K-1 Fiance(e) Visa Process & Procedures	One question after the wedding	Your visa expires the day you use it to enter the USA. You are given an I-94 that is valid for 90 days. You marry in the 90 days. There is no requirement to file AOS right away. It is advised to file as soon as possible because - 1, you cannot leave the USA unless you do not intend to return as you will not be allowed back in unless you file for a spousal visa. 2, you cannot work at all. 3, you will be out of status. Will that be a 2 year or 10 year card? Also what about the other forms I filed, they are for AP and EAD. A 2 year card. The interview would either approve or deny the adjustment of status. Some people don't have interviews and are just mailed approvals. No set times only approximation times for how long it would take for the interview notice or approval. If you didn't get the EAD or AP card it may come soon or it may not come at all before the green card. You would get an approval notice about it before getting the card in the mail. I have about 10 photos from the cruise the only thing that I was worried about was that the cruise was in November of this year and in the RFE it said from August 20, 2009 to August 20, 2011. I just read the instructions for the I-485 again and from my understanding we will not need the police certificate again, but he will need a copy of his medicals to submit. Is that correct? Since we aren't a special class and he has no criminal history. He just has 1 ay to replace his birth certificate and medicals, so we want to make sure we are in the clear and he doesn't need to get a new police certificate as well. Thanks No, I think you are missing the point.... They don't give him anything back its all meant for USCIS only. He gives it all to the POE and they send it to USCIS. Thats the end of it. Then you marry in the US and file AOS with gathering new things. You don't need a new medical or police record to do this. You also have to prove you can support her at 125% of the poverty guidelines - if you do not meet this then you will need to find someone to co-sponsor. If you cant afford the forms you should not petition her. The process will be thousands of dollars not just $340 but also another $350 at the interview + the medical, plus air fair, plus $1070 to file for the green card. You will get the forms and supporting evidence ready when you get the NOA2 and then send it to the beneficiary. USCIS has nothing to do with the affidavit of support. No its probably not worth it. Yes you would call and cancel the K-1 - then get married then file the new forms when you have the marriage certificate.
