We sent our packet in, but it was transferred to CSC at the 5 month mark, at which point they lost our marriage certificate and sent us an RFE for another copy - which delayed the entire process for us so I understand your frustration

The visa should be valid for 6 months, while I know it will be hard to wait, why not simply have him remain in Peru until he finishes school? That way he can come to the US without any strings and start a new life, without worrying about AP or having to return in time.

I am sorry, Morrocco is a high fraud consulate, regardless if your fiance does not fall under that.

Perhaps in the state of GA the child's father doesn't have any rights (I am from GA and actually do not believe this to be true) but you are dealing with federal law. If the child's father is on the birth certificate, then the father has rights, hense the situation with the passport.

You do have the option of cancelling the fiance visa, marrying and then petitioning for a spousal visa.

Yes, that is what a lot of people do, make sure you go to your interview WITH your medical - failure to do that can significantly delay your case.

I was from Toronto, so I could go to the medical about a month before hand and then take the results to the interview in Montreal.

No, K-1s are also done in Vancouver if you live in Manitoba west, and before you ask - if you are in Montreal's geography to interview there you cannot switch. So Montreal it is for you.

Yes, you can only do your medical in Vancouver, Montreal or Toronto. Sadly it is just the way it is.

It's a non-issue. I made about 5 separate mistakes on the "petition" (application comes later) and fretted about it for each of the 178 days that we waited for our NOA2. However, I made the corrections on the Ds230 and made a note of it at the interview and it was fine.

You can't send anything now, well I guess techically you can but it is a very remote chance that it will get matched up to your petition. Sit tight, you're ok.

Do you have a case number starting with EAC? You may not get an actual hard copy but if you know it has been received and you have a case number then you are good to go. The 5 months is usually from the NOA - which it seems you already have. If you go to the Wiki tab at the to of the page and do a search for 'interview questions' you'll get a list of possible questions

I wasn't foolish. Like I said in other reply. K1 was not in my plan. I had another visa in US and was able to stay and marry. But something happened and had to come back to home country. Then, this madness started...
The wedding was set when everything was fine with my life plan. Of course, I wouldn't have set the date if I knew I'd have to go through this. If 7/7 looks risky, I'm thinking of 9/1 but worry about guest having to travel on labor day weekend..
I don't have many choices cuz of the venue's available dates...


Ok, fair enough. Let me change my wording. Regarless of your 'life plan' I think it was foolish of you to plan a 'big money' wedding without the K-1 actually in hand. Like another said, you are adding more stress to an already exceptionally stessful situation. If September 1 isn't your cup of tea, what about October? Once the visa is issued, generally there is 6 months validity on it, meaning the beneficiary has 6 months to travel to the US. You don't need to move right away, so even if the benefiary gets the visa in...say...July, you can move in August and still fulfill the 90 days to get married requirement by marrying in October.

Honestly, it was foolish for you to set a big wedding in the first place

Regardless, and RFE will be sent close to the end of the processing. We got ours at day 161 and were approved on day 178. So no, just because you haven't received anything yet doesn't mean you won't. It is extremely unlikely that anyone has actually even looked at your case/petition. It is probablly sitting in the same filing cabinet it was when it arrived.

Our RFE took 2 weeks to process, but I've seen them take much longer (but then again, I've also seen it take much less).

I think your July wedding date is pushing the envelope. Why not change it to September? Here is GA the weather starts to break up around September into lovely, cool days.

Did you enter the US on the VWP? If so, you can fill that in where it says "visa number" you can put "visa waiver program". But I assume you will be leaving to return to Wales so that doesn't really matter.

Sorry, can't help you with the skype logs but I can tell you to put your efforts towards primary evidence, not secondary like e-mails, skype, chats, etc. Focus on the time you've spent together, bording passes, passport stamps, etc.

Reasonable explanation? You filed 2 days before christmas! I am sure USCIS, like every other place, has employees take time off for the holidays. Now that doesn't mean they shut down USCIS but I am sure they were working on a skelleton crew. I've seen NOA-1s take up to 60 days. that doesn't mean yours will but that also means 10 days isn't that long, considering when you filed

I'd give it a few more days, maybe a week before you start to worry

There's no issue with you visiting him in Canada. The only time it could be an issue is when a non-US citizen wants to visit a fiance/fiancee in the US. They want to prevent people from coming here on a visitor's (or other visa) in order to avoid a fiance/fiancee or spousal visa. Now, if he comes here saying he wants to visit his fiancee on a visitor's visa, they might deny him entry, wondering if he's planning to marry you and stay to circumvent the visa process.

Hi, it's me again... I thought of more questions relating to the medical exam.

I am in Canada, and my USC fiance is filing and I129F petition for myself and my two children.

I know that there will be a medical exam required prior to the K- Visa interviews:

Questions:

One: Will my children (11 and 9 yrs) also be required to have medical exams? And is it a separate cost for each of them and myself?

Two: I have a congential cardiac condition which requires me to see a congenital cardiologist annually for check-ups. My Canadian specialist has already told me he would refer me to a specialist in the United States when I move. My USC fiance has very good medical benefits as he works for the US Government and I would be covered by his benefits once we are married. Will my medical condition be a factor in approval of my Visa? :(

My USC fiance and I are in the process of filing our I-129F petition and getting all the information together for the package. I have a few questions about my children and travelling to USA.

My children are 11 and 9 years old. My fiance is petitioning for their K2 Visas on the I129F. (My children and I are Canadian citizens).

Questions:

One: I have sole custody of my children, but will I need some sort of letter of permission from their biological father or court order that shows I am allowed to move with them prior to applying for their K2 Visas?

Two: I want the children to enter the USA with their visas when I do, of course... will they be allowed to attend US schools while there on their K2 Visas and awaiting the Adjustment of Status??

Three: During this whole process... while we are waiting for the petition to go through, and the Visas to be approved... will I be allowed to visit my fiance in the USA?

Stamped passport and copy of the I-94 satisfies the primary requirement of proof of having met 1 time in the last 2 years.

Secondary evidence is the photos of the two of you together.

Remember - you are not proving ongoing relationship at this point (that comes at the interview). Right now, all you are proving is that you met once within the last 2 years.

You have all the proof you need for USCIS.

Flight iteniary is NOT acceptable proof of having met. Anyone can purchase airline tickets and never use them. Acceptable primnary proof is boarding passes, stamped passport, I-94's, etc...

Secondary evidence is photos, receipts from hotels, other financial documents (visa or mastercard receipts of expenses when you are in their city)...


Okay I have an I94 from my most recent trip, as well as my passport being stamped. (How does a passport stamp prove that I went to see him?? - just a curious question :blink: ) I drove down in the summer, and our passports were not stamped either going down or coming back... I only have pictures from that trip..

My fiance is filing the I-129F petition. He is from USA, I am from Canada.

We have met in person 4 times over the last year. Is a flight itinerary printed from the email
acceptable as proof of me travelling there? (and him coming here?) I didn't keep copies of all my
boarding passes but when I flew down in November, they issued me an I-94. I made a copy of the
departure record before I boarded the plane to come home. Should I include this?

Also, I have created a timeline of our last 4 meetings with photos and copies of itineraries. Is this
too much? I have read much about "Front-loading". I would rather keep a complete record and just
continue to add to it as we go through this process to the interview.. thoughts?? :help:

its not the service center that gets them, its texas lock box which is just a sorting center. Your k-1 will be forwarded to either CSC or VSC which is totally normal. Stuff getting lost? yes, it happens, but don't worry as them sending your petition to VSC is part of the process and it will be fine. :)

To the OP. I had a previous visa denial, and a border denial and it did not affect my K-1 at all. The point of it is that you are doing it the "right" way by showing them you have filed/are on the K-1 and as long as you're telling the truth, you have nothing to worry about. That being said, true, a K-1 is NOT free pass, and I understand how nervous you can get even if you've done nothing wrong. when they deny you, it makes you feel like a criminal especially if it involves a long interrogation. After being denied, I spent almost a year being terrified to try and cross the border, so I started taking yoga which really helped me to control my nerves with nice long deep breaths. When I did finally cross to visit, I brought LOTs of ties, and the most important was a round trip ticket, and my pay stubs from the last year or so plus a bank statement showing my spending history in Canada. When crossing with the K-1, I assumed that time, and every time before that, they had all information on me, and as soon as they ask me about it, I just smile and tell them it was my error and everything was fine. If you have all your papers in order and you are organized, friendly in confident, it helps to put them at ease I think. You'll be fine. :)

that has no effect, don't worry. The same and worse happened to me, and she will be totally fine as long as you've been truthful all along the process! She played by the rules and being denied for lack of ties has happened to two other close friends of mine so its not that uncommon! I know its scary, and she probably feels really nervous, but just try and get her to relax and know that they've got bigger fish to fry. :)

I would not make any solid plans until you have your visa. hard as that may be. A lot of folks just get married in a civil ceremony to satisfy the K-1 then make big plans later. Can be much less stressful this way, and you may enjoy it more. Moving to the US etc is stressful and getting all settled is kind of nice before doing the big wedding. If its too late, then I would still try and push it further than July. Processing times vary daily, and trends change easily! good luck to you and I really hope everything can go according to plan and you don't have any possible hitches along your journey! :)

Wait till your 18. Less paperwork and trouble. It is only 2 weeks. If you cannot wait 2 weeks then you will really have a hard time waiting for the petition to be approved. Do you know how long this process can take?

Plus once you file the I-129 he might not be able to enter USA due to the petition. So, you may not see each other for 10 months if it is approved.

Tell us how many times have you seen each other?
How long have you been a couple?
How did you meet?
How long have you spent together in person?
What proof do you have of your relationship? Phone bills, pics, travel tickets, passport stamps?
Remember your co-sponser has to make above the poverty line for his own family and your fiance. Currently it is about 18,400 for 2 people.
How old is your fiance?
What will he do to support you? He will not be able to work until months after he comes here. Sometimes it is better to get married then apply for CR-1 just so he can work soon after arrival.

The questions I asked are questions you will be asked on one form or in interview.

You'll have to be the judge if that will work, as if its not legible, you may just want to play it safe with a new one. What visa fraud did she commit? She jilted you and took your money, shame on you, but maybe she intends to marry and stay with the FL guy!

There is nothing to report. You could tell your tale to USCIS but she didn't break any laws and only time will tell if she is trying to use this guy for immigration fraud;;;;;worst case she could sue you for slander if you are not correct.

I'd say cut your loses, forget about her and live your life and be more careful next time. Don't ever again violate any of the few cardinal rules about international dating.


I've recently learned, and you can check in the family section, that K-1's cannot adjust other than with original petitioner.
