It is a common misconception that if one sends all the required documents to USCIS with the initial petition (including those required at later stages) this will quicken the process.  If you send the required documents for packet 3 and 4, they will be ignored by USCIS and you will end up sending them all again because they will need to be updated.  This can often cause delays. 

 

Read the I129F instructions and send what is required.

Keep in mind also that men from certain countries often get up in administrative processing.

 

If the USC does not live in the US, often the consulate will require them to move back to the US before the visa can be issued.  As I said, the consulates in Canada are very strict about this

Canadian consulates are VERY strict about domicile.  You'll want to read up on that before you proceed with the interview.  There is a sticky over in the Canada regional forum.

 

The interview must be held in a country where the beneficiary legally resides.  If, for whatever reason, the work permit is denied, the beneficiary will have to return home.

Shrm - In Canada one cannot book a medical until the interview has been assigned.  So my case was complete at NVC and it went to the Montreal consulate, and when NVC scheduled my appointment I was able to book my medical

You will have to be in Canada (Montreal, I believe) for the interview. The Canada-specific subforum should be able to help you out there. You can visit your fiancé while a K-1 VISA is pending, so long as you can prove you have strong ties and reasons to return to Canada. (Job, house, rental, etc.) You'll have to talk to the other Canadians about how that goes for them, since you Canucks often have slightly different entries to America. :-)

Ninja - where in Canada do you live?  Yes, she can file the I129F while you are in the US and you MUST return home (obviously).  Yes you can visit, but always bring strong ties to Canada with you when you cross.

I'm sorry, but your close minded fiancé just created a mess for you.  YOU are the one in the interview that will have to deal with these questions.  He won't get a chance to speak to them about 'acknowledging" the child but is putting all of this on your shoulders.  That, to me, is totally unfair.

 

He'll only tell the truth if he gets caught?  Seriously?

 

Take control, have the birth certificate change (I assume you can do that?  Do you need your fiancé to be there?  I don't know) and go into the interview confident that no fraud is taking place.

You will probably need a cosponsor as your current foreign income will not count.  You  may use savings, but read the I864 instructions regarding that.

 

Have you been paying US taxes during your time abroad?

 

Finally, why not get married in your current country and file for a spousal visa.  You do not say but perhaps direct consular processing is available in your country

You are confusing petitions with visas.  The I129F and I130 are usually approved together and forwarded on to NVC.  NVC will likely close the I129F.  If they do not, you may choose to ignore any correspondences regarding the I129F and follow the cr-1 path with the I130.

 

However, as of now, there is nothing you can do at the USCIS level I do not think

Your reasons to go to the US are irrelevant.  Stop thinking in terms of 'Is this a good reason to go to the US" but start thinking in terms of ties to your home country.  Do you have a good paying job?  Your own home/least/mortgage?  Enrolled in school?

 

Those are the things the Consular Officer will be looking for, not reasons to go to the US

Awesome thread idea!

Maybe we can put solutions in here as well? For example, instead of getting your forms and information from the Consulate sites, or VJ, or anywhere else, always check the uscis.gov site for the most up to date version of the form AND instructions, including fee amounts.
This is one that has caught many people out. Forms take years to get changed (literally) but webpages can be updated quickly. Always double check at uscis.gov before sending any payment or form.

We got a RFE because my fiance didn't send in enough proof of our meeting - he had to send in more evidence! It's not enough just to fill out the form and say 'we met on X date' - you have to provide photos too :) And then he got another RFE because they needed more financial information from him. Combined the two held us up for three months which seemed like an eternity but wasn't really a big deal.


What was the financial information for? The I-129F????

Affidavits from family and friends. 

 

I included copies of credit statements.  I submitted a few of mine and my fiance's from when we visted each other.  When I was in his town in the US, I would submit a copy of both mine and his, and highlighted the transactions made during the trip, showing that we were in the same town at the same time, and I did the smae for when he visited here.  I think I sent about 6 different trips worth.

She is a Myanmar citizen living in Singapore. We share a flat in Singapore. She cannot even buy an airline ticket to the USA without a visa. They will not approve her for a tourist visa because she has no ties to Singapore. That is why I applied for a K1.

It is fairly common for franchise businesses to use a different name.  All three franchises I worked at had different business names on my tax returns (in Canada).  I think they will have knowledge of that.  You should be fine! :)

I've been to the US numerous times over the past few years. My POE has always been the YYC airport. Sometimes my fiance is with me but lately, I have been traveling alone to see him. We filed back in December and since then I've gone to see him once earlier this year in March. I am going to fly out tomorrow to see him, actually. Just for further info, I always pack light and my trips never exceed 14-15 days. I have not yet been pulled into secondary--and I hope I never do. It would be incredibly difficult for me to remember all the questions I've been asked at POE but it usually goes like this:

- Purpose of trip?
- Length of trip?
- Who are visiting?
- Where are you staying?
- What's your occupation?
- What's his occupation?

Only twice has the conversation gone beyond those questions. The first time the officer explained to me that I needed to file a K1 Fiance visa (we were planning to and gathering our documents at the time but hadn't filled out any forms yet). The second time the officer told me about the K1 process and even he admitted it takes a long time and it's a frustrating wait.

I am hoping for a very uneventful time tomorrow as I anticipate this will be the last time I have to go visit my fiance in the US before I get my NOA2 and go the steps necessary to get my K1 Visa. Fingers crossed...

They specifically requested primary evidence that we met in the past 2 years. My fiance has managed to come up with ticket stubs for a flight we took together here, but of course due to the wonderful ways of Japanese airlines they didn't print the year on the boarding pass. I have her boarding pass from when we went to the US together, but not mine. I also have eticket boarding passes for another flight we took together that actually has the year on it.

My last resort is a rental car receipt from the same trip that has both our names.. the thing is I have her passport and we can prove she went to America and came back to Japan. I wonder if all of it would be enough...


I can't say for sure if this is enough. It seems for a low fraud country like Japan that you shouldn't have any problems but everything is left up to to the officer dealing with your petition. I hope it is enough so you two can move on and be together. Getting RFEs are no fun. Good luck.

I received an RFE today, but the problem is that at some point in the last year or so I seemed to have misplaced my passport. I have lived in Japan for almost 3 years now and my fiance and I have traveled back to America together, but I currently have no passport and can't send any copies of my visas.

Any suggestions for primary evidence for me? I can provide pay slips from work or copies of credit card bills or bank statements, but I have a bad feeling this won't count as primary evidence. Am I completely screwed? :(

I noticed that my passport was gone last week when I got the email from USCIS that they had sent out an RFE, and have searched daily for it but it looks like it really is gone. I can't believe this horrible timing.


Did you save your plane ticket stubs (boarding passes) when you or your fiance went to visit each other? Those can be used as primary evidence. Also you didn't mention what your RFE was for, it could be that the RFE has nothing to do with the need for more primary evidence if you've already submitted some when you applied.
