K-1 Fiance(e) Visa Process & ProceduresPolice Certificate from Canada & I-129F expiration

Hi there. Thank you for your reply. Yes. I've heard of the postal strike. It was regional but it didn't matter because Canada Post locked out all its workers 2 weeks ago. So, there was zero mail since June 14 throughout the entire country! :o But it's over now, isn't it? Hopefully, they get the backlog completed soon!

Yes my mother is getting mail since yesterday at her home in Canada.

K-1 Fiance(e) Visa Process & ProceduresPolice Certificate from Canada & I-129F expiration
Police cert is good for 6 months from the date of issue.

Its a shame you couldn't go in to get it in person, I walked out with mine same day.

Embassy extends the petition automatically once they have it.

K-1 Fiance(e) Visa Process & ProceduresDS230 Form
The interview is all about you the beneficiary, so the questions and forms are all information about you and your family, the beneficiary. If it was meant to be the USC they would have you fill out two separate forms.

Edit to add the example form which is found on VJ in the example section. http://www.visajourn...Form-DS-230.pdf

Originals need to be brought to the interview. Copys are fine for the initial stages.

I was asked questions at the interview about my guys previous wife and divorce. They looked at both the photocopy and the original comparing the stamps etc.

K-1 Fiance(e) Visa Process & ProceduresNOA2

NOA2 could be an RFE - it just means second notice. One more example of why NOA1, NOA2, etc. should not be used and Receipt Notice, Approval Notice or RFE Notice should be used.

Its common knowledge that NOA2 is used as approval letter and RFE Is used as request for evidence.

If you don't like it then don't post or find another forum.

K-1 Fiance(e) Visa Process & ProceduresNOA2
An NOA2 is a notice of action just like the NOA1, the NOA2 is the approval letter.

You have an RFE, they want more evidence from you because you did not supply them with enough. You will need to wait for your RFE to arrive in the mail and then mail back everything that they are requesting.

You will want to look over your papers and see if you can find what you forgot to send.

Your brother did not sign and date that, the 5 red circles indicate the missing parts they are requesting. Your brother also needs to provide evidence of income that shows he is above the poverty guidelines to support you.

K-1 Fiance(e) Visa Process & ProceduresTourist visa after fiance visa
Generally your tourist visa is canceled when you get the K-1. You can only enter once and 99% of the time the CBP will activate the K-1 on entry so you have no option but to use it.

There have been very few cases where a K-1 was not activated on entry from even Canada.

K-1 Fiance(e) Visa Process & ProceduresI-134 ( affidavit of support problems)
you need the tax returns and w2 or you need to get tax transcripts from the IRS.

You need as many pay stubs as you can give as close to the interview as possible.

The co-sponsor needs to provide the same evidence as the sponsor, but she needs to make enough to meet 125% for the house hold guideline. if its ust her and 2 kids then she would be a 4 person house hold including the immigrant.

You would be a 2 person house hold.

K-1 Fiance(e) Visa Process & ProceduresAvoiding possible RFE?
Do not send anything unless you get an RFE letter in the mail.

RFEs come with a special paper that you have to return with the evidence so that the evidence reaches your case. Without this whatever you send will likely get tossed out or never reach your case and get lost in the massive mail jumble.

K-1 Fiance(e) Visa Process & ProceduresSeriously No Approval Still ????
VJ makes up a tiny portion of the actual filers. Just because no one came online and reported that they were approved or no one that was using VJ was approved does not mean that VSC did not have any approvals at all.

VJ is not the entire world there are 100s of thousands of people that do not use VJ that are at VSC.

K-1 Fiance(e) Visa Process & ProceduresI need advice for K-1 visa
Why would you do a K-3 visa? A CR-1 is cheaper and gets her a green card on entry. Not to mention the fact that k-3 is pretty much obsolete now.

She doesn't have an alien number yet until the papers are filed and you start the process you would put N/A for that.

If you marry in her country you can have another second ceremony in the USA. But you would have already been legally married in her country.

You can do the K-1 and get married in the USA when she gets her visa and then after you apply and get the green card you can go back and visit her country and do a ceremony there if you want.

Many people do it either way.

Do you know about the medical fees before the interview? and the 1070$ AOS fee when in the usa?

You may want to do your research.

K-1 Fiance(e) Visa Process & ProceduresMRV FEE SAME AS USCIS FEE???
Its a visa fee you have to pay it or no visa. Everyone pays 350$. Its not refundable either if you don't pass the interview.

You either pay it now online with credit card or pay it when you go to the interview. No way around it.

K-1 Fiance(e) Visa Process & ProceduresPossible to use B1/B2 when K-1 has been issued?
Yes other visas are canceled when the K-1 is issued. Also if she has to go through the US they may not let her through without activating the K-1 anyways.

http://www.visajourn.../content/k1flow

If your interviewing in Montreal it will be slow, I would suggest getting the package yourself from the website because the mail from them is not really reliable.

After you get the approval in the mail call NVC and get the case number from them then wait a week and call DOS and ask about your case if they said they have it and sent packet 3 get it off the internet and fill it up collect the stuff and send it back.

You need to sign up online to book your DHL location as well as your interview. This is done after you send packet 3 back and after you know that packet 4 is logged and sent.

K-1 Fiance(e) Visa Process & Proceduresk-2 question

Please understand me the way I understand you the first time you stated that. I DON'T WANT HIM TO BECOME A US CITIZEN DECIDING FOR HIM!. I want him to decide if he wanna preserve mom's nationality or his dad's. Since I'm not pursuing the american dream... I'm sorry but not all people want to become USC as I don't want to, and I don't want to decide for my son!

Yes I get that but i'm telling you that the baby CANNOT MOVE TO THE USA ON A VISA if the child has claim to US CITIZENSHIP. Thats the fact. If the child has claim to US CITIZENSHIP they REFUSE HIM A VISA because he is a USC. Then he has to apply for US PASSPORT to enter the USA.

Maybe it is in your best interest to stay in your country until the child is older and then decide if you want to move to the USA.

K-1 Fiance(e) Visa Process & Proceduresk-2 question

He does, but I DON'T want him to, is it mandatory or so??

He cannot use a visa to enter the USA. He cannot move to the USA without the US passport because he will not be granted a visa.

K-1 Fiance(e) Visa Process & Proceduresk-2 question
A baby born to a USC who has claim to US citizenship cannot be granted a visa. They have to file CRBA and get a US passport.

You need to find out if the child has claim to US citizenship.

K-1 Fiance(e) Visa Process & ProceduresK1 and US citizen child
You cant bring him with you unless he has his US passport.

You apply for CRBA and the US passport when you get it you show the consul and they issue your visa. When you get your visa and passport back then you can travel with your child to the USA.

K-1 Fiance(e) Visa Process & Proceduresemailed form 1040

Is it W2 that has to go with the tax transcript or the recent paystub that can show the recent income? I am confused because W2 and last year tax return shows the same information about the previous year’s income. Since you claim your recent income on the I-134, you should have to back up with some sort of documentation and that is current paystub and letter from the employee. If I am wrong, please let me know.

Thanks and Good Luck

Transcripts from the IRS you do not need a W2 with.

Tax Returns you must have all pages including the W2.
