He needs letters and records for the anti-depressants and may have to see a therapist before the medical is completed if he is currently on anti-depressants. He also needs to bring his vaccination records to the medical.

The petitioner does not have an interview.


The beneficiary has 6 months to use the visa once it is issued, once the visa is used it is then void and you have 90 days to get married. You must marry in the 90 days.

After marriage as soon as possible you need to file for AOS.

Edit to add ---

He can go back after marriage but he cannot return. The k-1 is ONE TIME USE ONLY.

He must file AOS and have the green card or AP card before leaving the USA if he intends on returning. Otherwise he leaves and you have to file all over again for a spousal visa and pay the fees and wait over a year for him to be able to come back.

I-134 is the correct form for the K-1 at Montreal and Vancouver. 864 is not needed until the AOS process later down the road.

Not sure how to fire a lawyer I would guess call him and demand stop on the work and tell them they are fired and not pay them. Then contact USCIS and let them know via Tier 2 officer not phone jocky who picks up first. Thats just a guess though.

Yes you can visit the USA.

You need to bring ties to Canada with you such as letter from work expecting you back, utility and rent proof, NOA2 from the petition to show you are going about things the legal way and have to be back for medical and interview.

You shouldn't have problems if they ask show them the NOA2 first explain yours just visiting and have to be back to finish the process.

I would suggest calling the NVC and getting the embassy case number first. When emailing the embassy you need to put the US embassy case number as the subject line of the mail, if you don't have a US embassy case number and only a USCIS case number they generally do not respond.

If you have already done this then call DOS ( department of state) and asking them if the embassy has gotten the petition before doing other things. If they have gotten it then ask if anything has been sent out yet.

Its possible they may have to pick up the packet from the embassy themselves or even download it from the US embassy website.

I am confused about this as well. I know everyone says, just check the forms, but not all of the example forms on here are correct and when we post on a forum it is because we want to know what you, a fellow K1 visa filer put on your form, especially if it got approved.

On #10 are you supposed to put the day you filed the I-94 or the day you received your NOA1?

Most importantly, On #11 are you supposed to check Yes, No or leave it blank when they ask if you intend to make specific contributions. The example form leaves it blank. I can see why you wouldn't want to say "Yes" if you are planning to fully support them, but is the correct answer "No" or is it actually supposed to be left blank.

Thank you for your help. I hope we get some answers soon as my fiance is having to file ours on Monday morning with our packet 3.


I filled it out exactly like the example form for I-134 was approved no issue.

The USCIS online address change does only work if you are living in the USA and moved. She should speak to a Tier 2 officer and try to change her address with them but if they don't do it its not really a huge deal.

After you get the NOA2 -
She can go online on Montreal US Embassy and get the packet 3 from on there and fill out the forms with her new correct address. When she mails back papers to Montreal consul include a letter stating her address change as well.

your taxes will show 1 child but your house hold will show 4 people including him. So they know there is 1 unaccounted for person somewhere. Unless your lawyer is telling you to lie on your taxes as well as lie on your immigration forms.

Not to mention the fact that if you suddenly subtract this child from your taxes while all your other years have the child that will look even more fishy. Not only to immigration but to IRS no?

At this time of year every year they start working on other petitions as well and k-1s tend to take a back seat it seems. I would guess that VSC is going faster now because they are working with K-1 as priority and other petitions taking back seats instead. Likely they alternate doing this and thats why one is faster than the other at different times.

What is he adjusting status from? If he is adjusting from tourist / student / work from inside the USA? then priority date is no concern to you. You file based on the guides with the I-130.

I also have a military security clearence, but didn't have any problems and it has not affectted my clearence nor my job. My wife not being a citizen only affects me if we want to be stationed overseas. Basically, we wont' be able. Also, my mother and sister are both non US citizens who live in the US with Green cards. Again, I have not had any problems with my security clearence.


Congrats to you then. Must not be a high clearance like ours or you would be having the same issues.

Not sure why you cant be stationed over seas because we can and anyone whos military spouse has a green card CAN. You can ROC over seas and apply for citizenship early because of being active duty military and stationed over seas on orders.

My husband has a high level of security clearance and is in the military. It has definitely affected him and his job.

He has to have a special form from the FBI stating he is allowed to marry me and has to have a waiver from them. He also has to do several forms and tests from the military and his security clearance etc. I also have to have an FBI interview every time he needs to renew his security clearance. I may also have to have one for my ROC and citizenship testing.

This is VJ, most people do not even look up any extra information other than what they are told, when you give advice yourself, you need to be careful as well. I-129 is a non-immigrant work visa.
