You will likely need to include a waiver since your applying for one again so quickly. There have been people who were approved without sending in any photos ( other than the required passport photos ) You will need evidence of relationship aside from affidavits because they are not considered very strong evidence either. You could NOT send them and have the CO wonder why you didn't include them. You COULD send them and have the CO question that as well. Or you can make a choice either way and have the CO not think twice about it. You are the only one who has seen the pictures. in your opinion, do they look like wedding pictures? But in a sense it is similar because of the long awaited visits. My point wasn't about whether or not he should get denied (since he did file after the two year mark had already passed), My point was more on the fact of why he couldnt go see her, I can sympathize with him on that note. I understand, which is why my comments were not directed at you, but the OP. K-1 Fiance(e) Visa Process & Procedures	K1 Visa - Missed the two year deadline by 5 days?	Unfortunately it is not a reality for all petitioners to go visit the beneficiary as much as they would like. In my case, finances kept me from hopping a plane and heading to Africa every time I missed him. Don't get me wrong, I am very lucky to have been from Canada which allowed frequent visits during this process. But 2 years is a long time and is actually one of the requirements. While finances and distance always play a factor, it is essential that the 2 year requirement be met, I thought this would have been a priority becuase not only has the OP lost his filing fee but another trip BEFORE he can refile must happen Good luck	canadian_wife	Female	Canada	2012-01-21 19:37:00

Whatever their reasons are for being seperated 2 years, as VJers we should offer compassion with our advice. I was lucky to have seen my Fiance last year twice, but before that it had been about 6 years. We have been together since we were about 18 (we are 35 now) mostly for fiancial reasons we saw each other every other year. Judging? Isn't it best to prepare the OP for what will be inevitable? They are not authorized to do so. If you get turned away, bet on that you'll have to fund the trip back. Good luck, entrance is never a guarentee. All you can do is collect your ties and give it your best shot. No reason to think that you will be denied. Also, don't believe everything you read on the internet. Except for what I say of course. It had no effect on our eventual issuance of my visa Now, I was denied at a land crossing but from what I hear, you are responsible for paying your way home, why would the airline pay? They didnt' get you refused. You are not a criminal if you are refused, you broke no laws so why would they put you in prison? They will, however, detain you. If you are refused entry into the US and the next flight isn't available until hours later, what else are they supposed to do? They'll likely put you in a holding facility until the next flight is available. Now, there is no guarentee that you'll be admitted into the US ever, to make your chances easier you should carry strong ties to Australia and NEVER lie to the CBP.
