In case of K1 OP should not send anything since joint sponsor will be filling out I134. No one cares about OP's income if I134 is filled out by joint sponsor. On K1 stage joint sponsor needs to show 100 (not 125%) poverty line. However, it should be consistent with guidelines for number of people in his household (joint sponsor's) plus OP plus his fiancee.


Petitioner MUST provide I-134 and supporting evidence REGARDLESS of using a co-sponsor.

Everything that happened can affect the spousal visa in some way if its negative, he was removed from the US? and was denied visas? need to know why. Does he have a ban from being removed? The same problems that caused the denial/removal before could be reason to deny the spousal visa as well.

Hmm, i have lots of stuff. i tend to keep EVERYTHING. (ie our first movie tickets together, all of our passes for museums and tours we went on, every train ticket i had, plane tickets, etc.) Would it be bad to just include everything to be safe? I don't want them to be like "Pff, you guys are annoying sending too much stuff! DENY!" lol


Our I-129F was like an inch and a half thick of evidence, and when i went to my interview they had to have all the paperwork in TWO folders because we had so much papers plus the papers the USCIS and NVC and embassy add to it. When i got my visa and packet i had to bring TWO packets across the border because they couldn't fit it all in one envelope, even then both of them were busting full of paper lol.

I was only coming from Canada and i'm sure we didn't need that much stuff in it but I wanted to make sure there was no RFE and no delay. We had none lol and the whole thing took a bout 4 months from start to visa in hand and moved to the USA.

1. Even though you don't make any money right now you will have to fill out a I-134 anyways when the time comes because you are his primary, you will fill one out then your dad will too and they will look at your dads more so than yours for the sponsorship.

2. no issues just make sure he continues to pay them!

3. a rough date is good but do not book anything! just in case it takes longer than expected.

4. I just wrote a single small paragraph on how we met online and then met in person including the dates of it and we both signed it. (because I was visiting at the time that we were filling the papers out, USC didn't wanna fill it out cus he does paperwork all day so i just did it and he signed everything lol!!)

- we both included a letter that was a few sentences long saying that we both intend to marry and want/cant wait to marry within the 90days after entry on the K-1 visa. Signed our own letters and included them in the packet.

Does this mean one can simply leave the other portions of the I-134 blank? I don't recall seeing anywhere in the instructions that you could leave things out - it seems like they want an exhaustive list of your financials. It would certainly be more convenient to prove income and not bother with bank statements.


We left the entire thing blank accept for the income. We only provided income that is all and were approved.

You have to be married for her to get on your orders to be able to move with you.

With a k-1 you have to get married in the USA. Then you have to stay there and apply for AOS. Sounds like you may have picked the wrong visa.

As I said, my situation is unique. I do not have a job, but I have more than enough assets and I also have income that is not counted as earned.


Not unique really there are people daily applying that have no income what-so-ever. They apply without lawyers and use VJ website to help them get through the paperwork.

All you have to do is read the instructions and follow them. They lay out how to do the forms pretty well.

Why would you need a lawyer to help you fill out I-134? There are example forms for I-134 and its quite a simple form to fill out.

I recommend doing it yourself instead of paying crazy fees for someone to fill out a 1-2 page form for you...

Contact the consul that she was interviewed at tell them you want the case transferred to the Philippines as she moved back there.

Contact the Philippines and give them the Yemen case number and tell them you want the case transferred to them because she recently moved back.


The bigger issue though is the validity of the case since its past 2 years you said. You need to make sure the case is still open and they have not closed it or anything.

American citizens can't ever be free of filing taxes to the IRS, even if they become citizens of another country. The only way Americans can rid themselves of a lifetime obligation to file tax returns with the IRS on their worldwide income (and to file TD F 90s) is to formally give up their American citizenship. This too goes for naturalized citizens. Even if you become an expat you still have to pay tax to IRS for a certain number of years before it stops.

Finish reading that website that you posted. Nowhere does it say that you can stop filing IRS tax returns, it only states that you can file exclusions based on certain amounts of money you make in another country. You are required as a US Citizen to file taxes for the rest of your life regardless of where you live.

This is incorrect, you can leave the U.S with a green card and not loose permanent residency as long as you return within a 12 month period. If you happen to stay long enough and get your citizenship you can come and go as you like. As far as taxes are concerned U.S citizens who work abroad are required to pay taxes on any income they earn for the first 360 consecutive days they are out of the country. After 360 days the U.S government recognizes them as a permanent resident of where they are residing and they are no longer obligated to pay U.S taxes on income earned.

US citizen is required to pay/file taxes for life to the USA regardless of where they are living and how long they have been living there. There is an elderly woman in Canada that the IRS is going after because she has not filed her US taxes in many many years and is a US citizen. She had only filed taxes in Canada and is now feeling the burn of the IRS because she didn't think that she had to file anymore after a year of living in another country.

Americans also have to report annually on foreign bank accounts that they own that total more than 10,000USD.

Im just worried that they might have the wrong address that's why i have not received the packet yet, & there is no help from the US embassy website for the Philippines...



Well you wont be getting one because manila does not send out packets anymore, hasn't for a while.

Go online to the website and look up the instructions for K-1visa for Philippines. Call NVC or the lawyer and ask for your embassy case number.

I'm hoping that he doesn't have to be re-vaccinated. He knows that he was vaccinated as a child...so I'm not sure if you can actually be re-vaccinated with some of the vaccines. As far as finding those records...the doctor's office told him that anything over 15 years old is purged from the chart and they no longer have access to it. So, it appears that we are left with nothing and no hope of getting a record, either.


And you just disregard what I and another VJ member said? a titre test can build a shot record for him. All it is, is a blood test that can test his immunity levels and tell you what hes had and what he needs.

Last year is last year. They look at current income so this years income, what hes making right now needs to meet the guidelines. He also needs to have filed his taxes.

I married and then went and got my SSN in married name after marriage.

There is no requirement to get the SSN first what so ever. It is only a recommendation.

For us it was easier for me to drive across get married 4 days later and then apply for SSN in married name 2 weeks after entry.

No the NOA1 is the letter saying they have your petition. You did it correctly. Had you waited for aproval notice of the I-130 you would of filed a CR-1 not a K-3.

But you should of filed the CR-1 instead anyways way more benefits than K-3.

thanks for both your advice so quickly! I think we fall into the former - we never had any kind of engagement party and my ring isn't that much of a rock to be seen in normal everyday pictures lol

My guy was saying when he was filing the original paperwork there was a time constraint - that the photographs had to be dated from before the date the petition was filed. Are their similar restrictions on any of the images/emails/chats whatever else I send in?

Approved without issue.

There are people who are approved and have no rings or anything. Don't worry on proving "engagement".
