You should of waited till you had your NOA2.

Police certificate is valid for 1 year only.
K-1s are extremely backed up at Montreal and people have been waiting over a month for interviews.
The police certificate needs to state no record found and a search of the nation wide name check done.
I payed about 40$ for my 1 green sheet I filled out, they put it in a printer that printed it out saying no record and she stamped it with an embossed stamper.

- Airport finger printing has nothing to do with criminal record.
- You do not need finger printing for police certificates done unless you have a criminal record.

You have to talk to your health insurance company to find out what you need to do so she can be on your plan.

Most require marriage and SSN to be added to the plan.

After entry you have to wait 2 weeks to apply for SSN, in the mean time get married then go apply for SSN. Get the AOS package together and send it off ASAP.

Absolutly not, a K-1 is not for a spouse. However, a Cr-1 visa IS for a spouse but also unlikely a spouse of a US citizen will be granted a tourist visa

I wouldn't worry about it too much! he was telling the truth right? and they told him to obtain waybill for DHL which means mailing his passport/visa back to him? He's probably doing an extra background check or something which could maybe take a while. If he's from Mexico, they'll def put him through the ringer...My ex is from Mexico and every time we crossed the border from Canada to US it was always a big ordeal for him. They man get a lot of folks coming through there proposing fraudulent cases so they may be extra rigid. I think its good they kept his passport because they need to put the visa in it! :) try not to worry as hard as it is, and stay strong! you'll feel so good once you've both come through it all and can be together!

OP- is he a W2 employee or 1099?


He is a W2 both at his old job and the new one. It should be noted that the instant he leaves his old job, he will be starting his new job with no period of unemployment in between. Ie. He stops working at old job on a Wednesday then starts working the very next day for the new job. So technically he'll never not be working.

We just don't know how to handle the unfortunate timing of his job change and my K1 Interview. I can't move the interview at this point because I already booked my tickets and hotel room and everything.

My fiance got a new job and is starting a couple of days prior to my K1 Visa Interview. He has his tax transcripts and employer letter from his old job. It'll probably take him longer than a few days to get an employer letter from the new place he's working at. How do we prove he works and makes enough at this new place? He makes above the required amount at both places so that's not an issue. I guess it's just bad timing so any help and insight will be greatly appreciated.

My fiance got a raise recently and we want to know what to declare on the Affidavit as his income. Does he declare his current salary or the one he received on last year's tax transcripts? He is also self-employed so what does he declare for the total amount?

Do we do:

new salary + self-employment income from 2011

or

new salary + self-employment income from 2010

or

old salary + self-employment income from 2010 (as reflected in his tax transcript)

My fiance is also moving to a new job just a couple of days before my interview. There is absolutely no way he can get an employment letter done up and sent to me in time and obviously will not have any paystubs, so we were wondering if a written letter from him describing his situation as well as a copy of his offer letter from his new employer would be sufficient to prove that he is still making a suitable amount of income.

What to send to your fiance(e) once the I-129F is approved (Receive NOA2):
1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).
2. Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy.
3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).
4. I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.
5. You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form.
6. A copy of the NOA2 that you received in the mail.
7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).

If it were to cause an issue would probably depend on the individual adjudicating your package. Most certainly the more proof of relationship, the better.

I would just send it, and if there is an issue they will just mail you an RFE (request for [more] Evidence).

There have been a few posts from people who were denied out right, the main reasons being they forgot the check payment or they did not include any evidence just the forms. They are denied, the papers returned and they put the check in and send it back or try to re-open it so they don't have to pay again.

Never heard of someone having to be in the USA before turning 1 to qualify for PR status.

It might red flag if you have a family member sponsor you but i'm not sure, that would probably be country specific, but also Philippines doesn't usually let people have co-sponsor for K-1 visa.

My friend ( a petitioner ) had his father co-sponsor a K-1 from Philippians and he brought tons of evidence of the co-sponsor and got approved though. He said he thinks its because it was his father that did it.

If he does not meet 100% of the poverty guidelines for your house hold number you will need a co-sponsor. Yes military only need to make 100% of the guide lines.
