K-1 Fiance(e) Visa Process & ProceduresK-1
You should send exactly what they ask for. You need to wait for the RFE form to figure out what they are looking for

Nothing to do now but wait for the RFE to come in the mail and respond to it.

K-1 Fiance(e) Visa Process & ProceduresVisa for minor child
It doesn't matter whether you think the father was active enough in the child's life, he still has rights to the child. Like Payxibka said, without a court order or consent there is nothing that can be done

I am sorry

K-1 Fiance(e) Visa Process & ProceduresMarry US Citizen but not Apply for Permanent Residency
A. Not worth considering. Entering as a tourist with intent to adjust status is illegal. It is called 'immigration fraud' and can carry a lifetime ban

B. you don't need to become a US citizen with a K-1, it allows you to enter the US, marry and adjust status to a permenant resident

C. R1 sounds good, if you qualify

Nothing about immigration is fast. You'll have to put in the paperwork and wait. If you really don't want an immigrant visa then the R-1 visa might be best

If you are set on marrying in PI, then the spousal visa is your only option. A fiance visa means you will have to marry in the US

K-1 Fiance(e) Visa Process & Procedureswhats the fastest way to get in USA
umm...ok...well how do you want to get to the US? As in, under what circumstances do you wish to come?

Love?
Student?
Work?
Visitors?

Your post is exceptionally vague, you will not find answers until you give us more details

K-1 Fiance(e) Visa Process & ProceduresDidn't meet in person
No, USCIS will not approve your petition. You have gotten the right answers and advice. USCIS will keep the filing fee, you will have to meet and then refile

Good luck

PS - unless you included VERY compelling reasons why you two did not meet, there is no chance your petition will be approved

K-1 Fiance(e) Visa Process & Procedurescan i apply for a new visa if my k-2 visa is not approved yet?
For a visitors visa, your uncle does not apply for you. YOU apply for you

Yes, you can apply for a visitors visa. However, expect it to be denied with a pending K-2 from Ghana - you clearly have immigrant intent

Good luck

K-1 Fiance(e) Visa Process & ProceduresStill no NOA1 Notification received...
I've seen NOA-1s take up to 60 days. Calling USCIS is useless so don't even bother

You NEED to be more patient, this journey is stressful enough without unrealistic expectations and timelines

No, you cannot put NO to the arrest question. He's been arrested and it needs to be documents on all the forms regardless if the record is clean - failing to do so can ban him for life for misrepresentation

K-1 Fiance(e) Visa Process & ProceduresWould a Cruise Wedding violate our Visa?
Don't even bother with it. Do not have him leave the US without AP or GC. Too much riding on it. If a destination wedding is what you want, think Hawaii or Puerto Rico.

And Bahamas and Mexico are other countries. To land in one means he's left the US - a K-1 visa is single entry, he won't be able to return even if you are married

K-1 Fiance(e) Visa Process & ProceduresIs it possible for my fiancee to Submit I-129F to USCIS even we have not meet yet???

It is possible to send I-129F now even you guys have not met in person yet BUT you will get an RFE for that or worst case is they can deny it cos the main requirement for I-129F is you guys have met in person within the last 2 years before the filing.

Here is the guide in filing I-129F http://www.visajourn...content/k1guide

The bolded is the most important. You cannot file now, then meet, then respond to the RFE. You must meet BEFORE the petition is sent

Yes, there is a problem with coming over on the visa waiver program and adjusting status. It is call visa fraud

K-1 Fiance(e) Visa Process & ProceduresK1 application process: I have a few questions please!
Is it advisable I pick up a contract/temp job before we start the K1 process or would I be good to start the process now, considering my level of savings and being able to explain the reasons behind my choosing to not start new employment, until my fiancée and I had decided which country we'd like to apply for?

Since it sounds like you are the beneficiary it doesn't matter whether or not you have a job or how much savings you have in the bank. Chances are, you will not have to explain anything about your current financial situation as the beneficiary. The burden to prove financial support rests on the petitioner's shoulders. So your fiance will have to either have a job that can support you both or your fiance will have to find a co-sponsor. In most cases, the embassy doesn't even care about the beneficiary's job or finances.

Is there a known preference for having either form typed or hand written? The reason I ask, I can't fit all information in some of the boxes were I to type the information.

There is no preference. I typed up on my side of the forms and my fiance hand wrote his. I would recommend you type up yours though. Doing that eliminates the chance of someone not being able to read your writing and you can make corrections on the form without having to print out another copy. If you can't fit all of the information in the boxes when you're typing it up, you should attach supplementary pages containing the information. Just make sure you sign your forms by hand in blue ink. There have been some issues in the past with people signing their forms in black ink.

You can get examples of filled out forms here: http://www.visajourn...content/k1guide

K-1 Fiance(e) Visa Process & ProceduresVSC RFE Responded
If it helps you guys at all, I got an RFE from VSC over two months ago. We got the physical copy then sent our reply back to them via FEDEX. It arrived two days later and was signed for on May 11. It took them to May 16 before it was logged into their system. We were given our NOA2 on June 22.

From what I can tell, they should log receiving your RFE responses within two weeks. Maybe you will both hear from VSC this week?

K-1 Fiance(e) Visa Process & Proceduresphotocopies...

highlighting things and writing dates etc on photocopies is fine. Also include the copies of your passport pages that show the entry and exit stamps. The boarding passes alone are not proof that you actually entered the country. The passport pages will also show the dates.

Ive flown out to the US 3 times and they have never stamped my passport at any time. When he came to Canada, they did stamp his passport with something. But never for me. Is that a problem??

K-1 Fiance(e) Visa Process & Proceduresphotocopies...

Writing on the photocopies should be fine, just as well as stickies.

I left room to write the notes. I didn't want the stickies to fall off, so I wrote on the photocopies. I can't see a reason why someone would receive an RFE for that.

ok thank you :)

K-1 Fiance(e) Visa Process & Proceduresphotocopies...
Im still in the process of getting my K1 stuff ready to be sent out... here's my question... on the plane ticket copies, am i allowed to write on them (ex on the top) to write dates and destination clearly and to circle dates on the ticket copies to make it easier for the USCIS to read them?? or (i think i read this somewhere) is it better to just stick on a sticky note to them explaining the dates and destination to them? I dont want to get an RFE because i wrote on the photo copies.

PS ive seen people say on here that i should post in the Canada section, but for some reason, i can't seem to find it haha... can anyone tell me where to go so i can ask my questions in the canadian section of VJ... Thank you! and good luck to everyone still in the process :)

K-1 Fiance(e) Visa Process & ProceduresBeneficiary stopped working, will it be an issue for the interview?
No its a non-issue for beneficiary.
Only an issue if it is the petitioner.

Left my job before my K-1 interview due to the manager.

Just make sure to have some money saved up.
Wish I had a little more saved when I moved to the USA would of helped out better.

K-1 Fiance(e) Visa Process & Proceduresquestion on co sponsor I134

Do the Same Income Requirements Apply to Form I-134 as Apply to Form I-864?
No. The 125 percent of the federal poverty guideline minimum income requirement, the most recent year's tax return, and other requirements only apply when Form I-864 is needed. Applicants presenting Form I-134 will need to show that their U.S. sponsor's income is 100 percent of the federal poverty guideline.

EX. FOR K1 2010 POVERTY LEVEL AT 100% FOR A HOUSEHOLD OF 5 INCL. FIANCE IS 25,790.00 MY FATHER MADE 33,000 LAST YEAR. IS THAT ALL HE PUTS ON THE I134 OF DOES HE HAVE TO PUT A BANK STATEMENT FOR SAVINGS ACCT, STOCKS, AND VALUE OF HOUSE ALSO????????????????????

Its 125% of the poverty line for 2011.

He does not have to use bank statements or savings or stocks if his current income meets the 125% for 2011.

K-1 Fiance(e) Visa Process & Proceduresquestion on co sponsor I134
If you are not using your house you do not put anything on the line.
If you are only using your income as a sponsor you only put on the income line.

There are example forms in the example section. http://www.visajourn.../Form-I-134.pdf

Sorry your SSN will not come in the mail after entering on a K-1. You have to go and apply for it at the SSN office a few weeks after entry. You would only get your SSN in the mail if you entered on a CR-1 spousal visa.

Its sponsoring a foreign national that compromises it.

It does cause problems even for military people. They have to retest and take frequent testing/polygraphs to prove they are not giving info to this foreign national etc.

K-1 Fiance(e) Visa Process & ProceduresInformation clarification

I answered N/A since this question doesn't apply to fiancee. My fiancee has never been to US and has never been out of Vietnam for more than a few days. This didn't present a problem with getting the I-129f approved.

Good luck!

Its not asking for an address in the US, its asking for her last address outside of the US which would be the current address that she lives at.
