I was denied entry twice before my interview in Montreal. The POE was easy, never even asked about the previous denial of entries.

Now, you should disclose the denial of entry at the interview and be totally honest about it, but it is really a non-issue

Consider it a blessing that it will get sent back and give you the chance to make sure they will have everything they need! Same thing happened to me, they changed the filing amount a week before I sent it, so I of course didn't check the website to check the amount. But, they sent it back and we made it much better. Its a very small set back!

Yes, technically the fiance can visit. All you need to bring is proof of ties to the home country (beneficiary does that is) and that is also in the FAQ section of the K-1. If your fiance does get denied, its not a problem. It will not have any bearing on your K-1 as long as you are telling the truth and don't try and do it so you can marry faster. trust me, I know from experience....JUst make sure the beneficiary can prove they are returning to home country and you should be ok. What country is beneficiary from? that could have bearing on how easy or difficult it could be as well. Hope this helps :)

time's do vary, and yes, it can be sooner, but prepare to wait at least 5 months. after there is also a waiting period for interview and medical etc, so from start to actually physical move to US could be more like 9 months on average. If you spend some time looking at everyone's timelines, you'll see that they vary. Also, a helpful forum is your country's forum (or your fiance's country) because you can chat with people there about embassy processing times etc. You should be able to get all the help you need here. Hi! yes, CR-1 looks like the one for you especially if you're in no hurry. You'll be issued a green card which is legal permanent resident. No need to be a citizen, and you can work, and travel outside as you please. I believe if you leave the US for more than a year without a waiver, your green card is considered abandoned. Otherwise, you can come and go as you please. Check out the guides and just poke around this site as it is all you need. You do NOT need a lawyer. They suck, and cost you tons of money and this is something you can do yourself with the guidance of VJ! good luck!

DO NOT use a lawyer! they do not have any vested interest in your well-being. Ask me how I know. YOu can do it yourself! we're all here to help you do so! its daunting, but yes, if you're willing to put in the time, you can do it. All a lawyer will do is charge you a ton of money to do a half-assed job and with no guarantee they will get you an approval. I strongly suggest you do not go this route! I mean, I guess if you have tons and tons of disposable income and you are willing to let someone else take your life in your hands go for it! Good luck! :)

She would only be "locked out" until she can get AP (advance parole) which is a document that allows her to travel outside the US. And, a lot of couples get married legally and have a wedding later as immigration processing times are unpredictable. I just wanted to warn you about the not leaving b/c you expressed "what if someone dies" so as to let you know she cannot leave impromptu. She must have a travel document if you choose to go the marriage in the US route. Of course, she can travel on OPT.

Yes, she'd have to adjust from her F-1 status. Its a bit tricky, as previous poster said, you have to prove she didn't just do that to stay in the US. You would marry first, then file. The other option is for her to finish her F-1/OPT then return to Canada once the year is up, and you can file for a K-1. She can visit you during this process while living in Canada until she gets her K-1 visa (fiance) then she would come to the US, you marry within 3 months, then she applies for a greencard. IF you get married first, she cannot leave the US, and once you are granted, she would have a green card and be able to work anywhere. I'm not sure if you file for I-130 that she would be giving up her F-1 but I'm pretty sure you can't do both at the same time. Don't quote me on that...if I were you, I would go the K-1 route. You'll be apart for awhile, but if you're not ready to marry now and she wants to be able to go home, then this is a good choice. Like I said, she can visit the US while K-1 is pending as long as she can prove she's lives in Canada while she waits. You'd be apart for less than a year, but again, a good way to test your relationship for marriage. A CO told me that I could enter from Canada with my K-1 in possession, but inform the CBP that I was not using the K-1 at that time and was just going for a visit. It was possible as long as I had proof of strong ties, and just let them know. Once you cross on K-1, that's it! its only good for one border crossing once you activate it.

There are very few circumstances to expedite a K1 Visa. The major ones are:

1) If the US petitioner is a member of the military and is facing deployment.
2) If the beneficiary resides in a country that has experienced a major natural or man made disaster or political instability.
3) There is a medical emergency or terminal illness.
4) There will severe financial loss to a company or individual.

Your fiance possibly having to renew a yearlong lease probably won't qualify you guys for an expedite. However, it does not hurt for you to try filing for one anyway. It won't negatively impact your petition if you get denied an expedite so you might as well try.

Also you indicated that you got your NOA1 in April. Both CSC and VSC are processing mostly May or later. You need to call them up and put in a service request (different from an expedite) as you are now outside of normal processing time unless you got an RFE (normal processing time seems to be 5 to 6 months).

edit - I just saw on your timeline that you got an RFE on September 7th. When did VSC acknowledge your RFE response? If it's been over 60 days since they acknowledged getting your RFE then call them and put in a service request.

Yeah the A#, I just assumed that stood for the Alien Number on a Green Card. That apparently has been my key mistake. I have made so many assumptions that's gonna be biting me in the butt. I didn't answer it cuz it didn't apply and neither one of us have one. I'm just afraid that the reviewer might nitpick and decide to deny or rfe our app.


If all you did was leave the space for A# empty, you may get an RFE. Denying someone for leaving a field blank that doesn't apply to them anyway blank is a bit extreme. USCIS is strict about how you fill out your forms, but most of the time if they ever issue a denial it is with reasonable cause and for far more serious issues than what you're describing (ex. petitioner did not disclose criminal past, petitioner or beneficiary lied on their application, the relationship is clearly constructed for the purposes of visa fraud, etc). The most you might have to deal with is some extra waiting due to an RFE.

When being asked for Alen numbers, I left those blank when None or N/A would have been applicable. Are those grounds for denial or is the worst case scenario them having me resubmit a more complete app. Any idea how much delay I just caused myself?


I really doubt you'll have to resubmit an entirely new I-129F packet. When my fiance and I got an RFE, it was for missing a checkbox. The RFE consisted of one piece of paper. The front telling us why we got the RFE. The back had the question with the missed checkbox. All we had to do was check the checkbox then sign it and send it back to them. If they really want you to fill in those blank spaces, they will probably send them to you on a piece of paper like they did with us.

In terms of delay, it's hard to say. It depends on which service center you're at and what the service center is focused on. I'd say a conservative estimate on delay is 60 days if you even get an RFE. But it's hard to gauge what will happen down the road and what the service centers will be doing.

For those that got an RFE, how long did it take for them to review the requested docs and get the app moving again?


Depends on your service center. I was at VSC. After we sent our RFE response, they acknowledged receipt about a week later and then it took them a little over a month to review and then approve us.

Everything I've seen so far indicates that if you leave the United States, you will have major problems getting back in. Even the US territories can get a little hairy. So best plan your honeymoon around that issue. A cruise will likely complicate matters. Maybe you and your bride-to-be can vacation somewhere in the US? Like another poster said, it's a big country with a lot to see. And there's nothing stopping you guys from taking a few days with a simple honeymoon inside the US then saving up money for after she gets AP or her green card and doing the cruise then.

When you go to book the appointment for your interview at the Vancouver Consulate, you will be asked to pay ahead of time using their online system so make sure you have a credit card you can use to pay what is called the MRV fee. I believe they prefer it if you paid online and ahead of time as opposed to on the date of the interview. When I booked my appointment (two months ago) the cost was $350 USD for a K1 Visa.

The fee for Woking Medical was exactly $350CAD. You will need to pay the medical clinic via bank draft or money order. They do not accept credit cards, debit cards, or checks. Regarding paying $30 for an extra copy, I didn't pay the $30 and was given a copy of my medical forms in addition to the sealed medical results.

Everyone here is or has filed for a K-1 Fiance Visa. But in case you were asking about the K-1 anyway, I didn't use a lawyer. My fiance and I got an RFE but it was for a very minor issue that we easily fixed ourselves. The rest of our process has gone smoothly so far.
