I messed up both my parents' location of birth on the G325A, it was a non issue. It is simply for statistic and has no bearing on your I129F

Correct it on the Ds230 and it will be fine

Medical cannot be done in the US, it will have to be completed in her home country by an approved doctor

You can delay sending any documents back, however that will just delay her eventual return to the US

Look at the guide, see what is recommended you send in and compare it to what you actually sent it

It was vital you showed primary evidence that you had met in person within the last 2 years...did you do that?

And again, were you both free to marry when the petition was SENT in?

If you marry, you cannot file the I-129F alone. You must follow the guides for a spousal visa

Well, you can't get married and "ask" for a K-1. Married is married and you can't 'ask' for a fiance visa after that.

No asking involved, you petition and then apply for a visa. If you marry it would be a Cr-1 visa

Maybe it is simply procedural, like you used the wrong form or there is information missing. But until you get the actual reason for denial, there is nothing you can do. If the reason for denial is simple, the just correct the mistake and file again

The only other thing I can think of, were both of you free to marry when the petition was SENT?

This is something I never even thought to worry about when my fiance (then boyfriend) visited on his tourist visa on three separate occasions. I thought visa meant you're allowed in, but it appears that's not the case? Is there any way you can go down to see him instead, just to be safe?


All a visa allows you to do is apply for entry, it does not guarentee admittance

Which is why the tips I gave should be helpful for everyone

Remember, lots of people visit with zero issues

It is possible and it does happen. I was denied entrance to the US twice and sent back. It is because I didn't convince the CBP that I had ties to Canada with a significant other in the US - I couldn't prove that I would retrun to Canada

So, that being said, what can your SO show to prove that he'll return to MX? They are looking for things like a job, a lease/mortgage, enrollment in school, substantial family ties (ie - kids in MX) etc. What does he have?

Now, I had a return ticket myself, still wasn't enough. If they suspect he could illegally immigrant (use a tourist visa for immigration) then they can and will deny him.

Now, lots and lots of people visit with zero issues. I just want you to be prepared and have him prepared so what happens to me doesn't happen to others. Strong ties will help, so will a copy of your I129F packet showing intent to return, at least for the interview, as well as be polite and NEVER lie.

I was denied entry twice, although you MUST disclose it (if denied, you didn't actually say if you were admitted into the US) it won't be an issue for the K-1

Was anything written into your passport? What did the forms say that you signed?

If she has temporary status until 2014 pending a decision, why not simply suggest that? As long as she has not been sent deportation orders, her temp status shoudl still be legal.

I do not believe there is a reason to explain anything, why not simply copy the document and have your fiance explain the situation, as it is HER situation, on a written, notarized document and return it to the consulate

That is the same with USCIS. Sometimes adjudicators work faster than others, sometimes they get bogged down on one case for a while and can't or won't process any others until that one is done, so the people waiting behind them get stuck in the queue.

It is no one's fault, it is just the same as waiting in line at the grocery store, sometimes you get a super quick check out, sometimes you get stuck behind the old granny counting coupons and paying in pennies

Yes, you can visit with an I129F pending, about to be pending, or thinking about to be pending.

THere is no guarentees that you'll be admistted, as there never are

To help, you should NEVER lie to a CBP and carry strong ties to your home country

She can file the I129F now if she likes, regardless of when she petitions for you the issue of you visiting is still the same, never lie - no guarentees - carry strong ties

Obviously if he is a born citizen there won't be a 'certificate of citizenshp' Those are for naturalized citizens. The instructions on the 129F tell you what is sufficient for proof of US citizenship - US passport is fine

I134 is not sent to USCIS, yes it does need to be filled out but you must wait until it is requested. Sending it to USCIS just means you'll have to do another one when it is requested

No, the more info you have doesn't make it any quicker, you'll just have to wait - which i know is the hardest part

You'll book your medical - there are only 4 doctors in Canada you can go to, one in Vancouver, 1 in Toronto and 2 in Montreal, not sure where in Canada you are but yes, it HAS to be one of those doctors.

What helped with my wait, which was 10 months from start to finish, is to stay busy. We had been apart before so staying busy helped the time go by quicker and there is no way my husband would have put up with me being a miserable lump during this process

Once you get the fiance visa, you fly to the US, get married there and you stay there to file for Adjustment of status. Leaving after you activate the Fiance visa is not good, because you will not be let back in.
