The time frames vary, and fluctuate often, so you can't really bank on them being 100% accurate. Some petitions (k-1) I've seen approved as fast as 2.5 months, and other more like 6. You don't have a lot of control, but you do have control of how fast you can put together the package and send them things as they need it! :)

For Vancouver, its a little quicker actually. an average of 7 months I would say from filing I-129f to interview. Expedites are not an option for these visas with a few exceptions that usually involve some kind of disaster or hardship. Good Luck! :)

oh, and the non-US cit cannot travel outside the US until they are issued either AP or GC. removal of conditions are filed within (I believe, but feel free to correct me someone) 90 days before the 2 yrs are up.

after your fiance enters the US on a K-1, and you have married within 90 days, it has served its purpose (sole purpose) next, you file to AOS which means you register for permanent resident card (2 yr conditional GC) EAD (work auth) and AP (travel doc) all at once. You do not HAVE to file for all three, but you should because when you do, they waive the fees for the EAD and AP as opposed to filing separately and paying all fees, plus, its just good sense. You will most likely be issued EAD/AP at the same time as I believe it is a combo card, and then GC either with, or without interview. Once you have that, you're all set until it comes time to remove the "conditions" on the GC. But for now, just worry about what's in front of you :)

having already paid a lawyer who completely failed and put together a ridiculous package, not to mention had NO knowledge of basic geography of Canada (he was trying to send me to Calgary, and I am on the west coast, and he asked me "oh, is Vancouver closer?" wow.) I paid him about $4000 and guess what, I'm still paying for that since I had to borrow the money, and I ended up doing it again myself and paying again, myself, so if you want to save yourself the headache, I agree with the posters saying try not to use one, but totally up to you. :) best of luck, please ask for all the help you need here!

have you already filed for a K-1? if not, you can do a CR-1 visa instead, get married, go back to Canada, and she will have to remain in Canada while the visa is being processed. From what I know, Cr-1's are only processed through MOntreal and K-1's can be done through Vancouver which moves much faster. that being said, since she's in Ontario, it is VERY likely she will be processed through Montreal anyway. So, its up to you. Both will probably take about the same time, but check out with people here what the current processing times are for both visas and both embassies. :) congrats!

lots of K-1's do it this way and I think its best because then you don't have to worry about moving your actual wedding date if there are hold ups. Ideally, you should marry asap and file for AOS asap to reduce the amount of time you'll be unemployed. I thought it would take 6 weeks, and Its almost taken 3 months now. Good luck, and congrats! :)

Just curious what the reason is for waiting to send them? K-1 is valid for 6 months once it's issued, so if that was a concern for you, I would file asap because it can take awhile, but if you have other reasons, carry on! :)

I am US citizen who applied for my Fiance Visa (K1) from Atlanta (vermont center) in summer of 2010, it Sring of 2011 she did her medical, police report and all that. June 16 2011 she had her interview at US Embassy in London,UK. We had a realationship for 10 years and showed all the proof, its a long story, we both are from Pakistan and Muslim. Our familes didn't agree for years but we both waited and waited. I came to London like 8-10 times in 10 years. Now my question is that after she had her interview on June 16,2011., we have been put on "Administrative Process", I have emailed the embassy and called them as well, but get the same answer., Its under Administratvie Process, I have called the Dept.of Visa in USA and I get the same answer. Last month I involved my local Senator, and he emailed them once in Dec.2011 and pretty much he got the same answer. What should we do? Do you think we should get married and apply again? I did have a pretty good lawyer, she really can't do anything as well, I had a metting with her last month, she told me "no one can touch embassies", they are by themselves. She also mentioned that if we change our status to Married there is no Gurantee that we may not get Adminstrative Process again. I just want some ideas, if someone had a same situation or knows someone had a same situation. I hope you all best of luck, I have been praying hard! Its really hard for both of us now, we have stopped our lives. It totally sux! Please help.

RFEs were, in the past, processed in 1-2 weeks. When we got our RFE and sent it back it took VSC about a month to get to it and approve our petition. They ask that you give them 60 days to respond to your RFE. If it goes on longer than 60 days, you'll have to start calling. They refused to issue any information on our RFE until our 60 days were up.

The passport is taken at the interview to stamp the visa in it. Thats not for another 7-8 months.

go to the bottom of the page, you will see a guy with a laptop and it says"click here for U.S. Visa information, to register for courier delivery and to schedule an appointment online".
read the page check the box just above the confirm button
then hit the "confirm" button
you will have another window pop up, to create your account follow the prompt and questions, You will need your passport as your number. You will see what you need to do.
After you have set up your account and everything you will need your case number to book your appointment. But in the meantime you can log into your account and it will tell you when the next available time will be... example 21 days.

If you enter the US on a tourist visit with the intent to marry and adjust status it is visa fraud.
If you enter on a tourist visa with no intention of getting married but do so and then adjust status based on that marriage, it is not visa fraud.

Intent makes all the difference in the world and can be hard to prove.


If you read the OPs post. They clearly state their idea of entering and marrying then leaving and re-entering on a tourist visa and AOSing. Big no no.

Hi All,

My fiance (chilean) and I (US citizen) want to apply for a K1 visa. However, after we get married here in the US, he will have to leave the country for work reasons. Currently he has a tourist visa. 1) Will his tourist visa be nullified by him applying for the K1 visa (and hopefully receiving it?) and 2) If not, will he be able to re-enter the US on his tourist visa and then apply for the adjustment of status? Finally, should we just wait to apply for the fiance visa until he will be able to live here permanently? The thing is we just want to get married. We've been together 5+ years and would prefer not to wait any longer, but at the same time we want to go about this in a legitimate way, as to not have trouble in the future. Any advice is warmly welcomed! Thank you!!

Then you just bring your marriage certificate when you travel because your name doesn't match the passport. Simple.

If she intends on using her married name then she should use it. Being an immigrant makes no difference with "name change rules" As soon as you are married you may take your husbands last name and apply for your documents with the married last name using the marriage certificate.

A passport is always valid identification as long as the passport is valid itself and not expired.

Just bring the marriage certificate to use the married last name.

AOS does not require an SSN. You would apply for AOS and fill all forms out using the new married name so that the green card arrives in the married name.
You can try changing the name on the SSN now with the marriage certificate, or you can wait until after you get the green card and change it then.

Half the time the lawyer will destroy the petition and take your money!! Then you are left with no spouse and a destroyed petition and empty pockets.

The only person who has the most time and the most care about the petition and the work that goes in to it is you yourself. Lawyers do not care about you and do it on their own time and are slow and hold things up. They also make mistakes because all they do is fill in the blanks on the forms with all the papers you do the work to get.

There are many horror storys of destroyed lives and familys on VJ because a lawyer stole money and didn't file anything and lied saying they did. As well as lawyers making horrible mistakes on the forms and the evidence and messing up the entire petition causing people to have to start all over again spending 4x the amount of money to get things done.

Marriage license comes first, you need that to get married.

Marriage certificate comes after you are married and after its registered. - This is used for AOS.

We went to the county court house and picked it up, took about an hour because had to fill out forms together etc. They had a 24 hour waiting period before we could get married after we got the license. We picked a judge and booked our wedding date.
