Absolutly not. If you marry then you will lose your filing fee and any time you have gained with the K-1. You will have to start again from scratch. No way to transfer the application.

When you marry, you will void the K-1.

Sorry, nothing you can do. I know you've probably heard this, and already know it, but you really shouldn't make ANY travel plans before the visa is in hand - for this reason. If he has to leave then you can simply travel alone.

It took me 10 days to have my passport and visa back in hand, but that was also 2 years ago

I'm pretty sure the info for sponsors and what they are liable for etc is on the instructions portion of either the I-134 or I-864 Just download them from USCIS site (the instructions) to see. Typically, the things they ask you for (tax transcripts, pay stubs, etc) are listed there too, or you can find what else to include here on VJ. Good luck!

Hey no worries! He's not going anywhere now! But yes, please do file for AOS asap since it will mean he can work, and yes, remember he CANNOT leave until you either have AP (advanced parole-a document that allows him to travel and come back) or greencard in hand. So, yes, you have time, but don't forget to file in that time! They are right, if he leaves before you have either of these things, you will have to do the visa process all over again, including the money, before he can come back. Congrats on your wedding!


Check out the AOS guide under "guides" at the top. It is very useful, and filing AOS is much easier now that K-1 is finished!

If it wasn't dangerous for you to go, then I would say go for it, but I guess you have to decide. I have many friends from Mexico and from dangerous parts, and I have seen how it can be, so I would not take it lightly if he says its not a good idea. He'll be ok either way :)

I checked my case on USCIS and on the day of my approval, that was the first indicator before we received any texts or emails. Other than signing up for notifications, its kind of pointless! I think it varies with each case how useful it is, but it IS satisfying to see the blue dot move.... :) good luck!

That was kind of you to break it down for her and do all the info gathering. Yes, the VJ guides are amazing and are up to date, which is very important as if you send the wrong fee to the wrong place, it will get sent back to you and you'll have to start again! You may also want to look into getting married and filing for AOS as these days its hard to tell which takes longer. Are you currently in the same city? it might be an idea since she is already occupied with studying.

don't worry! I have both a visa denial, and a border denial and I did just fine. Granted, I was under scrutiny when crossing the border since then, and I decided to include a statement about my denial so as to avoid being questioned. It was all fine, and as long as you are totally honest, you are ok. I even lied to them at the border crossing, hence my denial, but I'm here now and have crossed twice before then. You'll be ok! :)

Proof of ties: when I crossed, I had a previous denial, so they really scrutinized me when I crossed again. The thing they most looked for was my pay stubs dating back as far as I could, and current, my bank statement showing a spending record, and of COURSE round trip ticket and minimal luggage!! that's the first thing they look for. The officer got irritated with me because my stuff was all in an envelope, and how he wanted it was in a binder, organized, and easy to look at. There's a good few tips for you. I had no problems at ALL the second time I crossed before I had my K-1 because I did exactly what the previous officer told me to. Other things I brought with me was my entire I-129F package, hotel reservations, utility bills, letter from employer, NOA1/2. Good luck! you'll be fine if you're prepared.

The service centers vary in their pace. Sometimes VSC is faster, sometimes CSC...it changes. Some people say that country is irrelevant, and its not supposed to have any bearing, but I'm not really convinced. Be prepared to wait at least 5 months. Also you need to take into consideration the time frame of medical, and interview wait etc. So its really more like 6-8 months (or more) not 5.

What exactly are these itineraries?


They are summaries of your flights that you've booked which the airlines give you. They outline when your flight is, on what aircraft, where you're sitting, and what the flight number is. I read somewhere that even these itineraries could be only secondary evidence and that flight tickets are the best because those prove that it was actually you that got on the plane, passport stamps also prove the same thing--that you actually went through security and customs at your airport and that you probably got on the plane.

I've got itineraries from several years ago because my fiance (then boyfriend) and I knew we would need those whether he planned to come to Canada or I planned to go to the US. The passport stamps you have should be decent primary evidence. Just for future use, and in case you need it, save your flight tickets and itineraries because they are immensely useful.

Also, just because I got stung with this, double check your I-129F and make sure everything you need to fill out is filled out. Especially in Part C, Question 2. Missing that question has caused a lot of people to get RFEs!

Hey everyone, glad to have found this site and all of the available information on here. I've read that an ACCO folder is best to contain the I129-F package, but I couldn't find one. The lady at Office Max looked at me like I was crazy when I asked about that folder style.

Is a three ring binder okay to use?

Will be the 4th month on 22nd October since we sent our NOA1... My fiance updated his address in U.S online. The website said it'd take a while for updating, like 2 months; yet he recieved a letter saying the address was updated in the system, also on the paper! Stay positive! I'd say it's kinda a good sign when they asked you for the divorce certificate! I've noticed (I think you do too) it won't take very long after you sent them the document they were asking! Also, be thankful as you're in Canada! It's very close to the States compare to other countries on Earth!! Also, no Visa is needed while traveling back and forth! The only thing is, if you're driving to the States, drive safe, stay alert and watch the road!

I'm in Manitoba and have to drive to North Dakota, approximately 5.5 hours drive. My fiancee gets nervous everytime I'm driving... I want winter comes quicker so we'll have our NOA2 sooner but the snow and icy road won't help at all! Have safety inspection for your car, check tires too!

Before 2009. You would send it to 1 of 2 places. Now everyone sends it to 1 place Dallas and from their they sort it out to somewhere else. You cannot be sure which place you will get. So just omit the USCIS address from the top of the letter as you are not sure if it will go to VSC or CSC.

Yep the example one is out of date, it used to be correct because you sent it to 1 of 2 places but they dont do that anymore and everyone sends it to the Dallas lockbox which then sorts out the petitions between 2 places.

Just omit the address on it.

I dont think so, I filed for divorce early 2008. My ex fought me the entire way. It went through the courts early Oct. 2009, but the judge took forever to sign and it was legaly over early Feb. 2010. My now husband filed for me the end of March 2010. So even though it "looks" bad, it really wasnt, not in my eyes. During the consulate interview, I was asked about the quicky filing. I told the CO that I was legaly seperated early 2008, but b/c the ex fought me, it wasnt final until early 2010. This was the only question, and only answer to this scenario, I think if it was red flag material the CO wouldve asked more details, maybe some proof, I dont know, but it came across as a simple question, to which I gave an honest answer.


YOU don't think so, but what about an interviewer. People need top stop saying " I " don't think so because of course you wouldn't think so you went through it yourself and you know its nothing strange because you know what happened. When the interviewer looks at the forms they see the divorce and they see now suddenly right after the person is engaged from another country. They can see this as a potential red flag especially from some certain countrys. You have to look at thinks from an interviewers point not from your own.

There have been a couple posts even on VJ in the past where a person divorced their spouse and married soon after got their new spouse a green card and then the new spouse left them once they had the green card.
