K-1 Fiance(e) Visa Process & ProceduresImmigration lawyer
cndgirl, I think you meant to post in this forum if you're filing for an F-1 Student Visa:

http://www.visajourn...-visitor-visas/

Everyone here is or has filed for a K-1 Fiance Visa. But in case you were asking about the K-1 anyway, I didn't use a lawyer. My fiance and I got an RFE but it was for a very minor issue that we easily fixed ourselves. The rest of our process has gone smoothly so far.

K-1 Fiance(e) Visa Process & ProceduresPOE with over $10,000

Nope. It's cash OR "monetary instruments", which "includes coins, currency, travelers checks and bearer instruments such as personal or cashiers checks, and stocks and bonds". Direct quote from the CBP Form 6059B.

To the OP: The F4790 is the old declaration form. It's now the FinCen 105.

http://www.cbp.gov/l...er_brochure.pdf

Thanks! Has anyone carried over 10k during POE and did the customs agents give them a hard time about their money? I shouldn't think they'd have a problem. After all, we're moving and just taking the money we earned with us. I just don't want to waste any more time. I'm still kicking myself for not just doing a wire transfer.

K-1 Fiance(e) Visa Process & ProceduresPOE with over $10,000
My POE is early morning on Monday. I just remembered today that if you're carrying over $10,000 into the US you need to declare it. There's no one at the bank tomorrow to do a wire transfer for me, but I do have a cashier's check to myself for over $10,000. What form do I have to fill out when I get to customs? Is it the F4790? And has anyone carried over 10k with them at POE and what kind of troubles have you experienced? Stupid me, I forgot all about this. Grr...

K-1 Fiance(e) Visa Process & ProceduresFiance changing decision
I always believe there's no right or wrong choices. Personal ability (smart and initiative) determines the result.
No matter what option you've picked, do the best job as you can! Stay positive and good thing will happen
I know it's frustrating as it seems that you're the only one who try to stay strong and positive, but be patient and try to send your positive vibes to your fiancee. B-)
Good luck and best wish! Feel better and stay positive!

Hmmm at least they're processing... I was just wondering these days, it seemed that no one's hearing anything from CSC/VSC about NOA2 lately...
We have been waiting for 5 months and 3 weeks. My fiance called yesterday and a very very nice officer told him they're now processing application dated on 17 June 2011.

and now... I have the feeling that we'll recieve the RFE instead of NOA2

K-1 Fiance(e) Visa Process & ProceduresPacket 4...and no interview letter?

Yep i can totally understand. my fiance is filipino but working in montreal. here's the deal with it. If there are no appointments available you cannot even pay the 350 fee so you don't have to go through that step when an appointment comes available on the website. Also it's a free for all, first come first serve. So let's say you've checked the website to see if appointments are available and have been waiting since september. Well there could be someone that got approved after you sitting at home refreshing the website every 5 minutes and they get one before you because you cannot sit in front of the computer all day and night waiting. therefore if you're not sitting in front of the computer everyone else can grab up the interviews and you can wait forever! awesome! What a stupid process.

Yup they should have never changed it to a free for all scream fest!! Montreal needs to rethink it or do something to have it que up people or something.

K-1 Fiance(e) Visa Process & ProceduresPacket 4...and no interview letter?
There are people who have been waiting 2 months for appointments at Montreal.

Currently they have no available or open appointments.

Please go to the Canada section and see the many posts about people waiting to book appointments at the Montreal consul. All you can do is keep refreshing the page until an appointment shows up and then quickly book it.

K-1 Fiance(e) Visa Process & ProceduresChanging Living Locations

How many forms does it take to do this? She said we would have to change the address on every form we've filled out so far, and it would be a huge hassle. She also said I would have to resend the I-134 and other forms.

Also, if she doesn't want to live in the Condo with my friend and his wife, where will she tell them we will be living, since we don't have an apartment yet.

You call them and update the address with USCIS/NVC, where are you in the process of the K-1? if you have already done the I-134 then yes you will need to update that address and she will need to update her forms that she brings to the interview with the new address as well. Its not a hassle as much as being shot in your sleep over your house hold items.

You list the condo and then when she gets to america you find a new place and move to your new place. Then you file a change of address with USCIS again by using 2 forms on their website.

K-1 Fiance(e) Visa Process & ProceduresChanging Living Locations
It has nothing to do with the process.

People change address all the time, all you do is update your address with USCIS. There is no issue they will NOT stop her from getting the visa just because you moved that is ridiculous.

K-1 Fiance(e) Visa Process & ProceduresChanging consulates -- waiting time?
You realize you don't have to wait for packet 3 from Montreal, the entire packet is all available on their US embassy website. You can access it and download it and get everything done and send it back to Montreal before they even mail you the Packet 3 in the mail.
InkyFemaleCanada2011-10-04 09:17:00
K-1 Fiance(e) Visa Process & ProceduresCSC Visa Information Service--No Dates?!
The US embassy opens appointments whenever they open them.

When someone cancels or changes, they have random days that they open up batches of appointments for interviews. Sometimes they show up after a maintenance of the website (shut down cant log on then when you can it shows appointments)

Honestly you just have to wait until whenever the US embassy will open dates for appointments and post them. Sometimes for the Canada people they show up VERY early in the morning sometimes randomly in the evening when people are still at work and cant book anything. Many of them have been waiting a few months for something to become available.

1, contact the Naples embassy and ask them to transfer your case to Brazil because you are moving.

2, contact the embassy in Brazil and tell them you want your case moved from Naples to Brazil because you are moving back to Brazil.

K-1 Fiance(e) Visa Process & ProceduresHow to work while waiting for K1 visa
You cant adjust to another petition.
You apply for 1 petition.
If you no longer want to use that one you cancel it you would then have to marry and start all over again. Bottom of the pile new fee new petition new everything.

If you want to go to the USA to work you would get a job and have them apply for a work visa for you. There is no "in-between waiting for a fiance visa so i can go work in the USA" You wait for the K-1, you can visit the USA but cannot stay. You get the K-1 and then you move to the USA, get married then you file AOS and you wait for EAD or GC to work.

K-1 Fiance(e) Visa Process & ProceduresRenewing passport before visa interview yes or no?
Use the new passport number because the visa will be stamped on that passport.

They cant put a visa in a voided/canceled passport.
InkyFemaleCanada2011-09-26 09:09:00
K-1 Fiance(e) Visa Process & ProceduresRenewing passport before visa interview yes or no?
Renew it bring both to the embassy, I had to do this because I had 6 months left on my passport. They said had I not done it ahead of time I would not have been issued a visa. They didn't even ask to see my voided passport and didn't even bring it up in the interview.

Form G-1145,... relatively new form?
Covers that.
Authorizes uscis to inform you of acceptance/approval, by text and e-mail.

I think it instructs you to fill it out and attach it to the FRONT OF YOUR PETITION.

yellow card?
red card?

Is this something peculiar to Afghanistan?

I could be wrong, but... something makes me think if you are applying for a visa for someone from Afghanistan or Iraq, ... then you got a loooong road ahead of ya.

its probably not peculiar to Afghanistan because that is how they do the process at the embassy.

if you mean something particular to Afghanistan, most embassys use different methods of approval. You need to see your own country section to find out what their usual practice is.

You think?

I was 'writing it off', as I said, as a careless error on their part.

Call?

I've done that, and it seems to me, there's no way to get past the AUTOMATION, and talk to a real person.
Of course, I called before I realized this error.

Any advice on how to talk to a real person? and do it without making an entire day affair out of it?

Yes you talk to a real person by using the options on the menu.

To be honest all you do is search the VJ forum and you can find a ton of threads on how to get through to an operator on the USCIS line. You could also probably figure it out if you call and try the options. http://www.visajourn...being-ar-uscis/

okay, Andie and Shugufa.... that's exactly what I wanted to know.
Thanks to you, I'll spare myself.
and Hopefully others will too.

I think I stated earlier, on another thread, that the uscis.gov page, when checking status, states that they are reviewing my "I130" app.... when very clearly, I've filed the I-129F. So, I was immediately suspicious about their validity and accuracy of running the site.

Thanks again for confirming what I imagined.

You need to call them about your issue. That is more serious than a case that is not updated on status.

That does not work when the case is at the US embassy in another country. It also does not work when the case is in AP in the other country. It is only for tracking when the case is at USCIS.

Clearly read what instructions where? I didn't see anything on the fine print of the I-129F which is why I asked. Sorry if I missed something obvious, just trying to wrap all this paperwork up today and I feel overloaded with details and fine print.

Anyway, if my regular bank checks will be fine, that's great...saves me a trip to get a money order.

I was asked for the original at my interview. The interviewer compared the copy and original and looked at the seal/stamp on the page very carefully. Then handed back the original.
