No they file for an I-129F petition. Once it is approved and sent to the US embassy they file for a K1 and K2.

Put as many pictures as you want and as much evidence as you want to include but make sure you include proof of meeting in person that is what they most want to see.

I honestly don't suggest k-1 unless you have faith in your relationship. K-1 adds a LOT of pressure and stress, as any immigrant or borderline immigrant visa does. You'll be held in the dark and can take anywhere from two months to 12 months to get it done.
Another thing, only apply for k-1 if you plan on getting married
ANOTHER thing, I would read into the medical stuff if I were you. Your gf is pregnant, which means no chest x-ray. I honestly have no idea how that would play out, but it's something you need to be aware of.

Canada gives chest Xray even if your pregnant - they put the lead apron over your stomach area when you are/ they do that even if you are not.

Thanks for clearing up the insurance, CR-1 & CRBA issues a bit.

Pursuing the route I talked about most recently, the time to move back to the states is after our baby is born and my (then) wife has the green card in hand, and when I have a job lined up with health care to support the whole family. Ideally of course.

Very sorry if this is coming off as me talking in circles, but that's pretty much it! This is a brand new challenge and I'm basically trying to understand every option we have. Thanks to you all, and this forum, I at least know that I'm making progress!

Her first visit to the doctor is tomorrow. She is based in Ontario.

My thoughts are as follows now:
-Visit the Canadian Consulate office and find out what my options are for travel into Canada using either the temp or perm res permit or even a pardon/waiver as to enable, at the very least, my ability to be with her during the 3rd t/m and delivery.
-Definitely rely on her health care during and after the pregnancy.
-Pursue the CR-1 route: get married here while she is across for work on her D-1 (flight crew) visa and have her file when she gets back. Hoping multiple entries into either country won't be impeded in any way thanks to the crew visa while undergoing the CR-1/AP process.
-Move her and the kiddo here after the AP or green card is granted, which will probably open a whole new can of worms when trying to make our baby legal here..(?)


The US citizen has to file the CR-1 the Canadian cant file that.
She cant move until she has the CR-1 visa and the green card is mailed on entry to the USA. The baby if born in Canada has to enter the USA on a US passport - a CRBA will need to be filed for the baby and a US passport filed for.

And yes, his income was so low he did not need to file a tax return. He's a full-time student who has had a few minimum wage paying, part-time jobs for a few months of last year.

I'm a little confused by people saying the consulate doesn't use the 1-864? On the checklist I received from the Montreal Consulate it says an Affidavit of Support (I-134) and Evidence of Support (I-864, federal individual income tax return for most recent year). Is that incorrect?


you are reading it wrong.

Montreal takes the 134 for the k-1 and uses the 864 for spousal visas. The information on Montreal website is lumped together for k-1 and spousal visas.

the bottom line is Montreal k-1 visa interviewers only use a 134.

CANADA does NOT use 864 for the K-1 interview !!!! totally wrong forms.

Beneficiary does NOT provide taxes at all only the petitioner and sponsor would provide taxes.

Even though, the I-134 is used for the first part, you still have to go by the I-834P Guidelines, but if you had a joint sponsor, would that require you to use form I-834A (Contract between Household Member) for your Joint Sponsor.


Manila requests this but this is an embassy specific request at the interviews. Not all embassys request this to be done this way.

One other thing. All children born abroad will be granted Dual Citizenship. The way that we understand is that once they turn 18 years of age, they must then declare what citizenship that they prefer, and renounce the other. If I am wrong, would someone here please respond to the exact law?


Thats country specific I believe. Does not hold a candle to Canada I know many born USC/Canadians who are still dual citizens and are in their 40tys and older.

If you mean for the visa interview -
No because he is not entitled to a visa he has claim to US citizenship. He will have to use a US passport to enter the US with you when you move.

They may need a medical and interview for the CRBA stuff but you will have to contact the consul to find out the details and what they need from you to do the CRBA and US passport apps.

ya unfortunately i'm stuck in the same boat if you apply for a birth abroad i think you have to be married because they asked us for our marriage certificate your husband has to show he's been present in the u.s for 5 years, divorce decrees if applicable child's live birth registration and your birth certificate. i think that's it. it has taken us a long time to try and get this but mostly because my son's birth certificate got screwed up so i had to wait to fix it then apply.


Did you call the consul and talk to them? they have different requirements for children born out of wedlock but you must contact the consul for the information on how to apply CRBA for a child out of wedlock.

if you have been arrested and stuff and gone to jail you might need a lawyer lol But it seems fairly straight forward so i wouldnt waste more money on a lawyer specially if hes getting laid off soon. All the lawyer does is collect papers from you and fill the forms out and mail it for you then charges you 100s or 1000s of dollars.

You guys have more time to collect papers and fill forms out and double check things than a lawyer does, plus its more important to you guys than a lawyer. There are quite a few horror storys on VJ about lawyers to messed things up so bad.

I don't completely know why lol But yes they do look closely at the current income. If he gets laid off they would look at the new income but want the previous tax return anyway. So for a brand new job he would need a couple pay stubs a letter from the employer stating annual summary and stuff on it. Then include the last couple years of tax transcripts or returns with w2s.

The I-134 is not to hard to pass, when it comes time to AOS in the USA after marriage the I-864 is a little more serious i think.

lol well the employment part is not really needed until your interview in Canada so 5-6 months ish? if you think he can get another job in that amount of time that will cover the poverty guidelines then yea send a K-1 in when you get everything filled out and collected for the packet!

Well if you guys got married the CR-1 might take a little longer to process but its cheaper than a K-1 and gets you a green card right after entry to the USA.

You still need a co-sponsor for the CR-1 but at least you could still get married and then file later on when he finds a job or co-sponsor?

Yep no visa for a child that is born to a USC. You will need to file CRBA and apply for the babys US passport.

The child will be listed on your I-129F because you have to list your children on it but he is not eligible for a K-2.

Nope nothing you can do at this time. And even then if you did pay the money and it took 60 days the EAD is only valid for 90 days.


- Also to add, no work without an SSN, you would be hard pressed to get one that quickly after arrival so work can begin.

No you cannot send DS230 ahead of time - it wont speed things up and USCIS does not use it.

Finger prints should not be needed unless there is a criminal background - but some countrys have different requirements to get police reports - check with the country of residence what is needed.
