K-1 Fiance(e) Visa Process & ProceduresThe RFE Master List

I received an RFE today, but the problem is that at some point in the last year or so I seemed to have misplaced my passport. I have lived in Japan for almost 3 years now and my fiance and I have traveled back to America together, but I currently have no passport and can't send any copies of my visas.

Any suggestions for primary evidence for me? I can provide pay slips from work or copies of credit card bills or bank statements, but I have a bad feeling this won't count as primary evidence. Am I completely screwed? :(

I noticed that my passport was gone last week when I got the email from USCIS that they had sent out an RFE, and have searched daily for it but it looks like it really is gone. I can't believe this horrible timing.

Did you save your plane ticket stubs (boarding passes) when you or your fiance went to visit each other? Those can be used as primary evidence. Also you didn't mention what your RFE was for, it could be that the RFE has nothing to do with the need for more primary evidence if you've already submitted some when you applied.

I checked our case status and saw we got an RFE today. Can't imagine what it would be except maybe questions about my citizenship (born in one country, immigrated to Canada, got citizenship in Canada). Hopefully it is something easy and we can get the evidence back to them so they can approve us and we can finally move on with our lives. But we should get the hardcopy in a few days and depending on what it is, I may be bugging you guys for help!

What about extra documents? Proof of relationship? We don't need it, only that they have met for the fiancee visa.

So are you saying that all these people here who have been sending in a novel full of information/pictures is NOT necessary??

Hi!

Im a Canadian Citizen living in Canada, engaged to an American Citizen living in the US. We want to get married in the US and then both move to Europe.
I will then start the immigration process to become a US from Europe.

Does this mean that I will be applying for Spouse Visa? Would that be ok and legal?

Would greatly appreciate any information you may have.

Thank you!

Marney

I do not understand... If you both plan on moving and living in the UK, why bother with trying to become a US citzen ? blink.gif

Current Status: Response to request for evidence received, and case processing has resumed.

On January 6, 2009, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. This case is at our CALIFORNIA SERVICE CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.

Is the 60 day thing a standard procedure? Or does it vary case by case or according to what the RFE was sent for?

- We had an RFE also, like the person who first started this forum, we did not send in all the things listed on VJ only the information listed on the Embasy site, and once we gathered all the information and sent it in, we got the exact same notification. That they would notify us in 60 days of the date they recieved the infomation.

- I had only found VJ recently and now, reading on the wealth of information here, I am kind of dreading the fact that I may have to wait 60 more days for them to hit me with another RFE. mad.gif

You included copies of your passport page with visa and arrival & departure dates right? You should be OK. If you are worried, search through all your paperwork at home (and ask him to do the same) and see if you can find other evidence, then copy it and keep ready just in case.

do you have to submit original copies of your evidence (credit card statements)? or can you submit photcopies?

Good proof to provide at this stage includes passport stamps showing you both were in the same country at the same time, boarding passes, copies of tickets and itineraries, and any paperwork with your name and address on it showing you both were in the same place at the same time (like credit card receipts showing purchases in his country, debit card receipts, hotel bills etc). And of course, photos. You can include written statements verifying the dates and places you were together.

do u think we will get an RFE? all we sent were photos, my itineraries, and a prescription receipt with my name on it, date (and his address) from when i bought medicine when i was there....

The proof they want with the I-129F is that you have met in person within the last two years. They don't want and they don't care about non-physical relationship proof at this stage (like emails, phone calls etc.). At the interview stage in your country, that is when they want the ongoing relationship proof.

what would you say is good non-physical evidence to provide? (in case we get an RFE). we've already filed, and sent pics and other proof.

Now my question earlier was: When we send in the evidence they need, do we send only what they are asking for or do we gather up the whole package again and resend the whole darn thing??! 129f

Cindy

Cindy, you send back only what they ask for, not the whole package.
You can start already by taking a look at your papers and see if you forgot to add something, anything, like a N/A.
I did this while waiting for the RFE and discovered a mistake.....still the RFE was for something else whistling.gif

When they ask for more evidence, are they looking for evidence of your relationship prior to the date of filing your petition, or can you send in recent proof of your ongoing relationship?

K-1 Fiance(e) Visa Process & ProceduresMore Evidence

We are in the process of waiting for the NOA2. Is there any benefit in sending more evidence? Since initially sending in the paper work we have had many visits, vacations, and engagement ceremonies.

Is there even a way to send in more?

Do not send anything unless they send an RFE asking for more.

Save anything new and bring it to the interview.

There is no photo amount requirement, 25 is more than enough when you have pages of other physical evidence. Make sure you include all passport stamps and travel documents.

K-1 Fiance(e) Visa Process & ProceduresInterview Tomorrow! DS-157 question!

This is new that the consulate has gender specific forms..? Posted Image

No it is not new it has always been this way because of selective service for men.

Hey guys!

The visa interview is tomorrow
and I was double checking everything with my fiancee
and on her packet 3, it says that the DS-157 need only filled out by MALE applicants between 16 and 45 years of age. Now, my fiancee is, of course, a female, so would this make her exempt of the DS-157?? Of am I, the US citizen, the applicant?

Sorry but you aren't the applicant of the visa. US citizen cannot get a K-1 visa. Only the immigrant is the applicant of the VISA. She being a woman does not fill it out for her visa forms/interview.

You are the US citizen petitioner.

No, the affidavit of support portion is NOT sent until the interview stage. Do not include the I-134 with the I-129F package.

1, call and get the new embassy case number, ask if its been sent to the embassy/consul yet.

2, you send nothing and do nothing with the NVC K-1 is NOT processed through the NVC it is only given a case number and forwarded directly to the embassy/consul.

3, find out for your country what is needed at the K-1 interview. Some require specific forms. You can find out usually by going to the website of the embassy/consul or posting in your regional country forum.

K-1 Fiance(e) Visa Process & ProceduresStarting K-1

Me and my fiancee are starting the k-1 process. I am getting getting some of her documents translated now for the 129 so I can file. the question I have is her police clearance. She is Filipino, but has lived in Japan for the last 20 years. getting the records from japan is easy. Does anyone know how she can get the records from the Philippines without actually going there? We are trying to get everything together as soon as possible to try and make this go smooth.

The police records are not needed until the interview, you should be waiting till it is closer to that time to get them. The process is taking many people 8 months or longer and the police certificates are only good for a year.

K-1 Fiance(e) Visa Process & ProceduresAffidavit of single status?

Hi, I am a September K1 filer. I am still waiting for NOA2 from CSC, but I thought I should start getting some documents ready. I read from some old posts that some people need an Affidavit of Single Status, but it is not mentioned in the K1 visa guide, so it is not clear to me whether it is needed for my case (I-129F K1 application, Vietnam). So my question is, do I need it? If so, where/how do I get one? (I read that I can type it up and get it notarized at the City Hall, but I don't know what to write without seeing a sample one...)

Thanks in advance!

This issue is generally specific to certain countrys only such as the Philippines. I don't know if Vietnam requests these at the interview, I have not seen anyone post that they needed one.

K-1 Fiance(e) Visa Process & ProceduresDo you choose your Port of Entry?

Hey guys, I haven't been able to find this information and I'm sure someone will know right away...When you get your interview date can you buy your plane ticket on your own? Is there a port of entry specifically assigned to you or can you enter the US at any major airport and use that port of entry? My fiance's interview is May 16 and he just reserved a plane ticket for a week later...I wasn't sure if it mattered where he he is entering the US.
Thanks so much!!

You enter where ever you want. There is no assigning of POE or anything like that.

K-1 Fiance(e) Visa Process & ProceduresPregnancy

I am going to the Philippines to meet my fiancee in person and propose to her in July of 2013. Someone who
married a Pinay told me that when she applies for the K1 fiancee visa and goes for her medical exam, she will
be turned down for her visa if she is pregnant. Is this true? To me that doesn't make sense if she is pregnant with
our child. Does anyone know the FACTS on this?? Thanks for your help.

Edward

Thousands of pregnant women are issued K-1 visas. The only thing pregnancy does is
1, you cant get some vaccinations while pregnant which is covered via waiver generally.
2, if she reaches a certain time of pregnancy she may not be allowed to fly to the USA until after the baby is born.
3, if the baby indeed has to be born in the other country they would then have to procure a US passport for the baby to travel on which may take some time.

Active duty military only for any type of military expedite. so being discharged isn't going to get help from that.

But you certainly can try based on the fathers condition. You will need to request an expedite and send them all the information with doctors notes etc.

You should really write your own letters, examples are examples, you can use some points of it but it does need to be personal and written by the both of you.

K-1 Fiance(e) Visa Process & ProceduresI Just Confused Myself

I haven't received my NOA2 yet, but I feel it's time to prep. So I'm reading a guide about NVC and woops, I think I was reading one I wasn't supposed to read. K1 NVC process is pretty much handled by my foreign fiance, correct? I know I read a K1 specific NVC guide but the search bar hates me. I can't find it. The K1 flow chart links to a page of forms I can download but which ones are NVC specific? I want her to practice filling them out. Grrrrr, I have 50 bizillion bookmarks but failed to bookmark that guide.
Any help would be greatly appreciated.

Sorry but there is NO NVC process at all for K-1. They assign a case number and forward it directly to the interviewing embassy/consul. NO forms NO information no nothing is sent to the NVC.

The information for Philippines specific forms and paperwork is found in the Philippines forums of this website.

MY fiance (who is petitioning me to come to the usa) just got a new job, do we need to notify the USCIS that his employment has changed? I'm sure this happens often? or what if one is to become unemployed while the I129F is going through, will that effect anything?

Thank you!

It affects the affidavit of support. And no you do not need to notify anyone.
You just fill out the forms with the new job when the interview comes and you submit the affidavit of support.

If its for the I-129F package then you put the address your mailing it to on it. Which I previously said is in the instructions.
Honestly the letter of intent does not need an address on it because its in the package with the rest of your stuff all going to the same place.
