Yes, you can go to the US on your approved K1 visa, get married and go back to the UAE. Strictly speaking the K1 visa is not needed to marry in the US; anyone can marry in the US on a B2 or a VWP. The K1 visa is needed if the couple wants to marry in the US *AND* stay in the country after the wedding. That's not your new plan, but since you already have the K1 visa, you can enter on that, get married, and leave the US. If you want to return to the US after that, you need to apply for CR-1 visa. (The K3 visa is administratively dead.)

Please note that after you wed and leave the US, you cannot apply for a B2 visa to just visit the US. You will need to apply for a CR-1 because you are already married to a US citizen. Applying for a B2 would be next to impossible for you.


No you would apply as IR-1 if married more than 2 years. They said they would stay in UAE for a few years. CR-1 is not the option.
CR-1 is only for people married less than 2 years.

SSN is not needed for marriage in many states, call and check with your county.

SSN is not needed for AOS but is needed to get put on a bank acount, a drivers license, car insurance, a job, health insurance etc. It is very important to have an SSN.
However, I applied after marriage so I could get my SSN in married name and have 1 less document to change my name on.

Their son is a USC if his father is a USC. They need to apply to get his passport etc. Can't remember what this is called but other VJ members will know.


This is not always the case, if the child was born before the parent became a USC and the new USC parent does not fit the requirements for CRBA then they could not bring the child to the USA as a US citizen.

Yes i agree they need to read the website, they married in thai but they didnt reg. with the u.s embassy which the u.s is not going to recognize as being married, just looking for positive help, i guess what im asking for is how do they apply for adding their son? I myself have gone through the k1 process before and am goint throught it again im just not sure about adding their son ......


If hes born to a US citizen parent who fits the requirements, they would file a CRBA and get a US passport for him.

There was a Canadian with a criminal record who was refused entry when they had a visa. Cant remember the name but they had posted about it on VJ, they ended up marrying instead and filing for a CR-1 with a successful entry that time.

Background checks or something came up on a name check that they didn't like so they are investigating it. All you need is a name in common with someone who did something bad to mess up the visa issuance. They have to investigate it which takes time.

The K-1 does not stay at the NVC there is nothing for you do to at the NVC stage cept for wait for it to be forwarded on after being logged.
It stays about a week at NVC and leaves.

Are you talking about reading on people trying to bring their children and getting stuck because they do not have a permission letter from the absent parent? Thats been a large topic recently on VJ.

Are the kids yours? are they older than 16? does she have sole custody of the kids? etc. are the questions you would need to answer for us to be able to tell you if she would need a letter from the other parent.

Have you already filed the case or are you just preparing to send of the I-129F? if you are just now sending the I-129F you have quite a ways to go before needing to worry about entry with the visa.

Your way over worrying, if your planning on living with friends put their address. You can always change the address later.

Once he has the green card he is required by law to notify USCIS of any move/address change that is made, the USC and sponsor also need to update the address but are not required by law to do it.

Ya there is because its not going to be valid anymore and USCIS doesn't even look at it or use it. You have to do it all over again and send it to the beneficiary when you get the NOA2.

Do they also consider how much money you have in the bank, assets, etc... 2011 will be my first year of working. (I was a student prior) I will have made about $33,000 and currently have $30,000 in the bank. I know they like to have 3 years tax return. Will this be a problem for me?

If you make 125% of the poverty guideline for the house hold then you have no need to show bank accounts, savings or assets. You can just show your income only.

The USC fills it out and collects the supporting evidence after they get the NOA2. Then they send it to the beneficiary and it is brought to the interview or it is sent when the USEM requests it from them. It depends on how the USEM they are going to asks for the papers.
