2 years of proof of a commingled married life.

You file jointly, you both go to the interview, the fee is 590$.

Follow the guides and the instructions.

If you dont find out why they denied your K-1. They will likely deny the CR-1 for the same reason.

Find out what was the reason for denying and then move ahead from there.

K-1 Fiance(e) Visa Process & ProceduresChecking status of K-1
Why can't you, its a 1-800 number for USCIS.

I called them from outside of the USA.

You can also call DOS to get information on your case, I also called them many times from outside of the USA. They often gave me more information than USCIS did.
InkyFemaleCanada2011-05-03 20:44:00
K-1 Fiance(e) Visa Process & ProceduresChecking status of K-1
Some people never see their status online. Most of the time if you can access it, its not updated correctly or its not updated at all.

Status checking is not reliable. The best way is to call or wait for physical mail.

The Status Checking is not a requirement for USCIS. It is a courtesy offered by them.

K-1 Fiance(e) Visa Process & ProceduresImmigration service recommendation please
You will not find someone cheap. They are lawyers.

You can do it yourself cheaper. This website is a self help website. It has all the guides and information listed as well as links and you can post questions if you have them.

Unless you or the beneficiary have some kind of criminal history or drug history or anything that may be considered a red flag. Save yourself thousands of dollars, screw ups, and time and just use VJ to file your papers etc.
A lawyer does not have the time that you do to check things over and make sure everything is there and correct. There are many posts on this forum about how badly lawyers messed up and caused huge issues or very long delays even getting paperwork denied.

K-1 Fiance(e) Visa Process & ProceduresGetting Married Before Entering US on a K-1
You cannot AOS from the K-1 if you marry in another country after getting the K-1.

The requirement of the K-1 is to marry in the USA. Filing for AOS requires a marriage certificate. You will not be able to adjust status from the K-1 with a non US marriage certificate.

Cancel your K-1 like the other poster suggests and marry in the UK like you wish to and then start all over again with a CR-1 Visa petition. That will take around a year.

Or you can continue with the K-1 and marry in the US as you are supposed to. Then have a large wedding celebration or vow renewal in the UK at a later date, after the green card is issued and in hand.

K-1 Fiance(e) Visa Process & ProceduresExtensive Background Checks at USCIS
:(

That really sucks, hopefully the USCIS background checks wont be as long as AP from an embassy can be. AP at the embassy stage can be as low as a few weeks or high as a year or more.

Yes you can use copys, you don't really send any original evidence with the I-129F. The originals should be brought to the interview.

You can include pictures yes, there are people on VJ tho that have not included any and been approved.
If you have a very tough embassy to go through I would include pictures.

Depends what country and if you need to front-load the petition or not really.

K-1 Fiance(e) Visa Process & ProceduresProof of Affidavit of Support when Petitioner works with the US Air Force

Thank you so much for the quick response Inky. This helps a lot :)

I was really nervous about the I-134 and evidence as well because military taxes and LES are different and I was scared they wouldn't be able to read it correctly.

My husbands taxes show much less than 125% but he makes well over, its because of the deployments being non-taxable. But they know how to read and match up the LES and the W2s etc.

At the interview they did ask me a little about his job, just don't give them too much info. Sometimes its a test to see how much you will talk about it when you aren't really supposed to.
