Approved without issue.

There are people who are approved and have no rings or anything. Don't worry on proving "engagement".

No because its not a legal marriage, but if they at USCIS or the embassy find out, they can deny you saying you got married. There have been quite a few posts on VJ about that happening to people trying to get K-1 visas.

If you have no US government photo ID then you must use your passport so you will need a passport.

Government photo ID is required to get into the ASC center for biometrics or any other reason.

On the DOS ( Dept of State )website where it says contact us, it lists the phone number you can call!

Am I way off target here, or shouldn't the USC be the one calling the consulate and the DOS?


The beneficiary should be calling the consul and DOS. The USC can call if they want but once the petition part is approved everything is generally up to the beneficiary to deal with! It is their visa not the USCs visa.

You call them, DOS is department of state. They are more quick to answer your questions than the embassy on the status of your case.

About how long until she can begin working once she comes to the US if we were to do a fiance visa and sign the papers basically upon her arrival?

What is DCF?

I read that to sponsor her for a US visa, I had to be in the US myself. Is that true?



K-1 visa will not get her there in a few months, it will take closer to 9-10 months. And then on top of that you have to file AOS after you marry and it takes around 4-5 months to be able to work after filing AOS.


Either you are going to go back to USA without her or you are going to wait in Japan longer.

CR-1 is the only thing that will let her work right away.

You would have to marry then file CR-1. DCF is no longer once August 14th comes but you can mail the CR-1 from Japan to the location in the USA listed in the CR-1 instructions on the USCIS website.

You have to go pay for a marriage license then you get a list of people who can do the service and the dates they can do it on. Then you pick one. Then you call and book the date for the marriage. Then you show up on that date and get married. You walk your license down to the marriage license office in the court house then you pick up your marriage certificate.

You should of done some research. Now find out where to pick up your marriage license and go get one and book the person who will do the marriage. Its very likely you wont get " the next day " because they may not have someone available. They may also have a waiting period to get married. The wait period for our state was 24 hrs after we got the marriage certificate.

Your supposed to contact NVC to get the case number from them.

All k-1s pass through the NVC to get logged and given an embassy case number then are sent to the embassy. K-1s generally only stay at the NVC for a few days to a week. Unlike CR-1s which are processed through the NVC.

As Jay Kay said.

You cannot leave the USA after you enter because you have to file AOS. If you do not file and wait for the green card you will have to start all over again filing the CR-1 paying the fees and waiting.

Looks like the K-1 is NOT the visa you want and you want to get married now and file for a CR-1 visa instead.

Sorry but you have to marry IN the USA on a K-1 visa.

You wont be able to apply for the K-1, get married then move to the USA.
If you don't want to marry in the USA then you need to marry now and file for a CR-1 visa instead. Then you would move to the USA after that.

Because it is Montreal, it is different for everyone.

Go to the Canada forums you will see. There are many many posts, threads and comments about how poor Montreal service is for some and how good it has been for others.

Recently there was a whole bunch of people who never even got their P3 in the mail even tho Montreal maintained they had sent P3 to them.

If you sent to Montreal that is normal they are slow and it takes them forever to get their mail out of the mail room and into the computer system.

you cannot start AOS until after you are married and you have the marriage certificate. You dont make an appointment with INS office you apply the same way you did with K-1.

Fill the forms provide the evidence and pay them. Wait for biometrics and wait for interview or approved green card.
